A USCIS Form I-797 approval notice is the official letter confirming that an immigration application or petition has been granted. It comes in several variants, and the one you received determines what it actually lets you do — work, stay, travel, or nothing at all on its own. Reading the notice correctly, storing it properly, and knowing how to replace it if it goes missing will save you months of trouble the next time you need to prove your status.
Which Version of Form I-797 You Received
USCIS uses Form I-797 for a range of communications, from receipt confirmations to full approvals. You don’t fill it out; USCIS generates it in response to your filing.1U.S. Citizenship and Immigration Services. - I-797A is issued to people already inside the United States when an extension of stay or change of status is approved. The bottom portion is a detachable I-94 that serves as your new arrival/departure record and controls how long you can remain in the country.1U.S. Citizenship and Immigration Services. - I-797B is issued when USCIS approves a petition for a noncitizen worker. If you’re outside the country when you receive it, you still need a consular interview and a visa stamp before you can enter. - I-797C is the most common notice people see first. USCIS sends it to confirm receipt of your filing, to schedule biometrics or an interview, or to notify you of a case transfer. It is not an approval.
- I-797D accompanies a physical card, such as an Employment Authorization Document or a Permanent Resident Card, when the card is mailed to you.
The distinction is practical. An I-797C receipt notice grants no benefit on its own. An I-797A with an attached I-94 is direct proof of your authorized stay. An I-797B approves a petition but not a border crossing.
Reading the Dates and Numbers on Your Notice
Receipt Number and Priority Date
Every I-797 carries a unique 13-character receipt number: three letters followed by ten digits. Immigrant visa petitions subject to annual caps also carry a priority date. That date is your place in the visa queue. Until it becomes “current” on the Department of State’s monthly visa bulletin, you generally cannot move forward with adjustment of status or immigrant visa processing, even though the underlying petition is already approved.3U.S. Citizenship and Immigration Services. Petition Validity vs. I-94 Dates
On an I-797A, two separate sets of dates matter. The top portion shows the validity period of the approved petition, which controls your work authorization. The detachable I-94 at the bottom shows the dates of your authorized stay. Those dates often match, but not always.
Some classifications, including H-1B, L-1, and TN, include a grace period of up to 10 days before and after the petition validity dates. During those windows you’re in authorized stay but cannot legally work. If you leave the country and re-enter, Customs and Border Protection issues a new I-94 that replaces the one attached to your I-797A. When the two disagree, the most recently issued I-94 controls.
What to Do Right After the Notice Arrives
Check for Errors Immediately
Compare every field on the notice to your original filing. A wrong name, date of birth, or classification can cascade into failed background checks or denied entry at a port of entry. Store the Original Safely
Put the original somewhere secure: a fireproof safe, a locked cabinet. Make at least one high-quality scan or photocopy. Many agencies will accept a copy for initial processing while verifying the original electronically, and a digital backup makes replacement much easier if the paper goes missing.
Using the Notice with Other Agencies
Many state and federal agencies verify immigration status electronically through the Systematic Alien Verification for Entitlements (SAVE) program. When you apply for something like a driver’s license, the agency enters your receipt number or other identifiers into SAVE to confirm status within seconds.5U.S. Citizenship and Immigration Services. Verification Process If the automated check is inconclusive, the agency may ask for additional documents or a copy of your notice for manual review.
The Social Security Administration is stricter. SSA accepts a Permanent Resident Card (I-551), an Employment Authorization Document (I-766), or an I-94 with an unexpired foreign passport showing a work-permitting class of admission.6Social Security Administration. If you have an I-797A, though, the detachable I-94 at the bottom is an I-94, and SSA accepts it. Bring the right document rather than assuming the notice alone is enough.
Travel: What the Notice Does and Doesn’t Cover
An approval notice is not a travel document. If you hold an I-797B and are outside the United States, you still need a consular visa interview and a passport stamp before entering. Many consulates now verify approved petitions electronically through the Petition Information Management Service (PIMS) and no longer require the physical notice, but bringing the original is still a sensible precaution in case of gaps in the electronic record.
If you’re inside the country on an I-797A with an attached I-94, leaving and returning requires either a valid visa stamp in your passport or advance parole, depending on your status. The I-797A alone will not get you past a port of entry. Confirm you have the right combination of documents before booking international travel.
If Your Notice Never Arrived or You Lost It
Start With the Free Options
If the notice never came, start with the USCIS e-Request system. Filing Form I-824
When the free options don’t resolve it, or when you need USCIS to take a specific action on an already-approved case (such as notifying a consulate or issuing a duplicate of a CBP-approved notice), the formal path is Form I-824, Application for Action on an Approved Application or Petition.9U.S. Citizenship and Immigration Services. The I-824 has a filing fee, which USCIS updates periodically; check the current amount on the USCIS fee schedule before filing. As of 2026, USCIS no longer accepts personal checks, money orders, or cashier’s checks for paper-filed forms unless you qualify for a specific exemption. Expedite Requests
If the delay is causing serious harm, USCIS considers expedite requests case by case, entirely at its discretion. The recognized grounds include severe financial loss (for a person, job loss may qualify; for a company, risk of failure, loss of a critical contract, or layoffs), emergency or humanitarian situations, government interest, and clear USCIS error.11U.S. Citizenship and Immigration Services. Expedite Requests Simply needing work authorization does not qualify, and neither does a humanitarian-based application without time-sensitive evidence. Every request should include supporting documentation. A bare assertion of hardship rarely succeeds.
Keep Your Address Current With USCIS
Most delivery problems trace back to an outdated address. Federal law requires most noncitizens in the United States to report any change of address to USCIS within 10 days of moving.12Office of the Law Revision Counsel. 8 USC 1305 – Notices of Change of Address You do this by filing Form AR-11 online through the USCIS website or by mail.13U.S. Citizenship and Immigration Services. Filing the AR-11 online takes about five minutes and costs nothing. Do it as soon as you move, before any pending case reaches a decision. If USCIS mails your approval notice to an old address, getting a replacement adds weeks or months to whatever you’re trying to accomplish.
