Form I-765 PDF: Application for Employment Authorization

Form I-765, the Application for Employment Authorization, is the form you file with U.S. Citizenship and Immigration Services to request an Employment Authorization Document (EAD). Standard filing costs $470 online or $520 by paper, though several categories pay more, less, or nothing at all.1U.S. Citizenship and Immigration Services. Who Can File Form I-765

Your eligibility depends on your immigration status or the benefit you have pending. Federal regulations at 8 CFR 274a.12 sort eligible applicants into classes, each identified by a code you enter on the form.2eCFR. 8 CFR 274a.12 – Classes of Aliens Authorized to Accept Employment Choosing the wrong code is one of the most common reasons USCIS issues a Request for Evidence or denies an application, so verify yours before filing.

The categories fall into two broad groups. The first covers people already authorized to work by virtue of their status who need the card as proof. Refugees admitted under section 207 use category (a)(3); people granted asylum under section 208 use (a)(5). The second group covers people who need USCIS to grant them work authorization. The most commonly filed codes include:

  • (c)(9) for applicants with a pending Form I-485 adjustment of status
  • (c)(3)(B) for F-1 students seeking post-completion Optional Practical Training, and (c)(3)(C) for the 24-month STEM OPT extension
  • (c)(26) for H-4 spouses of H-1B holders whose principal has an approved Form I-140
  • (c)(8) for applicants with a pending asylum case
  • (a)(12) for those granted Temporary Protected Status and (c)(19) for TPS applicants
  • (c)(33) for DACA recipients with a pending or approved Form I-821D

Documents You Need Before You Start

Missing a single item is enough to trigger a delay or a Request for Evidence, so pull everything together before you open the form.

Personal Information

Your legal name, date of birth, and country of citizenship have to match your passport exactly. You also need your Alien Registration Number (A-Number) or USCIS Online Account Number if you have one, and a U.S. mailing address where USCIS can send the card.

General Supporting Evidence

Every application, regardless of category, should include:

  • Two identical 2×2 passport-style photographs, unmounted and unretouched, with your name and A-Number written lightly in pencil on the back4U.S. Citizenship and Immigration Services. Form I-765, Application for Employment Authorization
  • A copy of your Form I-94, front and back, or a printout of the electronic version
  • A copy of your passport biographical page
  • A copy of any previous or expiring EAD

Photos cause more trouble than applicants expect. USCIS rejects digitally enhanced or retouched images, and submitting them can force an in-person appearance at an Application Support Center to verify your identity.

Category-Specific Evidence

Every category layers additional documents on top of the general list. Two common examples show how different the requirements can be. F-1 students filing for OPT must include a Form I-20 that has been signed and endorsed for OPT by their Designated School Official before filing, and post-completion OPT applicants must submit the I-765 within 30 days after the DSO enters the OPT recommendation in SEVIS.6Department of Homeland Security. Translations

Any document not in English must include a full English translation. The translator has to attach a signed certification confirming they are competent to translate from the source language and that the translation is accurate and complete, along with the translator’s printed name, signature, and date.

Signatures

If you file on paper, sign the form by hand in ink. USCIS does not accept typed names, stamped signatures, or electronic signatures from platforms like DocuSign on paper-filed forms. A photocopy of a handwritten signature is technically allowed under the USCIS Policy Manual, but in practice USCIS has been issuing Requests for Evidence questioning reproduced signatures, so mailing the original ink signature is safest. A parent or legal guardian may sign for an applicant under 14.

Filing Fees

The correct fee depends on your category, whether you file online or on paper, and in some cases when you filed a related application. Current tiers:1U.S. Citizenship and Immigration Services. G-1055 Fee Schedule

  • Standard: $520 paper, $470 online for most initial, renewal, or replacement applications
  • Pending adjustment of status, I-485 filed on or after April 1, 2024: $260 online or paper
  • Pending adjustment of status, I-485 filed between July 30, 2007 and April 1, 2024 with fee paid: $0
  • Replacement due to USCIS or USPS error: $0
  • Refugees (a)(3) and asylees (a)(5): no fee

Several categories now carry a mandatory additional fee. Initial EADs under TPS granted (a)(12), certain (c)(8) ABC asylum applicants, most parolees (c)(11), and TPS applicants (c)(19) pay an additional $560. Renewals in those categories add $275 to $280. A paper-filed initial TPS EAD, for example, totals $1,080. Underpaying by even a dollar leads to rejection, so run the numbers through the USCIS fee calculator before you seal the envelope.

How to Pay

USCIS stopped accepting personal checks, money orders, and cashier’s checks for paper-filed forms in October 2025.7U.S. Citizenship and Immigration Services. Fee Waivers

If you cannot afford the fee, submit Form I-912 with your application. You qualify if your household income is at or below 150% of the Federal Poverty Guidelines at filing, or if you or a qualifying family member currently receives a means-tested benefit such as Medicaid, SNAP, TANF, or SSI.10U.S. Citizenship and Immigration Services. Filing Online vs. by Mail

Online

Online filing is faster and cheaper when your category supports it. You can complete and submit the form through a USCIS online account for categories including F-1 OPT ((c)(3)(A), (B), and (C)), TPS holders (a)(12), asylum applicants (c)(8), certain parolees (c)(11), TPS applicants (c)(19), and DACA (c)(33). Adjustment applicants (c)(9) can upload a completed PDF through the online system but cannot use the interactive online form.12U.S. Citizenship and Immigration Services. Forms Available to File Online One trap: if your (c)(9) filing is fee-exempt, do not use the PDF upload option. The system will demand payment and USCIS will not refund it.

Paper

If your category is not eligible for online filing, mail the package to the correct USCIS Lockbox. The address varies by category and sometimes by where the underlying petition was filed. F-1 OPT applications go to the Chicago Lockbox, asylum applications to Dallas, and H-4 spouses to Dallas or Phoenix depending on the receipt number prefix of the principal’s petition.13U.S. Citizenship and Immigration Services. If you are filing the I-765 with another form such as I-485 or I-539, the whole package goes to the address for the primary form, not the I-765 address.

When you assemble a paper package, put the payment form (G-1450 or G-1650) or fee waiver request on top, followed by the signed I-765, then your supporting documents.

After You File

USCIS processes the payment first. If it clears, you receive Form I-797C, a receipt notice with a case number you can use to check status online. If the payment fails for any reason, USCIS rejects the filing and you lose the original filing date, which can be costly in categories with filing deadlines.

Processing times vary by category and by the service center handling the case. USCIS publishes estimates on its website; they change often, so check periodically rather than relying on one snapshot. Once approved, the card ships by USPS. If You Need It Faster

Premium processing is available only for F-1 students filing pre-completion OPT, post-completion OPT, and STEM OPT. The fee is $1,780 as of March 1, 2026.15U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service It is not offered for other I-765 categories.

Other applicants can request a discretionary expedite. USCIS approves these only when specific criteria are met. The strongest basis is severe financial loss not caused by the applicant’s own late filing, such as a company at risk of losing a critical contract or an individual facing job loss or loss of critical public benefits.16U.S. Citizenship and Immigration Services. Renewals: The Automatic Extension Is Gone

If you are renewing an existing EAD, the rules changed sharply in late 2025. An interim final rule eliminated the automatic extension entirely for renewal applications filed on or after October 30, 2025.17eCFR. 8 CFR 274a.13 – Application for Employment Authorization Under the new rule, your EAD expires on the date printed on the card and your work authorization ends the following day, whether or not a renewal is pending. Filing early no longer buys any additional time on the card itself.

The practical consequences depend on your category. For most (c) categories, whose work authorization exists only because of the EAD, losing the card means losing the right to work until USCIS approves the new one. For most (a) categories, work authorization continues based on the underlying status, but you will not have the physical document to show an employer.18Federal Register. Renewals filed before October 30, 2025 keep the old 540-day automatic extension protection.18Federal Register. File as early as USCIS allows, which is generally up to 180 days before expiration, and use premium processing or an expedite request if your category qualifies.

If You Move While the Case Is Pending

Notify USCIS within 10 days of moving. If you do not, USCIS will send your receipt notice, approval, and the EAD itself to the old address. Updating through your USCIS online account satisfies the reporting requirement and refreshes the case management system almost immediately. Paper Form AR-11 by mail also works but takes longer.
