Form I-765: Eligibility, Filing Steps, and EAD Fees

To apply for employment authorization, you file Form I-765 with U.S. Citizenship and Immigration Services under the eligibility category that matches your immigration situation, attach the evidence that category requires, pay the correct fee (or request a waiver), and wait for USCIS to issue your Employment Authorization Document. Processing runs roughly one to six months depending on the category. The steps below walk through each decision in order.

Step 1: Identify Your Eligibility Category

Every I-765 turns on a three-character alphanumeric code that tells USCIS why you qualify to work. The code you enter in Part 2, Item 27 determines your fee, your required evidence, and whether you can even file the form. Step 2: Gather the Required Documents

Some evidence is universal. Some depends on your category.

What Every Applicant Submits

If you’ve never held an EAD before, add a copy of a government-issued identity document showing your photo, name, and date of birth. A passport biographical page works, as does a photo national ID card or a visa issued by a foreign consulate.

Include a copy of your Form I-94 arrival/departure record, which you can retrieve through the Customs and Border Protection online portal.7USAGov. You can also ask USCIS to have the Social Security Administration issue a new or replacement card once your EAD is approved.

Category-Specific Evidence

H-4 spouses need a marriage certificate, proof of H-4 status, and documentation of the H-1B holder’s qualifying petition. F-1 students need school certification of their program and OPT recommendation. Pending asylum applicants submit evidence tied to their asylum case. The instructions list the specific evidence for each code, so work from the section that matches yours.

Filling Out the Form

Indicate whether this is an initial EAD, a renewal, or a replacement.8U.S. Citizenship and Immigration Services. Employment Authorization Enter your eligibility code in Part 2, Item 27. Answer all questions about immigration and law enforcement history truthfully. On paper, sign in black ink. Typed and stamped signatures are rejected.

Step 3: Pay the Fee (or Request a Waiver)

The filing fee depends on your category and whether you file online or on paper. As of 2026, F-1 OPT and STEM OPT applicants pay $470 online or $520 on paper. Other categories carry different amounts. Confirm your fee against the current USCIS fee schedule and the I-765 instructions before you send anything.

Pay by money order, personal check, or cashier’s check made out to the U.S. Department of Homeland Security. Paper filers can pay by credit card by attaching Form G-1450. Online filers pay electronically at submission.

Fee Waivers

If you can’t afford the fee, submit Form I-912 to request a waiver based on financial hardship.9U.S. Citizenship and Immigration Services. Form I-912, Request for Fee Waiver Most I-765 categories are eligible, but DACA applicants under (c)(33) cannot request a fee waiver.10U.S. Citizenship and Immigration Services. Premium Processing and Expedites

Premium processing is available for OPT and STEM OPT classifications through Form I-907. The premium processing fee for Form I-765 is $1,780 as of March 1, 2026.11Federal Register. Adjustment to Premium Processing Fees If premium processing exists for your category, you generally cannot request a discretionary expedite instead.12U.S. Citizenship and Immigration Services. For categories without premium processing, you can ask USCIS to expedite. Approval is entirely discretionary. USCIS considers severe financial loss, humanitarian emergencies, and clear USCIS errors, and expects supporting documentation. General need for work authorization does not qualify.

Step 4: File Online or by Mail

Filing method depends on your category. As of early 2026, these categories can file through the USCIS online portal: (c)(3)(A), (c)(3)(B), (c)(3)(C) OPT and STEM OPT; (c)(8) pending asylum; (a)(12) TPS holders; (c)(19) certain TPS applicants; (c)(11) humanitarian parolees; and (c)(33) DACA.13U.S. Citizenship and Immigration Services. If your category isn’t listed for online filing, mail your application to the USCIS Lockbox facility assigned to your residence and eligibility category. The correct address is in the I-765 instructions and on the USCIS website. Wrong-address filings can be rejected, so verify before you mail.

Step 5: What Happens After You File

USCIS mails Form I-797C, a Notice of Action, confirming receipt.14U.S. Citizenship and Immigration Services. Some applicants are scheduled for a biometrics appointment at an Application Support Center for fingerprints and a photo.15U.S. Citizenship and Immigration Services. If USCIS needs more information, it issues a Request for Evidence explaining what’s missing and how to satisfy the requirement.16U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 – Part E – Chapter 6 – Evidence Late or incomplete responses are treated the same as no response.

How Long Processing Takes

Median processing times through early FY 2026, based on USCIS data:

  • Pending asylum applications: under 1 month
  • DACA renewals: about 2.3 months
  • Pending adjustment of status: about 4.3 months
  • Parole-based applications: about 6.2 months
  • Most other categories: about 4.1 months

These are medians. Half of cases take longer.17U.S. Citizenship and Immigration Services. Historic Processing Times The USCIS Case Processing Times tool gives current estimates once you enter your form, eligibility category, and the service center or field office handling the case.

If You Move

Report any address change to USCIS within 10 days.18U.S. Citizenship and Immigration Services. How to Change Your Address Use the Enterprise Change of Address tool in your USCIS online account and enter the receipt number for each pending case. A U.S. Postal Service change of address does not update USCIS, and USPS will not forward USCIS mail. If a biometrics notice or RFE goes to your old address and you miss it, the consequences fall on you.

Renewing an EAD in 2026

USCIS recommends filing renewals up to 180 days before the current EAD expires.19U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization File early. The reason matters more now than it used to.

Before October 30, 2025, a timely renewal filing gave you an automatic extension of work authorization for up to 540 days while USCIS processed the case. That extension no longer applies to renewals filed on or after October 30, 2025.20U.S. Citizenship and Immigration Services. Automatic Employment Authorization Document (EAD) Extension The only exception is certain TPS-related extensions provided through Federal Register notices.

So for renewals filed in 2026, your current EAD expires on its printed date. If USCIS hasn’t decided the renewal by then, you cannot work in the gap. Early filing, and premium processing where it’s available, are the two levers you have.

Working Without Authorization Can Block Your Green Card

Unauthorized work isn’t only an employer problem. Under the Immigration and Nationality Act, unauthorized employment is a bar to adjustment of status, and it can disqualify you from getting a green card through the standard process.21U.S. Citizenship and Immigration Services. Some categories escape the bar. Immediate relatives of U.S. citizens (spouses, unmarried children under 21, and parents of citizens over 21) can adjust despite a history of unauthorized work. Certain employment-based applicants can adjust under INA 245(k) if their total unauthorized employment and status violations since their most recent lawful admission don’t exceed 180 days.

USCIS counts every calendar day of unauthorized work toward the 180-day limit, whether you worked a full shift or an hour. Filing an adjustment application does not stop the clock. Only an approved EAD, stopping the work, or an approved adjustment ends the count. In a world without automatic EAD extensions, the gap between an expired card and a renewed one is exactly where this clock ticks.

Replacing a Lost or Damaged EAD

If your card is lost, stolen, or damaged, file a new Form I-765, mark it as a replacement, and pay the fee (or request a waiver).2U.S. Citizenship and Immigration Services. Employment Authorization Document If the card arrived with wrong information because of a USCIS error, you don’t file a new application or pay a fee; you return the card to USCIS with an explanation. If the error was yours, refile and pay.

If USCIS Denies Your Application

There is no formal appeal from an I-765 denial. Two paths remain. You can file a motion to reopen or reconsider on Form I-290B within 30 days of the denial, or 33 days if the notice was mailed. A motion to reopen requires new evidence that you meet the eligibility requirements. A motion to reconsider argues that USCIS applied the law incorrectly on the existing record. You can also file a fresh I-765 if you can establish eligibility. When the denial came down to missing evidence rather than an underlying eligibility problem, refiling with a clean, complete package is often faster than a motion. Read the denial notice carefully; USCIS is required to say why, and the reason tells you which route fits.
