Form 8892 gives you an automatic six-month extension to file a federal gift tax return (Form 709 or Form 709-NA), moving the deadline from April 15 to October 15. It also serves as a payment voucher if you owe gift tax or generation-skipping transfer (GST) tax. One thing it does not do: extend the time to pay. When You Need Form 8892
There are two scenarios. The first is when you want more time to file your gift tax return and you have not already requested an income tax extension. The second is when you owe gift or GST tax and need to send in a payment with your extension request.1Internal Revenue Service. Instructions for Form 8892
If you already filed Form 4868 (or Form 2350) to extend your individual income tax return, your gift tax return deadline is extended automatically. You do not need Form 8892 for the extension itself.2Internal Revenue Service. A quick note on when a gift tax return is even required. For 2026, gifts of $19,000 or less per recipient do not trigger a filing obligation.3Internal Revenue Service. How to Complete the Three Parts
The form fits on one page plus a detachable payment voucher.
Part I: Donor Information
Enter your first name, middle initial, last name, and taxpayer identification number (usually your Social Security number). Add your full mailing address. If you are filing on behalf of a donor who died during the year, use the donor’s information here.
Part II: Extension Request
Check the box requesting the automatic six-month extension to file Form 709 or Form 709-NA. No written justification is required. If the donor died during the year, enter the date of death.1Internal Revenue Service. Instructions for Form 8892
Part III: Payment Voucher
Fill in Part III only if you are sending money. Detach it and mail it with your check or money order. Enter the calendar year the tax applies to and the amounts of gift tax and GST tax you are paying. Make checks or money orders payable to “United States Treasury.” Write your Social Security number, daytime phone number, the tax year, and “Form 8892” on the payment so the IRS can match it to your account if it gets separated from the voucher.6Internal Revenue Service. Pay by Check or Money Order
Deadline, Timing Rule, and Where to Send It
Form 8892 is due by the regular filing deadline for Form 709 or Form 709-NA: April 15 of the year after the gift. If April 15 falls on a weekend or legal holiday, the deadline moves to the next business day.
One timing rule surprises people. Unless the donor has died, you cannot file Form 8892 before January 1 of the year the return is due. The IRS will not process it earlier than that.1Internal Revenue Service. Instructions for Form 8892

The Extension Does Not Extend Time to Pay
This is the pitfall. Filing Form 8892 gives you six more months to prepare and submit the return. It does nothing for the payment deadline. Any gift or GST tax you owe is still due April 15.5eCFR. 26 CFR 25.6081-1 – Automatic Extension of Time for Filing Gift Tax Returns
If you are not sure how much you owe, estimate on the high side and pay with Part III. You can claim a refund of any overpayment when you file the actual return. Penalties for Late Filing and Late Payment
Two separate penalties can apply on top of interest.
The failure-to-file penalty is 5% of the unpaid tax for each month (or partial month) the return is late, capped at 25%. If you filed Form 8892 properly, this penalty is measured from the extended October 15 deadline. The failure-to-pay penalty is 0.5% of the unpaid tax per month, also capped at 25%. This one runs from the original April 15 payment deadline, not the extended filing deadline. In any month where both penalties apply, the failure-to-file penalty is reduced by the failure-to-pay amount, so you will not owe more than 5% total for that month. Both penalties are calculated against the tax actually owed. If your gifts do not exceed your lifetime exemption and no tax is due, a late return generally will not generate a failure-to-file penalty. Filing on time is still the safer path, because the IRS can assess penalties if it later determines a tax obligation existed.
Gift Splitting and Deceased Donors
Married Couples Who Split Gifts
Married couples can elect to treat gifts as coming equally from both spouses. For 2026, that lets a couple give up to $38,000 per recipient within the annual exclusion.3Internal Revenue Service. There is a narrow exception. If only one spouse made gifts, all gifts were present-interest gifts, and the total to each recipient stayed at or below $38,000, only the donor spouse needs to file, with the other spouse signing consent on that return. When both spouses have to file and both need more time, each requests their own extension on a separate Form 8892 (or Form 4868).
When the Donor Died During the Year
If the donor died during the tax year, the executor files the gift tax return. The deadline is the earlier of two dates: the due date (with extensions) for the donor’s estate tax return, or April 15 of the following year, extended if a gift tax extension was granted.10Internal Revenue Service.
