Form 8809 Instructions: Deadlines, Filing, and Penalties

Form 8809, Application for Extension of Time to File Information Returns, gives you an extra 30 days to file forms like the 1099 series, W-2, 1042-S, 5498, and the ACA 1094/1095 forms with the IRS. For most of these returns the extension is automatic if you submit a properly completed form by the original due date. For Form W-2 and Form 1099-NEC the rules are stricter: the extension is never automatic, you must justify the request, and you can only file on paper. The instructions below walk through what to enter, when to file, and how to submit it.

Returns You Can Extend With Form 8809

Line 6 of the form lists every return type Form 8809 covers. You check the box for each type you need extended and enter the number of returns for each.1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns

  • Form W-2, filed with the Social Security Administration.
  • The 1099 series, along with Forms 1097, 1098, 3921, 3922, and W-2G (one shared checkbox), plus separate checkboxes for Form 1099-NEC and Form 1099-QA.
  • Form 1042-S for income paid to foreign persons.
  • The 5498 series (5498, 5498-ESA, 5498-QA, 5498-SA), each with its own checkbox.
  • ACA reporting Forms 1094-C, 1095-C, and 1095-B.2Internal Revenue Service. About Form 8809 – Application for Extension of Time to File Information Returns
  • Form 8027, the employer’s annual report of tip income.

One Form 8809 can cover several return types at once. If you need extensions for 1099-MISC and 1042-S, check both boxes and enter the count for each. You do not file a separate form per return type.

Form 8809 is only for information returns you file with the IRS about payments to third parties. It has nothing to do with your own income tax return. Personal income tax extensions go on Form 4868,3Internal Revenue Service. Form 4868 – Application for Automatic Extension of Time To File U.S. Individual Income Tax Return and business income tax extensions go on Form 7004.4Internal Revenue Service. When Form 8809 Is Due

Your Form 8809 must reach the IRS by the original due date of the return you’re trying to extend. That date depends on which return you’re filing.1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns

  • Form W-2 and Form 1099-NEC are due January 31, whether you file paper or electronic. Your Form 8809 is due January 31 as well.5Internal Revenue Service. Information Return Reporting
  • Most other 1099s, 1098s, and similar returns are due February 28 on paper or March 31 electronically. Your Form 8809 is due by whichever of those matches your filing method.6Internal Revenue Service. A Guide to Information Returns

If you mail a paper Form 8809, the postmark controls. A day late and the IRS can deny the request outright, in which case you get no extension at all.

Filling Out the Form

The form is short. You provide your name, address, and Taxpayer Identification Number (your EIN if you’re a business, SSN if you’re a sole proprietor). Add a contact name, phone number, and email. On line 6, check the box for every return type you want to extend and write in the number of returns for each type.1Internal Revenue Service. Line 7 is where you check a hardship reason. You only complete line 7 when the extension is nonautomatic, meaning any request for W-2 or 1099-NEC, or a second 30-day request for other forms. The acceptable reasons are:1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns

  • Your business was in a federally declared disaster area and operations or records were affected.
  • The person responsible for filing died, became seriously ill, or was unavoidably absent.
  • A fire, casualty, or natural disaster hit your business.
  • This is the first year your business has been in existence.
  • You didn’t receive necessary data from a third party (a Schedule K-1 or Form 1042-S, for instance) in time to prepare accurate returns.

Nonautomatic requests must be signed by the filer, the transmitter, or someone authorized to sign a return on your behalf.

W-2 and 1099-NEC Are Different

Extension requests for Form W-2 and Form 1099-NEC are never automatic, even for the initial 30 days. You must complete line 7, provide a justification, sign the form, and submit it on paper. Electronic filing is not available for W-2 or 1099-NEC extension requests.1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns

There is also no second extension for these two forms. You get one 30-day request, and if the IRS grants it, that’s all the extra time available. Anything filed after the extended deadline is late and subject to penalty.

A Second 30-Day Extension for Other Returns

If the first automatic 30 days weren’t enough for your other information returns, you can ask for a second 30-day extension. This one is nonautomatic. You must file a second Form 8809 before the first extension expires, complete line 7 with a qualifying reason, and sign the form.1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns The IRS will mail you a decision letter. If it denies the request, penalties accrue from the date the first extension ended.

How to Submit the Form

Electronic Filing

The IRS runs two electronic filing platforms for information returns. The older FIRE (Filing Information Returns Electronically) system accepts a fill-in Form 8809 for automatic 30-day extensions.2Internal Revenue Service. About Form 8809 – Application for Extension of Time to File Information Returns FIRE is scheduled to retire after filing season 2026, with tax year 2026 returns moving to the newer IRIS platform.7Internal Revenue Service. Filing Information Returns Electronically (FIRE)

The Information Returns Intake System (IRIS) supports electronic filing of returns and corrections and accepts automatic extension requests through either a free web portal or an application-to-application channel.8Internal Revenue Service. E-file Information Returns With IRIS If you’re setting up electronic filing for the first time, register for IRIS.

Both systems require a Transmitter Control Code (TCC), a five-digit code you apply for through the IRS. Each authorized user needs their own account.9Internal Revenue Service. IRIS Application for TCC Apply well before your filing deadline; approval isn’t instant.

If you file 10 or more information returns in a calendar year across all types combined, electronic filing is mandatory. That threshold dropped from 250 per type to 10 total starting with tax year 2023.10Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically Businesses above the threshold should submit their automatic extension requests electronically as well.11Internal Revenue Service. Paper Filing

Internal Revenue Service Center
Ogden, UT 84201-02091Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns

Send it certified with return receipt. That receipt is your proof of the postmark date if the IRS later questions timeliness. Paper is required for all nonautomatic requests, including any W-2 or 1099-NEC extension and any second 30-day request.

Confirmation

For automatic extensions, the IRS usually stays silent. If you don’t hear anything, the extension was accepted. For nonautomatic requests, the IRS mails a letter with its decision.2Internal Revenue Service. About Form 8809 – Application for Extension of Time to File Information Returns

Form 8809 Does Not Extend Recipient Statement Deadlines

An approved Form 8809 buys you more time to file with the IRS. It does nothing for the deadline to send copies to the workers and contractors named on those returns.1Internal Revenue Service. Form 8809 – Application for Extension of Time To File Information Returns For that, you file Form 15397, Application for Extension of Time to Furnish Recipient Statements. Form 15397 provides a one-time extension of up to 30 days for recipient copies. File it by the recipient statement due date, and no earlier than January 1.12Internal Revenue Service. Form 15397 – Application for Extension of Time to Furnish Recipient Statements

The IRS does not send an approval letter for Form 15397; you only hear back if the request is denied or incomplete. If you need both extensions, file both forms.

Penalties If You Miss the Deadline

Late or missing information returns are penalized per return, with the amount rising the longer you wait. For returns due in 2026:13Internal Revenue Service. Information Return Penalties

  • Up to 30 days late: $60 per return.
  • 31 days late through August 1: $130 per return.
  • After August 1 or not filed: $340 per return.
  • Intentional disregard: $680 per return, no annual cap.

Annual caps apply, and they’re higher for businesses with average annual gross receipts above $5 million than for those at or below that level.14Internal Revenue Service.
