Form 8453-EMP is the IRS signature declaration employers and payroll providers use when e-filing a federal employment tax return without a PIN-based electronic signature. It covers Forms 940, 941, 943, 944, and 945, confirms you reviewed and approved the return, authorizes your Electronic Return Originator (ERO) to transmit it, and, if you owe tax, authorizes direct debit from your bank account.1Internal Revenue Service. About Form 8453-EMP, E-file Declaration for Employment Tax Returns Without a signed 8453-EMP or an accepted electronic signature alternative, the IRS does not treat the return as filed.2Internal Revenue Service. When You Need Form 8453-EMP Instead of a PIN
The IRS accepts several signature methods for e-filed employment tax returns. Form 8879-EMP lets you and your ERO sign with a personal identification number, keeping everything digital.3Internal Revenue Service. About Form 8879-EMP, E-file Authorization for Employment Tax Returns Form 8453-EMP is the alternative when no PIN is used: you print it, sign by hand, and your software transmits a scan of the signed form with the return.4Internal Revenue Service. Employment Tax Modernized e-File (MeF) E-Signature Methods
If your preparer or payroll service uses a PIN method (including a Practitioner PIN, a 94x Online Signature PIN, or a Reporting Agent PIN), you do not need 8453-EMP for that return.4Internal Revenue Service. Employment Tax Modernized e-File (MeF) E-Signature Methods
What Goes on the Form
Enter your legal business name and Employer Identification Number exactly as they appear on the return you’re signing for, plus the tax period. In Part I, check the box for the specific return (940, 941, 943, 944, or 945) and copy in the financial figures from the corresponding lines, including total taxes after adjustments and any balance due or overpayment.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
One detail that trips filers up: match the return exactly. If a line on the return is blank, leave the corresponding line on 8453-EMP blank. If the return shows zero, enter zero.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
When an ERO or paid preparer is involved, the form asks for their firm name, address, and Preparer Tax Identification Number (PTIN). If the same person is both ERO and paid preparer, check the “Check if also paid preparer” box and skip the separate paid preparer section.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
Who Signs
The taxpayer or an authorized agent signs the declaration under penalty of perjury, attesting the return is accurate. If the return goes through an ERO, the ERO also signs to confirm they have met IRS e-file requirements. A paid preparer signs in the designated section unless they are also the ERO.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
How to Submit the Signed Form
The current version, revised December 2024, is built for electronic submission. Sign the printed form, scan it as a PDF, and your tax preparation software transmits the PDF along with the return. The instructions are explicit: file electronically and do not file paper copies.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024) Earlier versions required mailing paper to an IRS processing center; that step no longer applies.
Paying by Direct Debit
Checking the electronic funds withdrawal box authorizes the U.S. Treasury to pull the tax owed directly from your bank account. Your software captures the routing number, account number, account type, payment amount, and the debit date.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
To cancel a scheduled payment, call the U.S. Treasury Financial Agent at 888-353-4537 no later than two business days before the debit date. After that window, the withdrawal will process, and you would have to resolve any overpayment or error with the IRS separately.2Internal Revenue Service. Form 8453-EMP (Rev. December 2024)
If the Return Rejects on the Business Name
When you transmit, the IRS matches your EIN against a short “name control” (up to four characters) it assigned when the EIN was issued. A mismatch rejects the return outright.5Internal Revenue Service. Using the Correct Name Control in E-Filing Corporate Tax Returns Confirm the EIN first, then check the name control against IRS rules. If the rejection continues, particularly after a recent business name change, call the IRS e-Help Desk at 1-866-255-0654. For a name change, check the “Name Change” box on the return itself and retransmit.6Internal Revenue Service. Using the Correct Name Control in E-Filing Partnership Tax Returns
Keeping Your Copy
Employers must keep employment tax records for at least four years after the tax becomes due or is paid, whichever is later. That includes your signed Form 8453-EMP and the supporting documentation for the return.7Internal Revenue Service. How Long Should I Keep Records? Because the form is now transmitted as a scanned PDF, keep both the digital copy and the wet-signed original in case the IRS ever asks you to verify the signature.
