Form 720 for LLCs: PCORI Fee, Deadlines & Fuel Credits

An LLC must file Form 720, the Quarterly Federal Excise Tax Return, for any calendar quarter in which it engages in an activity subject to a federal excise tax. The trigger is the activity, not the LLC’s size, revenue, or profit. Most LLCs never touch Form 720. The ones that do face strict twice-a-month deposit rules and stacking penalties, so the first job is figuring out whether you’re in the system at all.

Activities That Pull an LLC Into Form 720

Federal excise taxes attach to specific goods, services, and activities. If your LLC handles any of them during a quarter, you owe a return for that quarter.

Fuel is the most common entry point. LLCs that produce, import, or sell gasoline, diesel, kerosene, aviation fuel, or other taxable motor fuels report and remit those taxes quarterly, at rates published in the Form 720 instructions.1Internal Revenue Service. Instructions for Form 720

Air transportation is another. LLCs selling air passenger tickets or air freight collect and remit excise taxes on those transactions. The passenger ticket tax combines a percentage of the fare with a per-segment charge that adjusts for inflation; for 2026, the domestic segment fee is $5.30 per passenger.2Federal Aviation Administration. Environmental and Superfund excise taxes hit LLCs that manufacture, import, or use ozone-depleting chemicals or listed taxable chemical substances. The IRS continues to add substances to the taxable list.4Internal Revenue Service. Several less obvious activities also pull you in. Manufacturing or importing sport fishing equipment, fishing rods, bows, arrow components, or certain firearms and ammunition. Indoor tanning services, which carry a 10% customer-collected tax. Vaccine manufacturing, taxed per dose. Buying insurance from foreign insurers, where premium taxes run from 1% on life and reinsurance up to 4% on casualty coverage.3Internal Revenue Service. The PCORI Fee Catches Many Employer LLCs Off Guard

If your LLC sponsors a self-insured health plan, you owe the Patient-Centered Outcomes Research Institute (PCORI) fee, and it’s reported and paid on Form 720.6Internal Revenue Service. Patient-Centered Outcomes Research Trust Fund Fee – Questions and Answers Employers often don’t think of health benefits as excise-tax territory, which is how the deadline sneaks past them.

For plan years ending between October 1, 2025, and September 30, 2026, the fee is $3.84 per covered life. Covered lives include employees, dependents, retirees, former employees, and anyone on COBRA. You multiply the average number of covered lives during the plan year by the applicable dollar amount.6Internal Revenue Service. Always File Under the LLC’s EIN

Your LLC’s income tax classification does not carry over to excise taxes. The IRS treats LLCs as disregarded entities, partnerships, or corporations for income tax purposes.8Internal Revenue Service. Limited Liability Company (LLC) For excise taxes, even a normally disregarded single-member LLC is treated as a separate entity.

That means a single-member LLC must use its own name and EIN when filing Form 720, registering excise activities on Form 637, and claiming refunds on Form 8849.9Internal Revenue Service. Single Member Limited Liability Companies Filing under the owner’s personal SSN is one of the most common mistakes and can trigger penalties and processing delays. Multi-member LLCs file under the LLC’s EIN as well. Whatever your income tax classification, excise taxes go under the LLC’s identity.

Quarterly Deadlines and Semi-Monthly Deposits

Form 720 is due on the last day of the month after each calendar quarter:1Internal Revenue Service. Instructions for Form 720

  • Q1 (January–March): April 30
  • Q2 (April–June): July 31
  • Q3 (July–September): October 31
  • Q4 (October–December): January 31

When a deadline lands on a weekend or federal holiday, it shifts to the next business day.

Filing the quarterly return is only half the obligation. Most excise taxes listed in Part I of Form 720 require deposits twice a month. The IRS defines two semi-monthly periods: the 1st through the 15th, and the 16th through the last day of the month.10Internal Revenue Service. Notice 2025-55 – Relief from Penalty for Failure to Deposit Remittance Excise Tax

Each deposit must equal at least 95% of the net tax liability for that semi-monthly period and is due by the 14th day after the period ends.10Internal Revenue Service. Notice 2025-55 – Relief from Penalty for Failure to Deposit Remittance Excise Tax In practice, the deposit for days 1–15 is due by the 29th of the same month, and the deposit for days 16 to month-end is due by the 14th of the next month.11Internal Revenue Service. Changes to the Requirements for Excise Tax Returns

All deposits go through the Electronic Federal Tax Payment System (EFTPS). Enroll in advance and schedule payments at least one business day before they’re due.1Internal Revenue Service. Instructions for Form 720

The $2,500 Small-Liability Exception

If your LLC’s total net liability for Part I taxes is $2,500 or less for the entire quarter, you can skip the semi-monthly deposits and pay the full amount with the return.1Internal Revenue Service. Instructions for Form 720 The exception covers Part I only. Part II taxes, including the PCORI fee, follow their own schedules.

Fuel Credits That Reduce What You Owe

LLCs that buy taxable fuel and use it for certain nontaxable purposes can claim credits directly on Schedule C of Form 720 instead of filing a separate refund claim. Qualifying uses include farming, off-highway business use, commercial fishing, school buses, use by nonprofit educational organizations, and export.1Internal Revenue Service. Instructions for Form 720 Only the entity that actually purchased and used the fuel can claim the credit, and the credit offsets excise tax liability on the same return.

Penalties and Interest

Form 720 penalties come from three directions, and they stack.

A late return without reasonable cause draws a failure-to-file penalty of 5% of the unpaid tax for each month or part of a month the return is overdue, capped at 25%.12Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax The cap arrives in five months.

Missing a semi-monthly deposit triggers a separate penalty based on how late the deposit arrives:13Office of the Law Revision Counsel. 26 USC 6656 – Failure to Make Deposit of Taxes

  • 1–5 days late: 2% of the underpayment
  • 6–15 days late: 5%
  • More than 15 days late: 10%
  • Still unpaid 10 days after a delinquency notice: 15%

These percentages apply to each missed deposit individually. An LLC that misses both semi-monthly deposits in a month pays the penalty twice.

Interest runs on top of penalties, compounded daily on any unpaid excise tax. The underpayment rate is 7% per year for Q1 202614Internal Revenue Service. Interest Rates Remain the Same for the First Quarter of 2026 and 6% for Q2 2026,15Internal Revenue Service. Internal Revenue Bulletin 2026-08 adjusted quarterly off the federal short-term rate.

Some excise taxes, including air transportation and indoor tanning taxes, are collected from customers and held in trust until deposited. If those trust fund taxes aren’t paid over, the IRS can personally assess the trust fund recovery penalty against anyone deemed responsible for collecting and remitting them. That reach extends to LLC members, officers, and employees with authority over tax payments.1Internal Revenue Service. Instructions for Form 720 The penalty equals 100% of the unpaid trust fund tax.

Fixing Mistakes With Form 720-X

Errors on a filed Form 720 get corrected on Form 720-X, the Amended Quarterly Federal Excise Tax Return, which handles both underpayments and overpayments.16Internal Revenue Service. About Form 720-X, Amended Quarterly Federal Excise Tax Return Identify the specific quarter and explain the adjustment.

Overpayments have a hard window. You generally must file 720-X within three years of the original return’s filing date or two years from the date the tax was paid, whichever is later.17Internal Revenue Service. Amended Quarterly Federal Excise Tax Return Past that, the refund claim is gone. If the correction increases tax owed, send payment with the amended return to stop penalties and interest from growing.

Form 720-X cannot adjust most Schedule C credits from the original return. The only Schedule C items you can correct on 720-X are the tire credit under section 4051(d) and section 6426 fuel credits.17Internal Revenue Service. Amended Quarterly Federal Excise Tax Return Other Schedule C credit corrections run through a different process.

Closing Out When the Activity Stops

If your LLC stops engaging in any excise-taxable activity, you don’t just stop filing. File a final Form 720 for the last quarter in which you had liability and check the “Final” return box above Part I. If there’s no tax to report for that quarter, enter zero on the relevant lines, write “None” on Part III, line 3, and sign the return.1Internal Revenue Service. Instructions for Form 720 Skipping the final return leaves the IRS expecting your next quarter and sending notices when it doesn’t arrive.
