Form 2848 vs. Form 8821: Scope, Authority, and How to Choose

Form 2848 and Form 8821 both authorize someone else to deal with your IRS account, but they grant very different powers: Form 2848, the Power of Attorney and Declaration of Representative, lets a qualified representative act on your behalf before the IRS, while Form 8821, the Tax Information Authorization, only lets a designee view your confidential tax information. If you need someone to argue an audit, negotiate a settlement, or sign an agreement, you need Form 2848. If a lender, accountant, or family member just needs to see your records, Form 8821 is enough.

Federal law treats tax return information as confidential, so the IRS will not discuss your account with anyone until the right authorization is on file.1Office of the Law Revision Counsel. 26 U.S. Code 6103 – Confidentiality and Disclosure of Returns and Return Information Picking the wrong form wastes weeks, so the choice is worth getting right the first time.

What Each Form Actually Authorizes

Form 2848 gives your representative authority to act for you before the IRS. That includes receiving and responding to notices, negotiating with agents, entering into agreements, and generally standing in your shoes on the tax matters you list.2Internal Revenue Service. About Form 2848, Power of Attorney and Declaration of Representative Audits, offers in compromise, and collections disputes all call for Form 2848.

Form 8821 is narrower by design. The designee can inspect and receive your confidential tax information for the matters and periods you list, and nothing more. They cannot speak for you, negotiate, sign anything, or make decisions about your account.3Internal Revenue Service. Instructions for Form 8821 – Tax Information Authorization It is the right tool when the third party’s job is to read, not to act, such as a mortgage lender verifying income or a new accountant reviewing prior-year returns.

Two limits apply to both forms. Neither one lets the authorized person endorse your refund check or receive a refund by direct deposit.3Internal Revenue Service. Instructions for Form 8821 – Tax Information Authorization And Form 2848 does not automatically let your representative sign your tax return; that requires an explicit authorization on line 5a and is allowed only in narrow circumstances such as disease or injury, extended absence from the United States, or specific IRS permission.4Internal Revenue Service. Who You Can Name

Form 8821 is open. You can name a family member, a business partner, a financial advisor, or a firm. The designee does not need any professional credential.

Form 2848 is restrictive. The person you appoint must be eligible to practice before the IRS. The usual choices are attorneys, CPAs, and enrolled agents, who have unlimited representation rights. Enrolled actuaries and enrolled retirement plan agents also qualify, but only for specific Internal Revenue Code sections tied to retirement plans. Unenrolled return preparers, family members, employees, and students can represent taxpayers only under limited circumstances, and students working in qualified Low Income Taxpayer Clinics or Student Tax Clinic Programs need a special appearance authorization from the Taxpayer Advocate Service.2Internal Revenue Service. About Form 2848, Power of Attorney and Declaration of Representative Part II of Form 2848 lists every eligible designation (a) through (r), and the representative must select the right one when signing.4Internal Revenue Service. Instructions for Form 2848 – Power of Attorney and Declaration of Representative

So if the person you want to help is not eligible to practice before the IRS, Form 2848 is not an option regardless of what you want them to do. Form 8821 may still work if their role is limited to receiving information.

How to Choose Between Them

Match the form to what the third party actually needs to do.

  • Facing an audit, appeal, collections action, or offer in compromise: Form 2848.
  • Hiring a tax professional to respond to an IRS notice on your behalf: Form 2848.
  • Giving a mortgage lender access to verify income from your returns: Form 8821.
  • Letting a new accountant pull prior-year transcripts to prepare this year’s return: Form 8821.
  • Allowing a bookkeeper or advisor to monitor your account for notices without acting on them: Form 8821.

You can file both. If a firm’s paralegal will pull transcripts while its enrolled agent handles the case, one Form 8821 and one Form 2848 covers the split of duties.

Rules That Apply to One Form but Not the Other

Signature Timing

On Form 2848, the representative must sign within 45 days of the taxpayer’s signature. The window stretches to 60 days if the taxpayer lives outside the United States.4Internal Revenue Service. Instructions for Form 2848 – Power of Attorney and Declaration of Representative Form 8821 has a different clock: when it is submitted for a non-tax purpose such as income verification for a loan, the IRS must receive it within 120 days of the taxpayer’s signature or the form is returned. That deadline does not apply when Form 8821 is being used to resolve a tax matter with the IRS.3Internal Revenue Service. Instructions for Form 8821 – Tax Information Authorization

Tax Matters and Periods

Both forms require specific entries: the type of tax (such as “Income” or “Employment”), the form number (such as “1040” or “941”), and the exact years or periods.5Internal Revenue Service. Form 8821 – Tax Information Authorization You can list past, current, and future periods, but the IRS will not record a future period more than three years past December 31 of the year it receives the form.6Internal Revenue Service. Instructions for Form 2848 Vague entries like “all years” or “all future periods” get the form rejected.

Special Authorities on Form 2848

Some powers do not come automatically with the Form 2848 appointment. If you want your representative to substitute or add other representatives, access your IRS records through an intermediate service provider, or authorize the IRS to disclose your information to another third party, you must check the corresponding box on line 5a. Without that grant, the representative cannot do those things.4Internal Revenue Service. Instructions for Form 2848 – Power of Attorney and Declaration of Representative Form 8821 has no equivalent because its designee has no authority to act in the first place.

Estates and Trusts

If you are signing Form 2848 on behalf of an estate or trust, you are acting as a fiduciary, not a representative. The IRS may require you to file Form 56, Notice Concerning Fiduciary Relationship, alongside Form 2848 to establish your authority.4Internal Revenue Service. Submitting the Form and What Happens Next

Either form can go in by mail, fax, or through the IRS online portal, using the address or fax number from the Where To File chart in the instructions.7Internal Revenue Service. One caution on signatures: if you use an electronic signature on Form 2848, the form must be submitted through the IRS online portal. The Tax Pro Account is a separate, fully digital route that records most individual-taxpayer authorizations to the Centralized Authorization File in real time. It currently handles only individual taxpayer authorizations; business entities have to use another submission method.9Internal Revenue Service. Tax Pro Account

For all other channels, processing has historically taken about one to several weeks and has stretched longer during IRS backlogs. Sending a duplicate because you are tired of waiting only adds to the queue; if nothing has posted after roughly 30 days, contact the IRS to check status rather than resubmit.10Taxpayer Advocate Service. Lighter Alternatives to Consider First

Sometimes neither form is needed. When you file a return, a checkbox near the signature area lets you designate someone to discuss that specific return with the IRS. The designee can answer questions and receive information about the return’s processing, but cannot represent you or sign anything, and the authorization expires one year from the return’s due date.11Internal Revenue Service. If you just need someone in the room for a single call or meeting, the IRS can accept oral authorization on the spot after confirming identities. It lasts only for that conversation.12Internal Revenue Service. Disclosure Authorizations

How the Authorization Ends

A Form 2848 power of attorney stays in effect until you revoke it, your representative withdraws, or an expiration date you wrote on the form arrives.13Internal Revenue Service. Power of Attorney and Other Authorizations It also becomes invalid when the taxpayer dies; the executor or administrator must then file a new Form 2848, generally along with Form 56.4Internal Revenue Service. Instructions for Form 2848 – Power of Attorney and Declaration of Representative

Filing a new Form 2848 automatically revokes earlier powers of attorney on file for the same tax matters and periods unless you check the box on line 6 to retain them and attach copies of each one you want to keep.14Internal Revenue Service. Form 2848, Power of Attorney and Declaration of Representative Form 8821 works the same way: a new submission cancels prior tax information authorizations for the same matters unless you opt to retain them.3Internal Revenue Service. State Taxes Are Separate

Neither Form 2848 nor Form 8821 reaches state revenue agencies. Most states have their own power of attorney and tax information authorization forms, and a federal filing does not carry over. If your issue involves both federal and state tax accounts, plan on filing parallel paperwork with each agency.
