Form 1099 Reporting Requirements, Deadlines, and Penalties

Form 1099 reporting requirements apply whenever your business pays a non-employee for services, rent, royalties, or other qualifying income above the threshold set for that payment type. For payments made during the 2026 tax year, the Form 1099-NEC threshold rises from $600 to $2,000 per payee, which narrows the pool of contractors you’ll need to report.1Internal Revenue Service. Form 1099 NEC and Independent Contractors Everything else about the system, deadlines, penalties, e-filing rules, remains in place, and getting any piece wrong generates IRS notices and per-form fines.

When a Payment Triggers a 1099

Only payments made in the course of a trade or business count. Hire a plumber for your rental property and the payment is likely reportable; hire the same plumber for your home and no 1099 is required. What matters is whether you paid as a business, not what the recipient does with the money.

The filing obligation sits with the payer. Sole proprietors, partnerships, LLCs, corporations, nonprofits, and estates or trusts running a trade or business all qualify as filers. If your business pays a non-employee and the yearly total crosses the relevant threshold, you owe the IRS a 1099.2Office of the Law Revision Counsel. 26 USC 6041A – Returns Regarding Payments of Remuneration for Services and Direct Sales

Picking the Right Form and Threshold

More than 20 versions of the 1099 exist. Most small businesses only touch three.

Form 1099-NEC

The NEC covers nonemployee compensation: fees, commissions, and payments for services performed by someone who isn’t your employee. For payments made during 2026, the threshold is $2,000 per payee for the calendar year.1Internal Revenue Service. Form 1099 NEC and Independent Contractors If you’re filing early in 2026 for the 2025 tax year, the older $600 threshold still governs those payments. The $2,000 figure covers only payments made after December 31, 2025.

Form 1099-MISC

The MISC handles business income that doesn’t fit on the NEC. Rent payments, prizes, awards, and other miscellaneous income each carry a $600 threshold. Royalties trigger reporting at just $10.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC The line between NEC and MISC catches filers regularly. If you paid someone for work performed, use the NEC. Rent on office space or prize payouts belong on the MISC.

Form 1099-K

The 1099-K covers card and third-party network payments (PayPal, Venmo, and similar). The threshold is $20,000 and more than 200 transactions in a calendar year, and both must be met before a filing is required.4Internal Revenue Service. IRS Issues FAQs on Form 1099-K Threshold Under the One Big Beautiful Bill The payment processor files it, not the business making the payment.

Who You Don’t Have to Send a 1099 To

Several categories are exempt, and paperwork gets easier once you know them.

  • Payments to C corporations and S corporations are generally exempt from 1099-NEC reporting. The one common exception is attorney fees: send a 1099-NEC to a law firm regardless of its entity type.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
  • Payments made by credit card, debit card, PayPal, or similar services don’t go on a 1099-NEC or 1099-MISC. The payment processor handles them through the 1099-K.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
  • Wages to W-2 employees never go on a 1099. Misclassifying employees as contractors to avoid payroll taxes is a separate and expensive problem.
  • Payments for personal, non-business purposes create no 1099 obligation at all.

The corporate exemption catches first-time filers. Your vendor’s W-9 tells you their entity type. If it shows a C or S corporation, skip the 1099 unless you paid them for legal services.

Collect the W-9 First

The single most important step happens before you cut the first check: get a completed Form W-9 from every vendor or contractor. The W-9 gives you the payee’s legal name, address, entity type, and Taxpayer Identification Number, which is either a Social Security Number or an Employer Identification Number.5Internal Revenue Service. About Form W-9, Request for Taxpayer Identification Number and Certification

Chasing down W-9s in January is the leading cause of missed deadlines and wrong filings. Collecting them upfront also gives you a TIN certified under penalty of perjury, which protects you if the number turns out to be wrong.6Internal Revenue Service. Form W-9 – Request for Taxpayer Identification Number and Certification When you prepare the 1099, W-9 data flows straight into the payee fields. TIN errors are the most common problem and are the ones that generate IRS notice letters.

Deadlines

Deadlines depend on the form and the filing method.

When a deadline lands on a weekend or federal holiday, it shifts to the next business day. Form 8809 grants an automatic 30-day extension for filing with the IRS.7Internal Revenue Service. About Form 8809, Application for Extension of Time to File Information Returns Note the limit: Form 8809 only extends the IRS filing deadline, not the January 31 date for getting copies to recipients. Recipients get their copies on time regardless of any extension you file.

How to File

The IRS has pushed filers steadily toward electronic submission, and for most businesses paper filing is no longer available.

The 10-Return E-File Rule

If you file 10 or more information returns of any type during the year, you must file electronically.8Internal Revenue Service. E-file Information Returns The count aggregates across return types. Four Forms 1099-NEC plus six Forms 1099-MISC equals ten, and you’re over the line. W-2s count toward the total too. Paper filing is only an option below the threshold.

Filing Through IRIS

The IRS Information Returns Intake System (IRIS) is a free web portal for keying in individual forms or uploading batches in CSV format.9Internal Revenue Service. E-file Information Returns With IRIS IRIS confirms receipt and flags errors so you can fix them before penalties start running. The older FIRE system is being wound down, and the IRS is directing all filers to move to IRIS.10Internal Revenue Service. Filing Information Returns Electronically (FIRE)

Paper Filing

Businesses below the 10-return threshold can still file on paper. Every paper submission needs Form 1096, a transmittal cover sheet summarizing the total number of forms and the total dollar amounts reported.11Internal Revenue Service. General Instructions for Certain Information Returns Each type of 1099 needs its own separate Form 1096. Use the official scannable forms, not printed copies, and send the package to the IRS service center for your region. E-filing removes the 1096 requirement entirely.

Fixing a Filed 1099

How you correct depends on what went wrong.

Wrong Dollar Amount or Checkbox

Prepare a new 1099 with the corrected figures, check the “CORRECTED” box at the top, and submit it with a new Form 1096 or through IRIS. Don’t resend the original incorrect return.11Internal Revenue Service. General Instructions for Certain Information Returns

Wrong TIN, Name, or Form Type

These need a two-step fix. First, submit a corrected return that mirrors the original but zeroes out all dollar amounts, which cancels the incorrect filing. Second, submit a brand-new return, without the “CORRECTED” box checked, containing the accurate information. Both go together with a single Form 1096 noting the reason for the correction in the bottom margin.11Internal Revenue Service. General Instructions for Certain Information Returns

The two-step process is where most filers slip. Simply checking “CORRECTED” and typing in the right name leaves the IRS with two records for the same payment under two different identities. Zeroing out the original and refiling from scratch is the only clean replacement.

h2>Backup Withholding

When a payee doesn’t give you a valid TIN, or when the IRS tells you a TIN is incorrect, you have to withhold 24% of each payment and send it to the IRS.12Office of the Law Revision Counsel. 26 USC 3406 – Backup Withholding The requirement also kicks in when the IRS sends a “B notice” flagging a name/TIN mismatch. You keep withholding on future payments until the payee resolves the discrepancy. Everything you withhold during the year gets reported on Form 945, due January 31 of the following year.13Internal Revenue Service. Instructions for Form 945 Collecting W-9s upfront and verifying TINs before the first payment is the simplest way to avoid the whole mechanism.

Penalties

Penalties are assessed per form and scale with how late you correct. For returns due in 2026:14Internal Revenue Service. Information Return Penalties

  • Corrected within 30 days of the deadline: $60 per return
  • Corrected after 30 days but by August 1: $130 per return
  • Filed after August 1 or not filed at all: $340 per return
  • Intentional disregard: $680 per return, or 10% of the total amount required to be reported, whichever is greater. No annual cap applies at this tier.15Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns

Every form counts separately. A business that issues 50 late 1099s pays 50 times the per-return amount, not one flat penalty. Even the lowest tier adds up quickly on a small margin.

State Filing

Many states require 1099 filings on top of the federal return. The IRS runs a Combined Federal/State Filing Program that automatically forwards electronically filed 1099s to participating states, which removes the need for a separate state submission.16Internal Revenue Service. Topic No. 804, FIRE System Test Files and Combined Federal/State Filing Program Not every state participates, and some participating states add their own notification requirements. Check with your state’s tax agency to confirm whether the combined program covers you or whether a separate filing is required.
