Form 1096 Meaning: Filing Instructions, Deadlines, and Penalties

Form 1096 is a one-page cover sheet that goes on top of paper information returns (like 1099s, 1098s, and W-2Gs) when you mail them to the IRS. It tallies how many forms are in the envelope and the total dollars reported, so the IRS can check that the batch matches what you say you sent. If you file your information returns electronically, you never touch it. And because the IRS now requires electronic filing for anyone submitting 10 or more information returns in a year, Form 1096 only matters to the smallest paper filers.

What Form 1096 Does and Which Returns It Covers

The official name is “Annual Summary and Transmittal of U.S. Information Returns.”1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns Think of it as a packing slip. If you send 30 copies of Form 1099-NEC reporting a combined $45,000 in contractor payments, the 1096 should show exactly 30 forms and exactly $45,000. When the numbers don’t match, the IRS sends back a notice requesting corrections, which delays processing and can trigger penalties.

Form 1096 is used to transmit paper copies of Forms 1097, 1098, 1099 (all variants), 3921, 3922, 5498, and W-2G.1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns The ones most small businesses encounter:

  • Form 1099-NEC, for payments of $600 or more to independent contractors and other non-employees.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
  • Form 1099-MISC, for rents, prizes, awards, and other miscellaneous payments.
  • Form 1099-INT, for interest income paid to an individual or entity.
  • Form 1099-DIV, for dividends and capital gain distributions.
  • Form 1098, for mortgage interest received from borrowers.
  • Form W-2G, for certain gambling winnings above specific thresholds.

Each type of form gets its own Form 1096. If you issued 1099-NECs to contractors and 1099-INTs to account holders, you prepare two separate 1096s and mail them in separate envelopes.3Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

When You Don’t Need Form 1096

If you file electronically, you skip Form 1096 entirely. The transmittal function is handled by the filing software.1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns

This is the point most filers miss: the IRS lowered the electronic filing threshold dramatically starting in 2024. If you file 10 or more information returns in a calendar year, you must file electronically.4Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically The count is aggregated across all return types, not counted separately for each form. Six 1099-NECs plus four 1099-MISCs is 10 total, and you’re required to e-file all of them.5Internal Revenue Service. General Instructions for Certain Information Returns (2025) The old threshold was 250 returns per type, which is why you’ll still see that number in older guides.

So Form 1096 now matters only to filers with nine or fewer total information returns who choose paper.

How to Fill Out Form 1096

The form is short but unforgiving about accuracy.

The top section asks for your legal name, address, and either your Employer Identification Number (EIN) in Box 1 or your Social Security number in Box 2.3Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

Box 3 is the total count of individual forms in the batch. Twelve copies of Form 1099-NEC means “12.”

Box 4 is the total federal income tax withheld across all the attached forms. Many 1099s show zero withholding, so this box is often blank or zero.

Box 5 is the total dollar amount reported across all attached forms. The instructions specify which box on each type of return to use when calculating this total. For 1099-NEC, it’s the amount from Box 1 on every form in the package. A few return types (1098-T, 1099-A, 1099-G) don’t require an entry here.3Internal Revenue Service. Box 6 is the checkbox grid where you mark which type of form you’re transmitting. Only one box per Form 1096, which is why different return types require separate 1096s.

Finally, you sign and date the form under a perjury declaration confirming the information is correct.

You Can’t Print Form 1096 From the IRS Website

This trips up more filers than almost anything else. The IRS prints the official version with special ink that its scanning equipment can read, and a regular printer can’t replicate it. The form itself warns: “Do not print and file a Form 1096 downloaded from this website; a penalty may be imposed for filing with the IRS information return forms that can’t be scanned.”3Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns Photocopies are also not accepted.

Order official forms through the IRS online ordering page at IRS.gov.6Internal Revenue Service. Order Paper Information Returns and Employer Returns Orders typically arrive within 15 business days, so plan ahead if you’re filing close to the deadline. Many payroll and accounting software packages also generate IRS-compatible versions that meet scanning requirements.

Filing Deadlines and Mailing Addresses

The deadline depends on which information return you’re transmitting:

  • January 31 for Form 1099-NEC. This deadline applies to both furnishing copies to recipients and filing the paper return with the IRS.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
  • February 28 for most other paper information returns, including 1099-MISC, 1099-INT, 1099-DIV, and 1098. Filed electronically, these same returns are due March 31.7Internal Revenue Service. 2026 Publication 1099

When a deadline falls on a weekend or federal holiday, it shifts to the next business day.

The IRS runs two processing centers for paper information returns. Businesses in the eastern and southern states (Alabama, Arizona, Arkansas, Connecticut, Delaware, Florida, Georgia, Kentucky, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, Texas, Vermont, Virginia, Washington D.C., and West Virginia) mail to Austin, TX 78714-9213. Businesses in the remaining states mail to Kansas City, MO 64121-9256.3Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

Send the forms in a flat mailer. Do not fold them. The IRS scanning equipment needs unfolded pages.

If you can’t meet the deadline, Form 8809 lets you request an automatic 30-day extension for most information returns, including the 1099 series.8Internal Revenue Service. About Form 8809, Application for Extension of Time to File Information Returns The extension applies to the IRS filing, not to the recipient copies, so your payees still need their 1099s by the original date.

Fixing a Mistake After You File

You don’t correct the original Form 1096. You file a new one to transmit the corrected returns.5Internal Revenue Service. General Instructions for Certain Information Returns (2025)

For a wrong dollar amount or incorrect code, prepare a corrected version of the 1099, attach it to a new Form 1096, check the “CORRECTED” box on the 1096, and mail it to the same processing center. Do not include a copy of the original incorrect return.

For a wrong TIN, wrong payee name, or a form that should have been a different type entirely, you’ll file two information returns, one to zero out the incorrect original and one with the correct information, along with a new Form 1096. Write “Filed To Correct TIN,” “Filed To Correct Name,” or “Filed To Correct Return” in the bottom margin of the 1096.5Internal Revenue Service. General Instructions for Certain Information Returns (2025) Use a separate Form 1096 for each type of return you’re correcting.

Penalties for Filing Late or Wrong

The IRS charges penalties per return, not per Form 1096, so the cost scales with how many information returns you have. For returns due in 2026:9Internal Revenue Service. Information Return Penalties

  • $60 per return if corrected within 30 days of the deadline
  • $130 per return if corrected after 30 days but by August 1
  • $340 per return if filed after August 1 or not filed at all
  • $680 per return for intentional disregard, with no annual cap

These add up fast. A business that files 20 late 1099-NECs after August 1 faces $6,800 in penalties. Small businesses with average annual gross receipts of $5 million or less get lower annual caps on total penalties, but the per-return amounts are the same.10Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns

Filing paper returns when you were required to e-file (because you had 10 or more returns) triggers these same penalties.4Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically The IRS can waive penalties if you demonstrate reasonable cause, meaning you exercised ordinary business care but still couldn’t comply. That request must be made in writing and signed under penalty of perjury. A phone call won’t do it.
