Form 1042 Due Date, Extensions, and Late Penalties

The Form 1042 due date is March 15 of the year after the calendar year in which you paid U.S. source income to foreign persons. For 2025 payments, March 15, 2026 falls on a Sunday, so the return is due Monday, March 16, 2026.1Internal Revenue Service. Discussion of Form 1042, Form 1042-S and Form 1042-T The same date applies to filing Forms 1042-S with the IRS and furnishing copies to recipients.2Department of the Treasury Internal Revenue Service. Whenever March 15 lands on a Saturday, Sunday, or legal holiday, the due date rolls to the next business day. One point that trips up filers: you must file Form 1042 even if you withheld nothing. If you made reportable payments to foreign persons and a treaty reduced the rate to zero, the return is still required.3eCFR. 26 CFR 1.1461-1 – Payment and Returns of Tax Withheld

How to Extend the Form 1042 Filing Deadline

File Form 7004 by the original March 15 deadline and you get an automatic six-month extension to September 15. No explanation is required; the extension is granted on timely submission.4Internal Revenue Service. About Form 7004

The extension covers the paperwork only. Any tax owed is still due March 15. Failure-to-pay penalties and interest accrue on unpaid balances from that date forward, even when the extension itself is perfectly valid.1Internal Revenue Service. Discussion of Form 1042, Form 1042-S and Form 1042-T Treat the extension as time to reconcile and paper the return, not time to fund the liability.

Separate Extensions for Forms 1042-S

Form 7004 does not extend Form 1042-S obligations. If you need more time to file Forms 1042-S with the IRS, submit Form 8809 by March 15 for an automatic 30-day extension through the FIRE system.5Internal Revenue Service. About Form 8809, Application for Extension of Time to File Information Returns That extension applies to filing with the IRS only.6Department of the Treasury Internal Revenue Service. Extra time to deliver 1042-S copies to recipients is a separate request: fax Form 15397 to the IRS before the furnishing deadline. This one is discretionary, not automatic. The IRS grants it only for qualifying circumstances such as a federally declared disaster, the illness or death of the person responsible for filing, or missing payee data. Approved requests typically add 30 days.7Internal Revenue Service. Extension of Time to Furnish Statements to Recipients

Deposits Are Due Throughout the Year

You cannot hold the withheld tax until March 15. Deposits go through the Electronic Federal Tax Payment System on a schedule tied to how much you have accumulated. The 2025 Form 1042 instructions set out three tiers:8Internal Revenue Service. 2025 Instructions for Form 1042

  • $2,000 or more accumulated at a quarter-monthly period end: deposit within 3 business days. Quarter-monthly periods end on the 7th, 15th, 22nd, and last day of each month.
  • $200 to $1,999 at month end: deposit within 15 days after month end. If you already made a $2,000-or-more deposit that month under the first rule, carry any remaining balance under $2,000 to the next month.
  • Under $200 at year end: pay with Form 1042 or deposit by March 15 of the following year.

A missed deposit is its own penalty event, separate from any consequences on the annual return. Filers who let deposits slide until March and then pay in full with Form 1042 routinely see stacked penalties on top of the correct total tax.

What It Costs to Miss the Deadline

Failure to File

If Form 1042 is not filed by the due date, including any extension, the IRS charges 5% of the unpaid tax for each month or partial month the return is late, capped at 25%.9Internal Revenue Service. Failure to File Penalty When the failure-to-pay penalty also applies, the filing penalty is reduced by the payment penalty amount for that month, but the combined charge still builds quickly.

Failure to Pay

A 0.5% per month penalty applies to any tax unpaid after March 15, capped at 25%.10Internal Revenue Service. Topic No. 653 – IRS Notices and Bills, Penalties and Interest Charges This runs even during a valid filing extension. Interest also accrues on the underpayment from the due date until it is cleared, at rates the IRS sets quarterly.

Failure to Deposit

Late deposit penalties climb by how many calendar days a deposit is overdue:11Internal Revenue Service. Failure to Deposit Penalty

  • 1 to 5 days late: 2% of the unpaid deposit
  • 6 to 15 days late: 5% of the unpaid deposit
  • More than 15 days late: 10% of the unpaid deposit
  • More than 10 days after a first IRS notice, or upon an immediate payment demand: 15% of the unpaid deposit

The rates do not stack. A deposit 12 days late owes the 5% rate, not 2% plus 5%.

Late or Incorrect Forms 1042-S

The 1042-S penalties run on the same March 15 clock. For returns due in 2026, the per-return amounts are:12Internal Revenue Service. Information Return Penalties

  • Corrected within 30 days of the due date: $60 per return
  • Corrected after 30 days but by August 1: $130 per return
  • Corrected after August 1 or never filed: $340 per return
  • Intentional disregard: $680 per return with no annual cap

Annual caps vary by filer size. Businesses with average annual gross receipts of $5 million or less face lower ceilings, such as $1,366,000 for the general tier in 2026, compared with $4,098,500 for larger filers.13Internal Revenue Service. Rev. Proc. 2024-40 A parallel penalty of up to $340 per statement applies to incorrect statements furnished to recipients for 2026.14Internal Revenue Service. Penalties Related to Form 1042-S

Any of these penalties can be abated if you show reasonable cause and that the failure was not due to willful neglect. That argument is difficult to win without documentation of what went wrong and the steps you took to comply. Willful failures can rise to criminal exposure for evasion or fraud in the most serious cases.

Practical Timing

Three dates carry the year on Form 1042. Deposits move on the quarter-monthly or monthly schedule during the year. Tax is paid by March 15. The return, and the Forms 1042-S it summarizes, are filed by March 15 as well, or September 15 with a timely Form 7004 for Form 1042 itself. The total on Form 1042 must match the combined withholding across every Form 1042-S you issued; when they don’t match, expect IRS correspondence regardless of whether you filed on time.
