Food Stamps Stolen: Federal Replacement and State Claims

If your food stamps were stolen through card skimming, cloning, or a phishing scam, cancel your EBT card immediately, document every fraudulent charge, and contact your state SNAP agency. Whether you can get the money replaced depends on timing. The federal program that reimbursed stolen SNAP benefits expired on December 20, 2024.¹ Theft that happened between October 1, 2022 and that date may still be claimable through your state. Theft after that date has no guaranteed federal remedy, though a bill in Congress would restore one.

What to Do in the First Hour

Speed is what protects the balance you still have. Call the customer service number printed on the back of your EBT card and cancel the card. That stops any further withdrawals. A replacement usually arrives within five to ten business days, and any remaining balance transfers to it.

While you have the representative on the line, ask them to note that you are reporting suspected fraud. Then open your state’s EBT portal or the ConnectEBT app and screenshot every transaction you don’t recognize. Write down the dollar amounts, dates, times, and store locations. That record is the backbone of any replacement claim.

Federal rules don’t require a police report, but filing one creates a paper trail that can help if your state investigates. At a minimum, keep dated notes showing you acted as soon as you noticed the theft.

Is Federal Replacement Still Available?

The Consolidated Appropriations Act of 2023 let states use federal money to replace SNAP benefits stolen through electronic fraud. The window ran from October 1, 2022 through December 20, 2024, and a later spending bill dropped the extension.² The program has not been reauthorized.

A bipartisan bill called the Fairness for Victims of SNAP Skimming Act of 2025 was introduced in the Senate on April 30, 2025, and referred to the Committee on Agriculture, Nutrition, and Forestry, but it has not advanced.³

What that means in practice:

If your benefits were stolen before December 21, 2024 and you never filed a claim, call your state SNAP agency and ask whether it is still accepting claims from the covered period.
If the theft happened after December 20, 2024, no federal program guarantees replacement. Some states use their own funds or emergency programs to help, but most do not. Your local SNAP office can tell you what is available where you live.

What Kinds of Theft Qualified

The federal program covered electronic theft the cardholder couldn’t reasonably prevent. Three methods accounted for almost all of it.⁴

Skimming happens when a criminal attaches a small reader to a store’s card terminal. Swiping the card copies your account number and PIN. It’s the most common form of EBT theft and the reason Congress acted in the first place.

Cloning is the follow-up. Once a thief has your data, they load it onto a duplicate card and spend down your balance somewhere else.

Phishing uses a text, email, or call that pretends to be your benefits agency. The message asks for your card number and PIN. Some scammers spoof official government phone numbers so the call looks legitimate.⁴

Some situations did not qualify. If your card was physically lost and then misused, or a household member or acquaintance used it without permission, that fell outside federal replacement. Cases where the cardholder voluntarily shared a PIN were also excluded.

How to File a Claim With Your State

Replacement claims go through your state SNAP agency, not USDA directly. Most states built a dedicated form and many still host it on the benefits website. The form includes a signed statement confirming the benefits were stolen through electronic fraud. Filing a false statement can lead to fraud charges and disqualification, so only submit if the theft actually happened.

You can generally submit through the online benefits portal, by mail, by fax, or in person. Online submissions usually produce a confirmation number worth saving. Federal guidance suggested that claims filed within 30 days of discovery were timely, though states set their own deadlines.⁵ If you are filing now for an older incident, ask whether the state will still accept it.

After you file, the state mails a formal notice of approval or denial. Turnaround varies; federal guidance pointed states toward the same timeline they use for standard food-loss claims, which generally means a decision within about 10 days.

How Much You Can Get Back

The federal program capped replacement at the lesser of two figures: the actual amount stolen, or two months of your household’s benefit allotment.⁵ If your household gets $450 a month and a skimmer took $1,200, the maximum recovery is $900. If the thief took $300, you get $300 because that’s the smaller number.

Households were also limited to two replacement claims per federal fiscal year (October 1 through September 30).⁶ A third theft in the same fiscal year was not covered. The pending Senate bill would remove the two-month cap and replace stolen amounts in full, but it isn’t law.⁷

If Your Claim Is Denied

Every SNAP household has the right to a fair hearing when it disagrees with a state agency’s decision, and that includes a denied replacement claim.⁸ You can request the hearing orally or in writing, and you can review your case file before it happens.

You have 90 days from the agency’s action to request the hearing.⁸ Bring your transaction records, screenshots of the fraudulent charges, and the denial letter. Someone else can represent you — a lawyer, a friend, or a family member. If free legal services operate in your area, the state agency is required to tell you about them.

Cash Benefits on the Same Card

Many EBT cards hold both SNAP food benefits and TANF cash assistance. Federal SNAP replacement did not cover cash. Separately, the Administration for Children and Families encouraged states to reimburse stolen TANF by classifying the payment as a non-recurrent short-term benefit, which means it doesn’t count against the five-year TANF lifetime limit and doesn’t trigger work requirements.⁹ Participation is voluntary, so whether your state does this varies. If cash was taken from your card, report it the same way and ask your caseworker specifically about TANF replacement.

Protecting Your Card From the Next Theft

Because replacement is no longer guaranteed, prevention matters more than it used to. USDA has announced chip-and-tap EBT cards, but there is no firm nationwide deadline and the magnetic stripe on current cards remains vulnerable.¹⁰

Change your PIN at least once a month, and change it right before your benefits load. Skip obvious patterns like 1111, 1234, or 9876. Cover the keypad with your free hand every time you enter your PIN, even when no one seems to be watching. Skimmers often pair with tiny cameras aimed at the keys.⁵

Look at the card reader before you swipe. If the slot feels loose, sits higher than readers at neighboring registers, or wobbles when you touch it, don’t use it. Tell the store manager and call the local police.

Never share your PIN or card number with anyone outside your household, including someone claiming to work for the state benefits office. Your state agency will not call or text asking for your PIN. Check your balance through the state’s EBT portal or phone line often enough that you catch strange transactions before the account is drained.⁵
