FMCSA DataQs: Filing an RDR to Challenge Inspections and Crashes

FMCSA DataQs is the federal system for challenging inspection reports, crash records, and other safety data you believe are wrong. You file a Request for Data Review (RDR) online, attach evidence, and a state or federal reviewer decides whether to change the record. There’s no filing fee. What it costs you is the time to pull documentation and write a clear, factual explanation of the error.

Corrections matter because the same records feed your Safety Measurement System scores and, for drivers, the Pre-Employment Screening Program report an employer may pull before hiring. A single misattributed crash or wrong violation code can push insurance rates up and draw compliance attention you didn’t earn.

What You Can Challenge

  • Roadside inspection reports with wrong violation codes, misidentified drivers, or equipment issues that never existed or had already been corrected.
  • Crashes attributed to your DOT number that involved a different carrier, or incidents that don’t meet the federal definition of a reportable crash.
  • Registration and insurance data that stayed stale after you filed updates.
  • Household goods complaints with wrong facts or applied to the wrong carrier.
  • Inspections assigned to the wrong carrier, which happens more often with similar names or after a merger.

The system is about factual accuracy. You’re showing the record itself is wrong, not arguing that a regulation is unfair.

Non-Reportable Crashes

Under 49 CFR 390.5, a reportable crash involves a commercial motor vehicle on a highway and results in a fatality, an injury with immediate medical treatment away from the scene, or disabling damage that requires at least one vehicle to be towed. Minor collisions where everyone drives away don’t qualify. Deadlines You Cannot Miss

States are required to accept and review RDRs submitted within three years from the date of an inspection, and five years from the date of a crash.3Federal Register. Waiting until a bad score triggers an audit to review your records is an expensive habit. A quarterly check keeps errors catchable while evidence is still fresh and witnesses are still reachable.

Documentation to Gather Before You File

A well-documented challenge with the evidence attached up front moves faster and wins more often. Reviewers are state analysts and FMCSA staff working through a large queue.

Start with the report number. For inspections, it’s at the top of the driver/vehicle examination report. For crashes, it’s on the official police report. You also need the date of the event and the DOT number involved, since that’s how the system locates the record. Carriers can pull inspection reports through the FMCSA Portal or from the state agency that ran the inspection.

Court Records for Dismissed or Reduced Citations

If you’re challenging a violation because the underlying citation was dismissed or you were found not guilty, you need certified court documentation. A dismissal without a fine or a not-guilty verdict removes the associated violation from the safety record entirely. Court proceedings can take months. If your case is still pending, wait for the final judgment before filing. Submitting without the paperwork burns a review cycle.

Crash and Equipment Evidence

Order the official police crash report from the responding law enforcement agency. Fees vary by jurisdiction. That report is what shows a crash was non-reportable, assigned to the wrong carrier, or eligible for preventability review.

For equipment violations, photographs taken at the scene or shortly after carry weight. Scan physical evidence to PDF or JPG for uploading. Keep the exact VIN and license plate number available; data-entry mistakes during roadside stops are one of the most common reasons records land on the wrong carrier’s profile.

Writing the Narrative

In the description field, stick to facts and cite the specific regulatory section at issue. Filing the RDR Online

Log in at the DataQs portal using either your FMCSA Portal credentials or a separate DataQs account. Carriers who use the Portal see every RDR tied to their DOT number, which is the simpler route if you already have Portal access.7Federal Motor Carrier Safety Administration. Add a new request. The portal walks you through screens to identify the record type, enter the dispute details, attach evidence files, and write the narrative. You can upload multiple documents. Proofread before submitting; sloppy errors in your own filing undermine the accuracy argument.

Tracking the Review and When Scores Update

The DataQs dashboard shows every RDR on your account and its current status. Automated emails go out when the status changes, and reviewers can request more documents through the portal’s messaging feature.1Federal Motor Carrier Safety Administration. DataQs Fact Sheet and User Roles

Check weekly. If a reviewer asks for more information and you don’t respond, the case stalls or closes without action. Processing times vary. A straightforward data-entry fix can wrap up in a couple of weeks; a contested crash review may take 60 to 90 days depending on the state agency’s workload.

When the review closes, you get one of two outcomes: the data was changed, or no change was made. An email confirms the decision.1Federal Motor Carrier Safety Administration. If Your Challenge Is Denied

A denial isn’t the end. If you have evidence that wasn’t part of your original submission, reopen the request. On the details page of the RDR, click the Correspondence tab, check the box asking for another review, add your new evidence and explanation, and submit.8Federal Motor Carrier Safety Administration. You get one reconsideration per request.8Federal Motor Carrier Safety Administration. DataQs Help Center FAQs Use it to fix the weakness that caused the denial: certified court records you didn’t have, better photos, a more detailed police report. Resubmitting the same evidence with a longer narrative rarely changes the outcome.

FMCSA has proposed an independent appeal tier for cases involving significant questions of legal interpretation or enforcement policy, available only after initial review and reconsideration. That proposal excludes purely factual disputes and would not cover CPDP or Drug and Alcohol Clearinghouse cases.9Federal Register. Crash Preventability Is a Separate Path

Even when a crash legitimately belongs on your record, the Crash Preventability Determination Program can remove it from your SMS scores if FMCSA agrees you couldn’t have avoided it.10Federal Motor Carrier Safety Administration. Frequently Asked Questions – Crash Preventability The program accepts 21 crash types covering situations where the CMV was the victim: being rear-ended, being struck by a wrong-way driver, hitting an animal, being hit by an impaired or distracted driver, and collisions caused by road debris or infrastructure failure, among others. If FMCSA finds the crash preventable, it stays in your SMS with a note. If the evidence is inconclusive, it stays with a note that reviewers couldn’t decide.10Federal Motor Carrier Safety Administration. Frequently Asked Questions – Crash Preventability The worst outcome is no change, so eligible crashes are worth submitting.

What Corrections Mean for Drivers

Prospective employers can pull a driver’s PSP report, which shows the most recent five years of crash data and three years of roadside inspection results from MCMIS.11Pre-Employment Screening Program. A PSP record can be updated to show that a crash was determined not preventable or that a driver was convicted of a different, less serious charge.11Pre-Employment Screening Program. PSP only shows what MCMIS contains; once the federal database is corrected, PSP follows.
