FLSA catch-up payments are the retroactive wages an employer must pay when it has underpaid a worker in violation of the Fair Labor Standards Act. They close the gap between what was paid and what the law required, and in most cases they come with an equal amount in liquidated damages that doubles the recovery. The payments can arrive through a Department of Labor investigation, a private lawsuit, or a negotiated settlement, and the calculation, taxation, and paperwork differ depending on the path.
What Triggers a Catch-Up Payment
The clearest trigger is being paid less than the federal minimum wage of $7.25 per hour, though many states set a higher floor. Overtime shortfalls are more common. The FLSA requires non-exempt employees to receive one and one-half times their regular rate for every hour past forty in a workweek, and employers frequently miscalculate the “regular rate” by leaving non-discretionary bonuses, commissions, or shift differentials out of it.1U.S. Department of Labor. Off-the-clock work is another steady source of claims. Setup before a shift, cleanup after clocking out, and answering work emails from home all count as compensable time. When those minutes go untracked, they accumulate into a back-pay obligation.
Misclassification often sits underneath a catch-up claim. To be treated as exempt from overtime under the executive, administrative, or professional categories, an employee must satisfy both a duties test and a salary threshold of $684 per week, or $35,568 per year.2U.S. Department of Labor. The same problem shows up when a business labels a worker an independent contractor to avoid overtime. How Much You Can Recover
The Look-Back Window
Recovery reaches back two years from the date the claim is filed. If the violation was willful, meaning the employer knew its conduct broke the law or showed reckless disregard for whether it did, the window extends to three years.3Office of the Law Revision Counsel. 29 USC 255 – Statute of Limitations The clock does not pause while the DOL investigates, so waiting to file means losing recoverable weeks off the back end.
The Regular Rate
Every overtime calculation starts with the regular rate, which is not simply the posted hourly wage. It is total weekly compensation divided by total hours worked, and the overtime premium is half that rate for each hour past forty. Non-discretionary bonuses, commissions, and shift differentials all belong in the numerator. Employers who compute overtime off the base wage alone underpay, and the difference becomes owed back wages.
Liquidated Damages
The FLSA adds liquidated damages equal to the unpaid wages, effectively doubling the recovery.4Office of the Law Revision Counsel. 29 USC 216 – Penalties Courts treat the doubling as the default, not something the worker has to prove separately. The one exception: if the employer shows it acted in good faith and had reasonable grounds to believe its pay practices were legal, a court can reduce or eliminate liquidated damages.5Office of the Law Revision Counsel. 29 USC 260 – Liquidated Damages This defense comes up most often when an employer relied on advice from a lawyer or accountant that turned out to be wrong. When a court denies full liquidated damages on that basis, it may award prejudgment interest instead.
Attorney’s Fees
A worker who wins an FLSA case also recovers reasonable attorney’s fees and court costs from the employer. Getting Paid Through the Department of Labor
When the Wage and Hour Division investigates and finds violations, it calculates what is owed and arranges for the employer to pay it. The DOL does not cut the checks itself; payment flows through the employer’s normal payroll system.6U.S. Department of Labor. Questions and Answers About PAID
The document that matters most is Form WH-58, the Receipt for Payment of Back Wages, Employment Benefits, or Other Compensation.7U.S. Department of Labor. Form WH-58 – Receipt for Payment of Back Wages Signing it accepts the settlement and waives certain rights, including the right to file a private lawsuit over the same violations.8U.S. Department of Labor. Back Pay The waiver language on the form identifies the specific damages being given up, such as additional liquidated damages or attorney’s fees beyond what the settlement includes.
This trade is worth thinking through. A DOL-supervised settlement often covers unpaid wages without the full liquidated-damages doubling. Once WH-58 is signed, the door closes on suing for the rest. If the numbers on the form look significantly lower than what a full FLSA recovery would produce, that is the moment to talk to an attorney before signing.
Private Lawsuits and Collective Actions
FLSA claims can also be brought as private lawsuits or resolved through negotiated settlements. Most federal courts hold that an FLSA settlement is enforceable only when approved by the DOL or a federal court, on the theory that the statute’s protections cannot be waived privately. A court reviewing a settlement confirms there is a genuine dispute over hours or pay and that the terms are fair. A minority of courts allow private settlements without judicial approval.
Cases involving multiple workers can proceed as collective actions, which resemble class actions with one key difference. Each worker must affirmatively opt in by filing written consent with the court; nobody is automatically included.4Office of the Law Revision Counsel. 29 USC 216 – Penalties The statute of limitations keeps running for each person until they file that consent, so a delayed opt-in loses recoverable weeks.
Taxes on What You Receive
The back-wages portion is treated as supplemental wages. Federal income tax can be withheld at a flat 22% (or 37% on amounts over $1 million in a calendar year) rather than through your normal bracket.9Internal Revenue Service. Liquidated damages are treated differently. The IRS does not consider them wages, so no FICA or income tax is withheld. They are reported on Form 1099-MISC, Box 3. If a settlement arrives as a single lump sum, confirm that the back-wages piece and the liquidated-damages piece are separately stated on the paperwork. Mixing them into one figure creates reporting problems at tax time for both sides.
Protection From Retaliation
An employer cannot legally fire, demote, cut hours, or otherwise punish a worker for filing an FLSA complaint, cooperating with a DOL investigation, or testifying in a wage-and-hour proceeding.11Office of the Law Revision Counsel. 29 USC 215 – Prohibited Acts The protection applies even if the underlying wage claim turns out to be wrong, as long as it was raised in good faith. Retaliation is a separate cause of action with its own damages, on top of whatever the employer already owes for the original violation.
If You Think You Are Owed Money You Never Received
When the DOL recovers back wages but cannot locate the worker they belong to, the agency holds the money for three years while continuing to search. As of October 2025, all back-wage payments are made electronically, so anyone who previously received paper checks needs to update their information through the DOL’s Workers Owed Wages system.12U.S. Department of Labor.
