A Fiktionsbescheinigung is a temporary certificate the German immigration office (Ausländerbehörde) issues to keep your legal status intact while it decides on your residence permit application. It operates on a legal fiction under Section 81 of the Residence Act (Aufenthaltsgesetz): your status is treated as valid even though your permit has expired or has not yet been issued. What you can actually do with the certificate depends entirely on which of two versions you hold, and the difference decides whether you can work, whether you can travel, and whether your health insurance keeps running.1Gesetze im Internet. Residence Act (Aufenthaltsgesetz)
The Two Versions
German law creates two separate fictions, and the paragraph printed on your certificate is the single most important piece of information on it.
A certificate under Section 81 Paragraph 4 applies when you filed your renewal or new application before your existing residence permit expired. It creates a continuation fiction (Fortgeltungsfiktion): your old permit and every right attached to it stay in force as though nothing changed. If you could work, you can still work. If you could travel, you can still travel. Any conditions printed on your old permit (Nebenbestimmungen) remain binding, but so do the privileges.1Gesetze im Internet. Residence Act (Aufenthaltsgesetz)
A certificate under Section 81 Paragraph 3 applies when you’re applying for a residence permit for the first time, or when your previous permit already expired before you managed to file. It creates a permission fiction (Erlaubnisfiktion): you’re legally allowed to stay in Germany, and that is essentially the extent of it. The old permit’s specific privileges do not carry over.2Informationsverbund Asyl & Migration. Fiktionsbescheinigung
The practical gap between the two is wide enough that filing your renewal early, before expiry, is the single best thing you can do to protect your position.
How to Apply and What It Costs
File your renewal application before your current residence permit expires. Doing so triggers the stronger Paragraph 4 fiction automatically. Many Ausländerbehörden recommend submitting at least six to eight weeks before the expiration date, because appointment slots can be hard to secure.3Landeshauptstadt Mainz. To be issued the certificate itself, bring:
- A valid national passport or officially recognized travel document.
- Proof that your application is pending: an appointment confirmation, a stamped submission form, or a receipt showing the office already has your file.
- A biometric photo, if your local office requires one. Check first.
The certificate can only be issued once a residence permit application is formally pending. Without an application in the system, there is nothing to bridge.4Berlin.de. Fiktionsbescheinigung (Fictional Certificate)
The fee is set by the Residence Ordinance (Aufenthaltsverordnung) at €13 for adults and €6.50 for minors.5Gesetze im Internet. Work Rights
A Paragraph 4 certificate preserves whatever work authorization was attached to your previous residence permit. Unrestricted employment stays unrestricted. Employer-specific or hour-limited authorization stays exactly as limited. The supplementary conditions printed on your old permit remain legally binding for the entire duration of the certificate.4Berlin.de. Fiktionsbescheinigung (Fictional Certificate)
A Paragraph 3 certificate is far more restrictive. Because it does not carry forward the privileges of a previous permit, it does not automatically grant the right to work, to start new employment, or to begin a new course of study.6Hamburg Welcome Center. Fiktionsbescheinigung (Probationary Residence Permit) If you hold this version and need to work, you will likely need separate employment authorization from the Ausländerbehörde, which may or may not be granted depending on your case.
Whichever version you hold, give your employer a copy of both the certificate and your expired residence permit. Payroll departments rely on those documents to keep you compliant. If the certificate states “Erwerbstätigkeit erlaubt” (employment permitted), an employer cannot refuse to continue your employment on the grounds that your original card has expired.
Travel and Re-Entry
Travel is where a misread certificate causes the worst damage. A Paragraph 4 certificate generally allows you to leave Germany and re-enter the Schengen Area, because it legally extends your previous permit. Check page three of the certificate: the third checkbox should be marked, indicating that your residence title is treated as continuing in force.1Gesetze im Internet. Residence Act (Aufenthaltsgesetz) Carry both the expired residence card and the certificate when crossing borders.
A Paragraph 3 certificate does not grant re-entry rights. It only legalizes your presence inside Germany while a first-time application is reviewed. Leaving the country on a Paragraph 3 certificate usually means having to get a new entry visa from a German embassy or consulate before returning, which can delay or complicate the pending application.6Hamburg Welcome Center. Fiktionsbescheinigung (Probationary Residence Permit)
A boundary worth knowing: nationals of the United States, Canada, Australia, New Zealand, the United Kingdom, Israel, Japan, and South Korea can re-enter Germany even with an expired residence permit, because their passport grants visa-free entry. The certificate matters less for their border crossings, though carrying it as supporting documentation is still sensible.
Practical friction remains even with a valid Paragraph 4 certificate. Airline staff and foreign border agents often do not recognize the document, which is a German-language administrative paper that resembles neither a visa nor a residence card. Direct flights back to Germany avoid that problem by putting only German border police between you and arrival. Return before the certificate’s printed expiration date, and give yourself a buffer: some airlines will refuse to board you if the document expires within a week of your return flight.
When the Certificate Itself Expires
The certificate has a printed expiration date, but the legal fiction it documents does not necessarily end when the paper does. Your status under Section 81 continues by operation of law until the Ausländerbehörde actually decides on your application, whether or not the physical document is still current. The certificate is proof of your status, not the source of it.1Gesetze im Internet. Residence Act (Aufenthaltsgesetz)
Practically, an expired certificate still creates problems. Employers, landlords, health insurers, and border officials all read the printed date. If yours is approaching expiration and no decision has arrived, contact the Ausländerbehörde and request a renewal. The office will issue a new certificate with an updated validity period at the same €13 fee.5Gesetze im Internet. Ordinance Governing Residence (Aufenthaltsverordnung) Do not let the date pass without acting. You will not technically be illegal, but proving your status to anyone who asks becomes much harder without a current document, and that is where paychecks pause and insurance lapses.
Health Insurance and Social Benefits
Coverage tracks the same split. A Paragraph 4 certificate preserves your enrollment in the national social security system and your eligibility for benefits, because your previous permit’s conditions stay in effect. Health insurance continues without interruption, and employer contributions proceed as usual.
A Paragraph 3 certificate offers much weaker coverage. Because it does not carry forward the rights of any previous permit, benefit eligibility depends on individual circumstances and the discretion of the relevant agencies. If you hold this version, contact your health insurer directly to confirm whether coverage continues during the waiting period.
Either way, the printed validity date is what agencies and insurers reference when confirming your enrollment. Letting it lapse without renewal can trigger automatic suspension of benefits even when your underlying legal status is unchanged. Keeping the certificate current is what keeps the rest of your administrative life in Germany working.
