Federal Family Education Loan Program: Repayment and the 2026 Deadline

If you still owe on Federal Family Education Loan Program debt, your repayment and forgiveness options under the FFELP are narrower than what Direct Loan borrowers get, and the most important ones require consolidating into a Direct Consolidation Loan before June 30, 2026. That is the disbursement deadline set by the One Big Beautiful Bill Act, signed July 4, 2025, for keeping access to income-driven repayment through consolidation.1Federal Student Aid. The June 30, 2026 Deadline Driving Every Decision

The One Big Beautiful Bill Act eliminates access to Income-Based Repayment, Income-Contingent Repayment, and Pay As You Earn for any borrower whose consolidation loan is disbursed on or after July 1, 2026. It also eliminates ICR and PAYE entirely going forward. FFELP borrowers who have never consolidated lose the ability to reach income-driven repayment through consolidation once that date passes. A borrower who consolidates after the deadline still ends up with a Direct Loan and still qualifies for standard, graduated, and extended repayment, plus Public Service Loan Forgiveness. What disappears is the income-based safety net for anyone whose standard payment is unaffordable.

Repayment Plans You Can Use Without Consolidating

Unconsolidated FFELP loans have access to a limited menu:

  • Standard Repayment: fixed monthly payments of at least $50 over up to 10 years. Lowest total interest, highest monthly payment.2Federal Student Aid. Loan Repayment Plans
  • Graduated Repayment: payments start lower and step up every two years, still within 10 years.2Federal Student Aid. Loan Repayment Plans
  • Extended Repayment: up to 25 years, available if you have more than $30,000 in outstanding FFELP debt. Lower monthly payment, substantially more total interest.2Federal Student Aid. Loan Repayment Plans
  • Income-Based Repayment: caps payments at 15 percent of discretionary income for borrowers who first took out loans before July 1, 2014, with forgiveness of any remaining balance after 25 years. Borrowers who first borrowed on or after that date pay 10 percent, with forgiveness after 20 years.1Federal Student Aid. Federal Student Aid Big Updates
  • Income-Sensitive Repayment: a FFELP-only plan that sets your payment based on annual income. The formula varies by lender, you reapply each year, and the maximum term is 10 years.2Federal Student Aid. Loan Repayment Plans

IBR is the only income-driven plan open to FFELP borrowers without consolidating. PAYE and ICR were never available on unconsolidated FFELP debt, and the SAVE plan is defunct. Income-Sensitive Repayment adjusts to your earnings but carries no long-term forgiveness, so it does little for borrowers whose balances dwarf their income.

Consolidating FFELP Loans Into a Direct Consolidation Loan

Consolidation converts your privately held FFELP debt into a government-held Direct Loan. It unlocks PSLF eligibility, income-driven repayment (if disbursed by June 30, 2026), and a single federal servicer. It can also be a way out of default.

You apply at studentaid.gov. The online application runs about 30 minutes and requires a Federal Student Aid (FSA) ID to sign electronically. Keep paying on your existing FFELP loans until the servicer confirms the consolidation is complete, or you can go delinquent during the transition.3Federal Student Aid. Student Loan Consolidation

The new loan carries a weighted average of your existing rates, rounded up to the nearest one-eighth of a percentage point, and that rate is then fixed for the life of the loan. Because of the rounding, your rate may end up slightly higher than your current weighted average. Consolidation never lowers your interest rate.

What You Give Up

Some FFELP lenders offer borrower benefits, such as interest rate reductions for on-time payments or autopay discounts, that can be more generous than what the Direct Loan program offers. Those disappear when you consolidate. Weigh what you would lose against what consolidation opens up.

PSLF for FFELP Borrowers

Public Service Loan Forgiveness cancels the remaining balance on qualifying Direct Loans after 120 monthly payments made while working full-time for a qualifying employer, such as a government agency or nonprofit. The statute limits eligible loans to Direct Stafford, Direct PLUS, Direct Unsubsidized Stafford, and Direct Consolidation Loans. Consolidating fixes eligibility, but your qualifying payment count resets to zero on the new loan. Years of payments made on the original FFELP loans do not carry over under standard rules. The temporary limited PSLF waiver that credited prior FFELP payments expired on October 31, 2022.5Federal Student Aid. For a borrower ten years into public service on unconsolidated FFELP loans, the reset is a hard trade. For someone earlier in a public service career, consolidation is usually the right move. Qualifying payments have to be made under a qualifying plan: standard 10-year, IBR, ICR, or any plan where the monthly amount equals or exceeds the standard 10-year amount.4Office of the Law Revision Counsel. 20 USC 1087e – Terms and Conditions of Loans IBR and ICR access on the consolidated loan still depends on hitting the June 30, 2026 disbursement date.

Forgiveness and Discharge That Doesn’t Require Consolidation

Teacher Loan Forgiveness

Teachers who work full-time for five consecutive complete school years at a qualifying low-income school can receive up to $17,500 in forgiveness for math, science, and special education teachers, or up to $5,000 for other qualifying teachers.6Office of the Law Revision Counsel. 20 USC 1078-10 – Loan Forgiveness for Teachers You cannot be in default when you apply. Total and Permanent Disability Discharge

A borrower who is totally and permanently disabled can have FFELP loans discharged. Eligibility can be documented three ways: a physician’s certification that the borrower cannot engage in substantial gainful activity due to a condition expected to result in death or last at least 60 continuous months; VA documentation of a 100 percent service-connected disability or total disability based on individual unemployability; or SSA documentation showing SSDI or SSI eligibility under qualifying conditions.8Federal Student Aid. Borrowers who qualify through a physician or the SSA face a three-year post-discharge monitoring period; taking out a new federal student loan during that period reinstates the debt. Closed School Discharge

If the school you attended closed while you were enrolled, or if you withdrew within 120 days before the closure, you may be eligible for a full discharge of the loans taken out for that enrollment. Borrowers who withdrew more than 120 days before closure may still qualify with Department of Education approval. Enrolling at another Title IV-eligible school within three years of the closure disqualifies you.9Federal Student Aid. Closed School Discharge Changes

Death and False Certification

FFELP loans are discharged upon the borrower’s death. False certification discharge is available when a school enrolled a student who lacked the legal qualifications for the program or forged the borrower’s signature on the loan application. Each of these requires a formal application filed with the current loan holder.

Getting Out of Default on a FFELP Loan

Default kicks in after 270 days without payment on a loan with monthly installments.10eCFR. 34 CFR 682.200 – Definitions The guaranty agency takes over the debt and can garnish up to 15 percent of disposable pay without a court order.11Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement Federal tax refunds and Social Security benefits can be offset through the Treasury Offset Program. There are two ways out:

  • Loan rehabilitation: nine qualifying payments within a 10-month period. Each payment must be voluntary, for the full required amount, and received within 20 days of the due date. Successful rehabilitation removes the default status from your credit report and returns the loan to regular servicing.13eCFR. 34 CFR Part 682 – Federal Family Education Loan (FFEL) Program
  • Consolidation out of default: available after six consecutive, on-time, voluntary full monthly payments, or by agreeing to repay the new consolidation loan under an income-driven repayment plan. Rehabilitation is a one-time cure per loan. If you default again after rehabilitation, consolidation is typically what’s left. For a defaulted borrower who wants IDR access or PSLF, consolidation does both jobs at once. The June 30, 2026 disbursement deadline still applies if you need IDR on the resulting loan.

What Forgiveness Costs You at Tax Time

The American Rescue Plan Act temporarily excluded forgiven federal student loan debt from taxable income, but that provision expired on December 31, 2025. Starting in 2026, forgiven student loan debt is generally treated as taxable income. Forgiveness under an income-driven repayment plan after 20 or 25 years counts as ordinary income for the year of discharge, and your loan holder will send you a Form 1099-C for the canceled amount.7Taxpayer Advocate Service. Three categories stay permanently tax-free: PSLF, Teacher Loan Forgiveness, and discharges due to death or total and permanent disability.7Taxpayer Advocate Service. The Insolvency Exclusion

If your total liabilities exceeded the fair market value of your total assets immediately before the debt was canceled, you were insolvent. You can exclude the forgiven amount from taxable income up to the amount by which you were insolvent, by filing Form 982 with your federal return. Assets for this calculation include everything you own, retirement accounts included, and liabilities include all debts.15Internal Revenue Service. Long-term IDR borrowers whose balances have grown over decades while income remained modest are often insolvent at the point of forgiveness, and the insolvency exclusion is the main tool to reduce the tax hit. State tax treatment varies; check whether your state conforms to the federal exclusion.

Joint Spousal Consolidation Loans

Before 2006, married couples could combine their federal student loans into a single joint FFEL Consolidation Loan, and both borrowers stayed liable for the full balance with no way to split it. The Joint Consolidation Loan Separation Act amended the Higher Education Act so co-borrowers can now split the joint loan into two individual Direct Consolidation Loans by filing the Joint Consolidation Loan Separation Application with the Department of Education. Either co-borrower can initiate the separation, and once done, each borrower can independently choose repayment plans and pursue forgiveness on their own share.16Federal Register. Check Your Loans Before You Act

Log in at studentaid.gov and open the “Loan Breakdown” section. Any loan listed with “FFEL” at the front is a FFEL Program loan. In “My Loan Servicers,” if the servicer name starts with “ED,” the Department of Education holds that loan. Otherwise, it is commercially held.17Federal Student Aid. Create an FSA ID if you don’t already have one; it is your legal electronic signature for any consolidation application. Have your most recent tax return ready for income-driven repayment enrollment. If you’re aiming at PSLF, identify your qualifying employer and gather employment certification records before you start the consolidation. Whatever your situation, the June 30, 2026 disbursement deadline for keeping IDR access after consolidation is close enough that checking your loans now is worth doing today, not next quarter.
