Federal debt relief programs fall into three tracks depending on who you owe: the Department of Education for student loans, the IRS for tax liabilities, and the Small Business Administration for SBA-backed business loans. Each track has its own eligibility rules, forms, and tax treatment, and a program that works for one type of debt has no bearing on another. The relief landscape shifted in 2025 and 2026 with the expiration of pandemic-era exclusions and a court ruling vacating the SAVE repayment plan, so anything you read from earlier years should be double-checked before you rely on it.
Federal Student Loan Relief
The Department of Education offers three main routes to cancellation: Public Service Loan Forgiveness, forgiveness under an income-driven repayment plan, and Total and Permanent Disability discharge. Picking the wrong route can cost you years of qualifying payments, so match the program to your situation before you enroll.
Public Service Loan Forgiveness
PSLF cancels the remaining balance on your Direct Loans after 120 qualifying monthly payments made while working full-time for a qualifying employer. Federal, state, tribal, and local government agencies count, as do 501(c)(3) nonprofits.1GovInfo. 34 CFR 685.219 – Public Service Loan Forgiveness Program The 120 payments don’t need to be consecutive, and switching between qualifying employers doesn’t reset the count.
Only payments made under an accepted repayment plan count. Standard, income-driven, and the 10-year standard plan qualify; extended and graduated plans generally do not. Forgiveness under PSLF is tax-free at the federal level.
Income-Driven Repayment Forgiveness
Income-driven repayment plans set your monthly payment as a share of discretionary income and cancel any remaining balance after 20 or 25 years of qualifying payments, depending on the plan.2Federal Student Aid. Student Loan Forgiveness Income-Based Repayment, Pay As You Earn, and Income-Contingent Repayment are the plans currently available.
The SAVE plan is being eliminated. A federal court entered judgment vacating SAVE on March 10, 2026, and borrowers enrolled in SAVE will need to switch to another plan within roughly 90 days of July 1, 2026. If you are in SAVE, contact your servicer promptly so you aren’t placed by default into a plan you didn’t choose.
Debt forgiven through income-driven repayment is treated as taxable income starting in 2026. The American Rescue Plan Act’s temporary exclusion for student loan forgiveness expired on December 31, 2025.3Internal Revenue Service. What to Know about Student Loan Forgiveness and Your Taxes If you’re close to the 20- or 25-year mark, plan for a potentially large tax bill in the year your loans are discharged.
Total and Permanent Disability Discharge
TPD discharge cancels both remaining principal and accrued interest for borrowers who cannot work due to a severe physical or mental condition. You can qualify through a physician’s certification, documentation from the Social Security Administration showing SSDI or SSI benefits, or a VA determination of total disability.4Federal Student Aid. How To Qualify and Apply for Total and Permanent Disability (TPD) Discharge The SSA route has several qualifying paths, including a next scheduled disability review five to seven years out, a medical onset date at least five years before you apply, or a compassionate allowance. TPD discharge is tax-free at the federal level.
IRS Tax Debt Relief
The IRS offers several options for taxpayers who owe more than they can pay. The right one depends on whether you can pay something, how much, and how soon.
Offer in Compromise
An Offer in Compromise lets you settle your tax debt for less than you owe, under authority granted by 26 U.S.C. § 7122.5Office of the Law Revision Counsel. 26 USC 7122 – Compromises Most accepted offers are based on doubt as to collectibility, meaning the IRS concludes it cannot reasonably collect the full amount given your income, assets, and expenses.
Filing requires Form 656, a $205 application fee, and an initial payment. The fee and initial payment are waived if your household income qualifies as low-income.6Internal Revenue Service. Form 656 – Offer in Compromise You also submit Form 433-A (OIC), which itemizes bank accounts, real estate equity, vehicle values, and monthly expenses.7Internal Revenue Service. Form 433-A (OIC) – Collection Information Statement for Wage Earners and Self-Employed Individuals Inconsistencies between Form 433-A and your recent tax returns are one of the fastest routes to rejection.
Before applying you must have filed all required returns, be current on estimated tax payments, and not be in an open bankruptcy proceeding.8Internal Revenue Service. Offer in Compromise Employers need current and past two quarters of payroll tax deposits made. Miss any prerequisite and the offer gets returned without review. The portion of tax debt forgiven through an accepted OIC is not treated as taxable income.
Installment Agreements
If you can pay in full but need time, an installment agreement spreads payments over months or years under 26 U.S.C. § 6159.9Office of the Law Revision Counsel. 26 US Code 6159 – Agreements for Payment of Tax Liability in Installments Individual taxpayers who owe $50,000 or less in combined tax, penalties, and interest can use a streamlined online application that skips detailed financial disclosure.10Internal Revenue Service. Setup fees are $22 if you apply online and pay by automatic withdrawal, and $69 if you apply online without automatic payments. Low-income taxpayers get the direct-debit fee waived and can have the non-direct-debit fee reimbursed under certain conditions. Applying by phone, mail, or in person costs more.11Internal Revenue Service. Online Payment Agreement Application Interest and penalties accrue on the unpaid balance until you finish paying.
Partial Payment Installment Agreements
If you cannot cover the full debt even over an extended term, a Partial Payment Installment Agreement lets you make smaller monthly payments. The IRS reviews your finances at least every two years and adjusts the payment based on any changes.12Internal Revenue Service. IRM 5.14.2 Partial Payment Installment Agreements and the Collection Statute Expiration Date (CSED) The IRS has a 10-year window to collect assessed tax from the date of assessment.13Office of the Law Revision Counsel. 26 USC 6502 – Collection After Assessment Anything left when that window closes becomes uncollectible. It isn’t formal forgiveness, but the practical effect matches.
Currently Not Collectible Status
When any payment toward your tax debt would prevent you from covering basic living expenses, the IRS can place your account in Currently Not Collectible status. Active collection halts, including wage levies and bank account seizures.14Internal Revenue Service. Temporarily Delay the Collection Process The debt itself remains, penalties and interest keep accruing, and the IRS may file a federal tax lien. The agency will re-check your finances periodically, and collection resumes if your situation improves. If it doesn’t improve during the 10-year collection window, the same statute-of-limitations math applies.
First-Time Penalty Abatement
If you were hit with a failure-to-file, failure-to-pay, or failure-to-deposit penalty and have a clean compliance history, the IRS may remove it under its First Time Abate policy. You qualify if you filed all required returns for the three tax years before the penalty year, had no penalties during those three years (or had any prior penalty removed for a reason other than First Time Abate), and are current on payments or have an approved payment arrangement.15Internal Revenue Service. Administrative Penalty Relief You can request it by calling the IRS or writing a letter. There is no formal application and no fee.
SBA Loan Debt Relief
The CARES Act §1112 program that had the SBA make principal, interest, and fee payments on 7(a) loans, 504 loans, and Microloans during the pandemic was temporary and is no longer accepting new applicants or making payments.16Congress.gov. Public Law 116-136 – Coronavirus Aid, Relief, and Economic Security Act Older references to it as current relief are outdated.
The SBA does maintain an Offer in Compromise process for borrowers who cannot pay. You propose a lump-sum settlement for less than owed, and the SBA evaluates whether it makes financial sense to accept. Collateral securing the loan must be liquidated before the SBA will consider an offer. Applications use Form 1150, and the process is governed by SBA Standard Operating Procedures for loan servicing and liquidation.17U.S. Small Business Administration. Offer In Compromise (OIC) Tabs The SBA coordinates through the lender that originated your loan, so your first call should be to the lender rather than the SBA. Expect a lengthy process, and don’t assume the agency will accept a steep discount if your business still holds significant assets.
Tax Consequences of Forgiven Federal Debt
Cancelled debt is generally treated as taxable income under federal law. If a creditor forgives $30,000, the IRS views that as $30,000 you received. Exceptions are carved out in 26 U.S.C. § 108.18Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness The exclusions most likely to matter here:
- PSLF forgiveness is tax-free at the federal level.
- TPD discharge is tax-free at the federal level.
- IDR plan forgiveness is taxable starting in 2026, after the ARPA exclusion expired on December 31, 2025.3Internal Revenue Service. What to Know about Student Loan Forgiveness and Your Taxes
- Tax debt forgiven through an IRS Offer in Compromise is not treated as taxable income.
- If your total liabilities exceed the fair market value of your assets at the time of discharge, you can exclude the forgiven amount up to the extent of your insolvency.
- Debt discharged in a Title 11 bankruptcy case is excluded from gross income.
State treatment varies. Some states conform to the federal exclusions and some do not. Check your state’s treatment before assuming the forgiven amount is fully tax-free.
How to Apply
Every program requires documentation of your situation, and incomplete applications get delayed or rejected.
For PSLF, use the PSLF Help Tool at studentaid.gov to generate and submit your employer certification. You’ll need your employer’s Federal EIN from your W-2 and the email of an authorized official who can certify employment and sign digitally.19Federal Student Aid. Employer-qualification problems caught early are fixable; the same problems caught at payment 120 can be devastating.
For TPD discharge, apply through the Department of Education’s designated servicer with a physician certification, SSA documentation, or VA documentation. The SSA route requires a notice of award showing your benefit status and scheduled disability review timeline.4Federal Student Aid. For an IRS Offer in Compromise, file Form 656 with Form 433-A (OIC), the $205 fee, and the initial payment, unless you qualify for the low-income waiver. Use current market values and match your figures to your recent tax returns. For an installment agreement of $50,000 or less, use the IRS online payment agreement tool.10Internal Revenue Service. Payment Plans; Installment Agreements For Currently Not Collectible status, call the IRS and be ready to provide the same financial information Form 433-A requires.
For an SBA Offer in Compromise, submit Form 1150 with the supporting OIC Tabs document, which collects your business’s legal name, tax identification number, and loan account details.20U.S. Small Business Administration. SBA Form 1150 – Offer in Compromise Have at least two years of business tax transcripts ready to verify revenue.
Processing Times and Appeals
Federal agencies are not fast. An IRS Offer in Compromise investigation can take up to 24 months depending on complexity and workload.21Internal Revenue Service. Offer in Compromise FAQs There is a useful backstop: if the IRS doesn’t reject, return, or process a withdrawal within two years of receiving your offer, the offer is deemed accepted. While an offer is pending, the IRS generally won’t levy wages or bank accounts, though interest continues to accrue.
Online installment agreements are typically approved within days. PSLF forgiveness generally takes one to three months to process after you hit 120 qualifying payments, though servicer backlogs can stretch that.
If the IRS rejects your Offer in Compromise or installment agreement, file a Collection Appeal Request using Form 9423 within 30 calendar days of the action.22Internal Revenue Service. Collection Appeal Request – Form 9423 Send it to the office or revenue officer who took the action. The appeals process is informal compared to Tax Court and gives you a second look without starting over. For a denied PSLF application, Federal Student Aid handles reconsiderations. Check your servicer’s online portal regularly; requests for additional documentation carry tight deadlines, and missing one sends your application back to the queue.
