The federal clean vehicle tax credit under Section 30D ended for vehicles acquired after September 30, 2025. If you bought or entered a binding written contract for an eligible new plug-in electric or fuel cell vehicle on or before that date, you can still claim up to $7,500 on your federal return for the year you took delivery. The One Big Beautiful Bill Act, signed on July 4, 2025, terminated the credit along with the used clean vehicle credit under Section 25E and the commercial clean vehicle credit under Section 45W.1Internal Revenue Service. FAQs for Modification of Sections 25C, 25D, 25E, 30C, 30D, 45L, 45W, and 179D Under Public Law 119-21 Walking into a dealership in 2026 to buy an electric vehicle off the lot no longer produces a federal credit.
What “Acquired by September 30, 2025” Actually Means
The IRS treats acquisition and delivery as two different events. You acquired the vehicle on the date you entered into a written binding contract and made a payment, which can be a nominal down payment or a trade-in. You place it in service on the date you take physical possession.1Internal Revenue Service. FAQs for Modification of Sections 25C, 25D, 25E, 30C, 30D, 45L, 45W, and 179D Under Public Law 119-21
The distinction matters because the credit becomes available in the tax year you place the vehicle in service, not the year you signed. If you ordered a qualifying vehicle in September 2025 and it arrives in early 2026, you claim the credit on your 2026 return. Hold onto the signed purchase agreement and proof of payment. Without those two documents, there is no way to prove you acquired the vehicle before the cutoff.
Income Limits That Decide Whether You Qualify
Signing before the deadline is not enough on its own. Your modified adjusted gross income has to fall below the threshold in either the year you place the vehicle in service or the prior year, whichever is lower. The limits:
- Single or married filing separately: $150,000
- Head of household: $225,000
- Married filing jointly or surviving spouse: $300,000
If your income exceeds the limit in both years, you are ineligible.2Office of the Law Revision Counsel. 26 USC 30D – Clean Vehicle Credit The two-year lookback gives some cushion when a bonus or a one-time gain pushes you over in the current year. Modified AGI starts with the AGI on your return and adds back items like foreign earned income and housing exclusions; for most domestic wage earners it matches AGI exactly.
Two smaller rules trip people up. If someone else claims you as a dependent, you cannot claim the credit on your own return. And the credit is nonrefundable for personal use: it can reduce your federal income tax to zero, but any leftover portion disappears and does not carry forward.3Internal Revenue Service. Frequently Asked Questions About the Eligibility Rules for the New Clean Vehicle Credit Under 30D Look at last year’s return to estimate your actual liability before counting on the full $7,500. Business use is the one exception; the credit can then be claimed on Form 3800 as a general business credit, which does allow a carryforward.
Which Vehicles Qualify
The manufacturer’s suggested retail price is capped by vehicle type. Vans, SUVs, and pickup trucks must have an MSRP no higher than $80,000. All other vehicles, including sedans and hatchbacks, are capped at $55,000. MSRP for this purpose is the base retail price plus factory-installed options attached when the vehicle was delivered to the dealer. Destination charges, dealer-added accessories, and taxes are excluded.4Internal Revenue Service. Topic B – Frequently Asked Questions About Income and Price Limitations for the New Clean Vehicle Credit The sticker set by the manufacturer is what counts, not what you negotiated.
Beyond price, the vehicle must undergo final assembly in North America, carry a gross vehicle weight rating under 14,000 pounds, and have a battery capacity of at least seven kilowatt-hours.2Office of the Law Revision Counsel. 26 USC 30D – Clean Vehicle Credit You can verify assembly location by checking the certification label or running the VIN through the Department of Energy’s Alternative Fuels Station Locator or FuelEconomy.gov.
The $7,500 Splits Into Two $3,750 Pieces
Half the credit rides on critical minerals sourcing and half on battery components. For vehicles placed in service in 2025, at least 60 percent of the battery’s critical minerals had to be extracted or processed in the United States or a country with a U.S. free trade agreement, and at least 60 percent of the battery components had to be manufactured or assembled in North America. Meeting both got the full $7,500. Meeting one got $3,750. Meeting neither zeroed out the credit.
A separate restriction that took effect in 2025 disqualifies any vehicle whose battery components or critical minerals came from a Foreign Entity of Concern, meaning China, Russia, North Korea, or Iran.5Department of Energy. Foreign Entity of Concern Interpretive Guidance These rules narrowed the qualifying list sharply in the credit’s final months. Confirm your specific model and configuration through the FuelEconomy.gov VIN decoder, which reflects the manufacturer data reported to the IRS.
Documentation to Keep
Three items matter when you file:
- The 17-character Vehicle Identification Number from the driver’s side dashboard or door jamb. The IRS uses it to cross-reference the manufacturer’s eligibility reports.
- Form 15400, the clean vehicle seller report. Your dealer provides this at the point of sale and files it electronically with the IRS. It lists your taxpayer identification number, the battery capacity, and other qualifying details. If the report was never filed, the vehicle is not eligible.6Internal Revenue Service. Form 15400 – Clean Vehicle Seller Report
- Your signed binding contract and payment record if you are relying on the September 30 acquisition date and took delivery later. The IRS may ask you to prove the contract and payment were in place before the cutoff.
If your dealer never submitted the seller report, contact them. The IRS Energy Credits Online portal remains open for previously registered dealers to submit and correct reports even after the credit’s termination.7Internal Revenue Service. Clean Vehicle Credit Seller or Dealer Requirements
How to File the Credit
You claim the credit by attaching Form 8936 and Schedule A (Form 8936) to your federal income tax return for the year you placed the vehicle in service.8Internal Revenue Service. About Form 8936, Clean Vehicle Credit Delivery in 2025 means it goes on the 2025 return. Delivery in 2026, under the binding contract exception, means the 2026 return.
The form asks for the date placed in service, the VIN, the battery capacity in kilowatt-hours, and information drawn from the seller report. The IRS matches your entries against the dealer’s electronic filing. Mismatches slow processing and can trigger a denial, so check the numbers on Form 15400 against what you enter.
If You Took the Discount at the Dealership
For vehicles placed in service before the credit ended, buyers could elect to transfer the credit to the dealer at purchase. The dealer then applied it as a price reduction, functioning like an instant rebate of up to $7,500.9Internal Revenue Service. Topic H – Frequently Asked Questions About Transfer of New Clean Vehicle Credit and Previously Owned Clean Vehicles Credit Taking the transfer does not eliminate the filing requirement. You still attach Form 8936 for that year; the form instructions are explicit about this.10Internal Revenue Service. Form 8936 – Clean Vehicle Credits
If your year-end modified AGI ends up over the threshold in both the current and prior year, you owe the entire transferred credit back to the IRS as an addition to your tax. You repay the IRS directly, not the dealer.9Internal Revenue Service. Topic H – Frequently Asked Questions About Transfer of New Clean Vehicle Credit and Previously Owned Clean Vehicles Credit The same recapture applies if you returned the vehicle within 30 days of taking possession, or if you bought it for resale rather than personal use.
The Leasing Workaround Is Also Gone
Some buyers previously leased electric vehicles to reach the credit through the back door. Leasing companies claimed the Section 45W commercial clean vehicle credit, which had no income limits for the consumer, no North American assembly requirement, and no battery sourcing thresholds, and passed the savings through lower lease payments.11Internal Revenue Service. Commercial Clean Vehicle Credit Section 45W was terminated on the same September 30, 2025 timeline, with the same binding contract exception for leasing companies that acquired vehicles before the cutoff.
State Programs Are Separate
The federal termination does not touch state incentives. Roughly 30 states run their own electric vehicle rebate, tax credit, or registration fee reduction programs, with amounts and eligibility rules that operate independently of Section 30D. Check your state’s revenue department or motor vehicle agency for the current terms where you live.
