FAA kite regulations, set out in 14 CFR Part 101, apply to any kite that weighs more than five pounds when flown on a rope or cable. Those kites cannot go higher than 500 feet above the ground, cannot fly within five miles of an airport, and require FAA notification at least 24 hours before any flight above 150 feet. One safety rule applies to every kite regardless of weight, and civil penalties for violations can reach $100,000 against an individual.
Which Kites the Rules Cover
Part 101 kicks in at more than five pounds.1eCFR. 14 CFR 101.1 – Applicability A kite weighing five pounds or less is exempt from the altitude ceiling, the airport buffer, the marking rules, and the notification requirement. Most recreational kites fall on that lighter side.
One rule applies at any weight. Under 14 CFR § 101.7, no one may operate a kite in a way that creates a hazard to other people or their property, and no one may drop anything from a kite if doing so creates a hazard.2eCFR. 14 CFR 101.7 – Hazardous Operations The rule is deliberately broad. A light sport kite flown recklessly near a crowd or into an aircraft approach path can still draw FAA enforcement.
Altitude, Weather, and Airport Limits
For kites over five pounds, 14 CFR § 101.13 sets four operating limits that apply at the same time:
- No higher than 500 feet above the surface of the earth.
- At least 500 feet below the base of any cloud.
- No flying where ground visibility is less than three miles.
- No flying within five miles of the boundary of any airport.
The airport buffer has one narrow exception. You can fly inside the five-mile zone if the kite stays below the top of an existing structure, remains within 250 feet of that structure, and does not block or obscure any lighting on it.3eCFR. 14 CFR 101.13 – Operating Limitations For most recreational flyers, this exception rarely applies.
Notifying the FAA Above 150 Feet
If you plan to fly an unshielded kite above 150 feet, you must notify the FAA at least 24 hours in advance. The requirement applies even though the flight stays below the 500-foot ceiling. “Unshielded” simply means the kite is not operating in the shadow of a structure under the exception above.
Contact the nearest FAA Air Traffic Control facility and provide:
- Names and addresses of the owner and the operator
- Size and weight of the kite
- Location of the operation
- Maximum altitude above the surface
- Date, time, and duration of the planned flight
The FAA uses that information to issue a Notice to Airmen (NOTAM) so pilots know the kite is there.4eCFR. 14 CFR 101.15 – Notice Requirements
Marking and Lighting the Line
A mooring line more than 150 feet up is nearly invisible from a cockpit, so 14 CFR § 101.17 sets separate day and night rules.
Daytime
Between sunrise and sunset, the line must display colored pennants or streamers no more than 50 feet apart, starting at 150 feet above ground level. Each marker has to be visible from at least one mile.5eCFR. 14 CFR 101.17 – Lighting and Marking Requirements Bright orange or red pennants on a clear day generally meet the standard.
Nighttime
Between sunset and sunrise, both the kite and its mooring line must be lighted well enough to give the same visual warning the FAA requires for permanent obstructions to air navigation, as defined in the FAA publication “Obstruction Marking and Lighting.”5eCFR. 14 CFR 101.17 – Lighting and Marking Requirements That is a high bar, and most recreational flyers avoid night flying rather than rig obstruction-grade lighting.
Prohibited Areas, Controlled Airspace, and TFRs
Some airspace carries restrictions beyond the general Part 101 limits.
No one may fly a kite in a prohibited or restricted area without permission from the agency that controls that airspace.6eCFR. 14 CFR 101.5 – Operations in Prohibited or Restricted Areas Prohibited areas cover locations like the White House and certain military installations. Restricted areas typically support military training or weapons testing and may be active only at scheduled times.
Busy airports sit inside controlled airspace classified as Class B, C, or D, where kite operations are also prohibited without authorization. The five-mile buffer already keeps most flights outside these zones, but Class B airspace around major hubs can extend farther than five miles. If you have a legitimate reason to operate inside controlled airspace, the FAA accepts applications for a Certificate of Waiver or Authorization on Form 7711-2.
Temporary Flight Restrictions can appear on short notice over sporting events, presidential travel, wildfires, and disaster areas. They apply to everything in the affected airspace, kites included. Penalties
The FAA can impose civil penalties administratively under 49 U.S.C. § 46301, without a court case. For violations occurring after May 16, 2024, the inflation-adjusted maximums are:
- Individuals: up to $17,062 per violation, capped at $100,000 per enforcement action.
- Businesses and other organizations: up to $17,062 per violation, capped at $1,200,000 per enforcement action.
These figures were set by the FAA Reauthorization Act of 2024 and adjusted for inflation.8Office of the Law Revision Counsel. 49 USC 46301 – Civil Penalties A first-time recreational violation rarely draws the maximum, but a kite that interferes with an aircraft or drifts into controlled airspace near a runway will get serious attention. Violations that endanger people or property can also lead to criminal referrals.
Power Lines and Other Practical Hazards
Part 101 addresses airspace, not power lines, yet contact with overhead lines is the most common source of kite-related injuries. No federal aviation rule sets a specific distance from utility infrastructure. The physics do the work instead: a string touching a high-voltage line can conduct electricity back to the person holding it, and wire or wet string makes that worse. Fly in open areas away from overhead lines, use non-conductive kite line, and if a kite tangles in a line, let go and call the utility rather than trying to retrieve it.
