An expired U.S. Treasury check does not mean the money is gone. U.S. Treasury checks are void one year after the date printed on them, but the government’s underlying obligation to pay you survives that expiration. To get paid, you contact the federal agency that authorized the original payment and ask for a replacement, provided you are still within the statute of limitations that applies to your type of payment.
What the One-Year Rule Actually Does
Under 31 U.S.C. § 3328, the Treasury is not required to honor a check unless it reaches a financial institution within 12 months of its issue date.1Office of the Law Revision Counsel. 31 USC 3328 – Paying Checks and Drafts Every Treasury check carries the words “VOID AFTER ONE YEAR” on its face for that reason. After the year passes, the check is “stale-dated.” Banks will refuse to deposit it, and if you try, you may be charged a returned-item fee.
Behind the scenes, the Bureau of the Fiscal Service cancels the check through a limited payability cancellation and credits the money back to the agency that originally authorized the payment.2Treasury Financial Manual (TFM). It just moves back to the sending agency’s ledger until someone claims it.
Why You Are Still Owed the Money
The check is only the delivery method. The debt itself is a separate legal thing. Section 3702(c)(2) of Title 31 says so directly: “Nothing in this subsection affects the underlying obligation of the United States, or any agency thereof, for which a Treasury check was issued.”3Office of the Law Revision Counsel. 31 USC 3702 – Authority to Settle Claims The government still owes you. You just need a new check.
Two different deadlines run after the check is issued, and people mix them up all the time:
- A claim about the check itself must be presented to the issuing agency within one year of the check’s date. Missing this bars the check claim but not the underlying debt.3Office of the Law Revision Counsel. 31 USC 3702 – Authority to Settle Claims
- The general statute of limitations for money claims against the federal government is six years from when the claim accrues, unless a specific statute sets a shorter window.3Office of the Law Revision Counsel. 31 USC 3702 – Authority to Settle Claims
So even a Treasury check that’s several years old is usually still claimable. The government also does not pay interest on money that sat unclaimed while you got around to filing. Waiting costs you nothing except time on the clock, and eventually the clock does run out.
Deadlines by Payment Type
The six-year window is the default, not a universal rule. Some payments have their own shorter deadlines, and those deadlines are firm.
IRS tax refunds carry a three-year statute of limitations, measured from the date the return was filed, or two years from when the tax was paid, whichever is later.4Office of the Law Revision Counsel. 26 USC 6511 – Limitations on Credit or Refund If you filed on time but never cashed your refund check, you generally have three years from the filing date to claim a replacement. After that, the refund belongs to the Treasury permanently. This is where most old-refund claims fall apart.
Social Security benefit checks follow the same one-year negotiation window as other Treasury checks, but the underlying benefit is not subject to the IRS’s three-year cutoff.5Social Security Administration. For most other federal payments — vendor payments, certain federal employee compensation, payments for goods and services — the six-year general window under 31 U.S.C. § 3702 controls.3Office of the Law Revision Counsel. 31 USC 3702 – Authority to Settle Claims
How to Get a Replacement Check
The request goes to the agency that authorized the payment, not to the Treasury. That agency pulls its records, confirms the check was never cashed, and recertifies the payment from the original funding source.2Treasury Financial Manual (TFM). Tax Refund Checks
For an expired IRS refund, the process is called a refund trace. Start one through the “Where’s My Refund?” tool at irs.gov, the automated line at 800-829-1954, or a representative at 800-829-1040. Social Security and Other Federal Benefits

What You Need to Have Ready
If you still have the expired check, the work is straightforward. Every Treasury check shows a four-digit check symbol and an eight-digit serial number on its face, and the agency needs both to locate the transaction. Also have the exact dollar amount, the issue date, and the name of the issuing agency.
Expect an identity check. Keep your Social Security number ready along with a valid government-issued photo ID. If the check was made out to co-payees, both people need to participate in the claim.
If your legal name has changed since the check was issued, update your name with the Social Security Administration first. Name mismatches between SSA records and the paying agency’s files are a common cause of delays.10Internal Revenue Service. If the Check Was Lost, Never Delivered, or Cashed by Someone Else
You do not need the paper check in hand to be paid. If it was lost, destroyed, never arrived, or later expired somewhere in a stack of mail, the same replacement process applies: contact the issuing agency and report what happened.9Bureau of the Fiscal Service. If it was never cashed, the agency cancels it and issues a new one. If someone else cashed it, the Bureau of the Fiscal Service will send you an FS Form 1133 with a copy of the cashed check. Fill out the form, answer every question about the circumstances, and sign it. If the check was payable to two people, both must sign.2Treasury Financial Manual (TFM). Return the form promptly; without a properly completed FS Form 1133, no further action is taken on your case.
Claiming a Check Made Out to Someone Who Has Died
An expired Treasury check payable to a person who has since died can still be claimed, but the rules depend on the type of payment and whether an estate representative has been appointed.
If a court-appointed executor or administrator exists, that person can endorse and claim checks for tax refunds, payments for goods and services, and payments related to U.S. securities. The endorsement must show the representative’s capacity, for example, “John Jones by Mary Jones, executor of the estate of John Jones.”11eCFR. 31 CFR 240.15 – Checks Issued to Deceased Payees
Recurring benefit payments like Social Security and annuities work differently. Those checks cannot be negotiated after the payee’s death, even by an executor. If no executor or administrator has been appointed, all checks, regardless of type, must be returned to the certifying agency for a determination about who is entitled to the money.11eCFR. 31 CFR 240.15 – Checks Issued to Deceased Payees
For IRS tax refund checks specifically, file Form 1310, Statement of Person Claiming Refund Due a Deceased Taxpayer. A surviving spouse who received a joint refund check can return it marked “VOID” with Form 1310 and a written request for reissuance. Other claimants who are not court-appointed personal representatives complete Part II of the form and keep proof of death on file in case the IRS asks for it.12Internal Revenue Service. Avoiding a Repeat With Direct Deposit
The simplest fix is to stop receiving paper checks. Federal law generally requires federal payments to be delivered electronically, and paper checks are being phased out for most benefit programs.13Bureau of the Fiscal Service.
