Erin Caffey Sentence: Plea, Parole, and Co-Defendants

Erin Caffey is serving two life sentences plus 25 years in Texas for orchestrating the March 2008 murders of her mother and two younger brothers. She pleaded guilty on January 2, 2009, under an agreement that took the death penalty off the table and set her first parole eligibility for March 1, 2038, when she will be 59 years old. She remains incarcerated at the Hobby Unit in Marlin, Texas.1TDCJ. Inmate Detail – Erin Michelle Caffey

The Plea Agreement and the Numbers Behind It

Caffey was 16 when the killings took place and 17 when she was sentenced. She pleaded guilty in Rains County on January 2, 2009, and received two life terms plus 25 years, structured as a cumulative life sentence across three case numbers in Texas Department of Criminal Justice records.2CBS News. The ceiling on her exposure was set by two rules. The U.S. Supreme Court’s decision in Roper v. Simmons (2005) barred the death penalty for anyone who was under 18 at the time of the offense. And Texas Penal Code Section 12.31 provides that a juvenile certified as an adult and convicted of capital murder receives an automatic life sentence with parole eligibility after 40 years.3VersusTexas. The two adults who physically carried out the killings will die in prison. Erin, who was a minor and did not personally fire a weapon or use a blade, retains eventual parole eligibility, a difference driven by Texas law limiting the harshest sentences for juvenile offenders.

What She Pleaded Guilty To

In the early morning of March 1, 2008, Wilkinson and Waid entered the Caffey family home in Alba, Texas, armed with firearms and a samurai sword. Penny Caffey was shot in her bedroom, 13-year-old Matthew Caffey was shot, and 8-year-old Tyler Caffey was stabbed. The attackers set the house on fire before leaving. Terry Caffey was shot five times but survived after crawling roughly 500 yards to a neighbor’s house.12ABC News. Prosecutors said the plot grew out of the Caffey parents’ effort to end Erin’s relationship with Wilkinson. Three days before the killings, on February 27, Terry and Penny told Erin to end the relationship. According to Wilkinson’s statements to investigators, Erin told him killing her parents was the “only way they could be together.” Wilkinson told police, “I intended to kill them because I thought I was in love.”8Texas Monthly.
