EPA Form 3520-1 is the emission declaration you file with U.S. Customs and Border Protection for almost every motor vehicle brought into the United States. The Environmental Protection Agency uses it to confirm that your car, truck, motorcycle, or light-duty engine either meets Clean Air Act standards or qualifies for a specific exemption. Which Vehicles Need Form 3520-1
The form is required for each passenger car, light-duty truck, highway motorcycle, disassembled vehicle, kit car, and light-duty vehicle or motorcycle engine entering the country.2U.S. Customs and Border Protection. One narrow group is exempt from filing: brand-new vehicles imported by their original manufacturer, covered by a valid EPA certificate of conformity, and already bearing an EPA emission control label.3eCFR. 19 CFR 12.73 – Importation of Motor Vehicles and Motor Vehicle Engines That covers automakers shipping new inventory to their U.S. dealers. Heavy-duty highway engines, off-road equipment, ATVs, snowmobiles, and stationary engines use a different declaration, EPA Form 3520-21, not this one.4Environmental Protection Agency. What to Gather Before You File
Have the paperwork on the desk before you start. The core identifier is the seventeen-character Vehicle Identification Number, which federal rules require to be readable through the windshield on the driver’s side of passenger vehicles.5eCFR. 49 CFR Part 565 – Vehicle Identification Number (VIN) Requirements You also need the engine family name or serial number, the make, model, model year, and the date and country of manufacture.
Whoever signs the form is the Importer of Record and carries full legal responsibility for the accuracy of the declaration and the vehicle’s compliance status. If the vehicle owner is someone other than the importer, both parties’ contact details go on the form. A valid physical address for the vehicle’s final U.S. destination is required so the EPA can conduct follow-up inspections.

Choosing the Right Importation Code
The most consequential decision on Form 3520-1 is the letter code. Each code tells CBP and the EPA the legal basis on which your vehicle is entering, and each code carries its own documentation requirements. Pick the wrong one and CBP can hold the shipment or open an enforcement file.
Vehicles That Already Meet U.S. Standards
Code B is the cleanest path. It applies to vehicles originally manufactured to comply with U.S. EPA emission standards and carrying a U.S. emission control label in the engine compartment or on the motorcycle frame.7Environmental Protection Agency. Codes EE and FF cover vehicles identical in all material respects to a U.S.-certified version, most often Canadian-market cars. Code EE is for personal use and needs proof of Canadian origin, such as a Canadian emission label or a letter from the manufacturer’s U.S. representative. Code FF covers Canadian-identical models on the EPA’s approved list imported for resale or lease, with the importer taking on labeling, warranty, and fuel economy obligations.7Environmental Protection Agency. Non-Conforming Vehicles Through an ICI
A vehicle that doesn’t meet U.S. emission standards and doesn’t qualify for an exemption has to come in through an Independent Commercial Importer, a company with EPA credentials to modify, test, and certify specific makes and models for U.S. compliance.8U.S. Environmental Protection Agency. Independent Commercial Importers (ICIs) The applicable codes are A, C, J, and Z:
- Code A: the ICI holds a valid EPA certificate of conformity for the specific make, model, and model year and will modify the vehicle to match.
- Code C: the ICI will modify and test the vehicle under a separate regulatory pathway, and the vehicle must be at least six years old.
- Code J: the ICI is importing the vehicle for pre-certification testing, has 180 days to obtain the certificate or export the vehicle, and must post a customs bond.
- Code Z: the ICI will modify the vehicle to be identical to an OEM-certified U.S. version using written instructions from the original manufacturer.

Age-Based Exemptions
Code E covers vehicles at least 21 years old, calculated by subtracting the calendar year of manufacture from the year of importation. These vehicles are exempt or excluded from EPA emission requirements as long as they remain in their original, unmodified configuration.7Environmental Protection Agency. Read the age carefully. The EPA’s 21-year emission threshold is not the same as the DOT’s 25-year safety threshold. A 22-year-old vehicle clears EPA but still has to satisfy federal safety standards. Each form has to reflect the correct exemption status on its own terms.
Temporary and Personal-Use Imports
Code O covers vehicles imported by a nonresident for personal use for up to one year, with an EPA letter of approval attached and no resale in the U.S.7Environmental Protection Agency. Other temporary codes cover import for repair, testing, or display. Code G, for example, allows entry for repair or alteration but prohibits registering, licensing, or driving the vehicle on public roads, and it requires a customs bond and an EPA approval letter. The DOT Companion Form You Also Need
Form 3520-1 does not travel alone. Every vehicle import also requires DOT Form HS-7, the safety, bumper, and theft prevention declaration administered by NHTSA. DOT has its own compliance route for non-conforming vehicles, using a DOT Registered Importer rather than an ICI. Vehicles at least 25 years old are exempt from DOT safety standards entirely.11National Highway Traffic Safety Administration. Submitting the Form to CBP
The completed form is presented to CBP at the port of entry when the vehicle arrives. Many importers now file through the Automated Commercial Environment, CBP’s electronic trade processing system, which the EPA’s publications page points filers toward.6U.S. Environmental Protection Agency. Miss the window and there are consequences. Penalties for Getting It Wrong

A vehicle conditionally admitted that isn’t brought into compliance or granted final admission within the 120-day conditional period is treated as unlawfully imported unless it’s delivered to customs for export or other disposition.9eCFR. 40 CFR Part 85 Subpart P – Importation of Motor Vehicles and Motor Vehicle Engines A vehicle denied admission will not be released in any way that could let it reach a consumer in non-conforming condition, so the realistic outcomes are export at your expense or destruction.3eCFR. 19 CFR 12.73 – Importation of Motor Vehicles and Motor Vehicle Engines Falsifying information on the form compounds the exposure and can invite criminal referral on top of the civil penalty.
