Emergency Chapter 13 Filing: Automatic Stay and 14-Day Deadline

An emergency Chapter 13 filing is a stripped-down bankruptcy petition you can put on the court’s docket in a day, instead of the weeks it normally takes to assemble a full case. The moment the clerk opens your case, the automatic stay under 11 U.S.C. ยง 362 takes effect and halts foreclosure sales, wage garnishments, repossessions, evictions, and collection lawsuits.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay You then have 14 days to file everything else. This is designed for people who learn about a foreclosure sale on Friday for a Tuesday auction, not for people who have had time to prepare and didn’t.

When This Type of Filing Is Appropriate

The pattern is a specific, time-sensitive threat you cannot outrun with a normal filing timeline. A scheduled foreclosure sale is the most common. An active wage garnishment draining your paycheck is another. So is a repossession that’s imminent, or an eviction proceeding you need to pause. In each case, the full bankruptcy paperwork would take weeks, but a skeleton petition can be ready inside a day.

Courts take a dim view of bare-bones petitions filed without genuine urgency, and a pattern of filing and dismissing cases triggers serious consequences for later filings. If you have time to prepare a complete petition, use it. The scramble that follows an emergency filing is stressful, and the penalties for missing the follow-up deadline are harsh.

Who Can File Chapter 13

Chapter 13 is available to individuals with regular income whose debts fall below federal thresholds. Unsecured debts (credit cards, medical bills, personal loans) must be less than $526,700, and secured debts (mortgages, car loans) must be less than $1,580,125.2United States Courts. Chapter 13 Bankruptcy Basics These caps are adjusted for inflation, so verify the current figures at the time you file. The two caps are separate, not a combined limit.

Regular income does not have to be a salaried job. Self-employment earnings, Social Security, pension payments, and reliable support from a spouse or family member can all qualify. The court needs to see enough income to fund a three-to-five-year plan.

Credit Counseling and the Emergency Exception

Before filing, you generally must complete credit counseling with an agency approved by the U.S. Trustee, and the session has to occur within 180 days before your filing date.3United States Bankruptcy Court District of Columbia. Notice to All Debtors About Prepetition Credit Counseling Requirement Most approved agencies offer the session online or by phone, and it takes about an hour.

In a genuine emergency, you can file without having completed counseling, but you must submit a certification with your petition that describes the emergency, states you requested counseling, and confirms you could not obtain it within seven days. If the court accepts it, you get up to 30 days after filing to finish the course, with a possible 15-day extension for good cause.4Office of the Law Revision Counsel. 11 USC 109 – Who May Be a Debtor Miss that window and the court dismisses the case, and you have burned a filing that will affect stay protection in any future case.

What the Skeleton Petition Contains

The skeleton petition is deliberately lean. It is just enough for the court to open a case number and start the automatic stay. The four pieces:

  • Official Form 101, the Voluntary Petition. You enter your full legal name, any other names used in the last eight years, the last four digits of your Social Security number, your current address, and check the box for Chapter 13.5United States Courts. • Official Form 121, the Statement About Your Social Security Numbers. This provides your full nine-digit number for the court’s internal records and stays sealed from public view.6United States Bankruptcy Court Eastern District of Arkansas. • A creditor matrix listing every creditor’s name and mailing address. The court uses it to send notice of your bankruptcy to everyone you owe.
  • Your credit counseling certificate, or the emergency certification explaining why you couldn’t complete counseling first.

You do not need your full asset schedules, statement of financial affairs, means test, or repayment plan at this stage. Those come later.

Filing Fee and Payment Options

You submit the petition to the U.S. Bankruptcy Court for your district. Attorneys file electronically through CM/ECF; pro se filers usually hand-deliver to the clerk’s office, or use a simplified electronic portal in some districts. The filing fee is $313.7United States Bankruptcy Court Western District of Louisiana. Filing Fees for Chapter 7 and Chapter 13

If you can’t pay the fee upfront, file Official Form 103A to request installments.8Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 1006 – Filing Fee Chapter 13 filing fees cannot be waived entirely; the fee waiver on Form 103B is only available in Chapter 7.

Making the Automatic Stay Actually Stop the Collection

The stay is powerful on paper, but the people trying to take your money or property will not check the bankruptcy docket on their own the morning of a sale. You have to tell them, and you have to do it fast.

For a foreclosure, get the case number and a copy of the petition to the foreclosure trustee or the lender’s attorney by fax or email the moment the case is filed. For a wage garnishment, send notice to your employer’s payroll department and to the creditor; the employer must stop withholding once notified. For a scheduled repossession, contact the lender directly with the case number. Formal notice from the court will follow through the creditor matrix, but that mailing takes days you may not have.

Chapter 13 offers something Chapter 7 does not: your repayment plan can cure missed mortgage or car payments over the life of the plan, generally three to five years.2United States Courts. Chapter 13 Bankruptcy Basics You keep the property and catch up on the arrearage gradually, rather than owing the full past-due balance in a lump. This mechanism is often the whole reason people choose Chapter 13 in an emergency. Chapter 7 can delay a foreclosure, but it gives you no way to cure a default and keep the house.

The 14-Day Deadline

Federal Rule of Bankruptcy Procedure 1007(c) requires all remaining schedules and your Statement of Financial Affairs within 14 days of the petition date.9Legal Information Institute. Rule 1007 – Lists, Schedules, Statements, and Other Documents – Time to File Your Chapter 13 repayment plan is due within the same 14-day window under Rule 3015.10Legal Information Institute. Rule 3015 – Chapter 12 or Chapter 13 – Time to File a Plan

Two weeks to assemble:

  • Schedules A through J: assets, secured debts, unsecured debts, executory contracts, co-debtors, current income, and monthly expenses.
  • Statement of Financial Affairs: a full disclosure of recent income, payments to creditors, lawsuits, and property transfers.
  • Means Test on Forms 122C-1 and 122C-2, which determines how much disposable income you must pay into the plan.
  • The Chapter 13 repayment plan itself, including how you propose to cure any mortgage or car loan arrears.

Documents for the Trustee

Separately from what you file with the court, you must give the assigned Chapter 13 trustee copies of all pay stubs or other proof of income received within 60 days before filing, plus your most recent federal tax return or transcript, which has to reach the trustee at least seven days before the meeting of creditors.11Office of the Law Revision Counsel. 11 USC 521 – Debtor Duties If you have unfiled returns, catch them up before the meeting; the trustee can move to dismiss the case for unfiled tax returns.

Your First Plan Payment

You must begin plan payments to the trustee within 30 days of filing your plan or the date the court enters the order for relief, whichever is earlier.12Office of the Law Revision Counsel. 11 USC 1326 – Payments In an emergency case, this clock often starts before the court has confirmed your plan. Missing the first payment is one of the fastest ways to lose the case.

The 341 Meeting of Creditors

Between 21 and 50 days after filing, you attend the meeting of creditors, often called the 341 meeting after the Bankruptcy Code section that requires it.13United States Bankruptcy Court. What Is a 341(a) Meeting of Creditors The trustee questions you under oath about your finances, assets, and proposed plan. Creditors may attend, though most do not. Bring photo ID and proof of your Social Security number. Failing to appear lets the trustee move to dismiss.

What Happens If You Miss the 14-Day Deadline

Failing to file the remaining schedules and plan within 14 days leads to dismissal. The automatic stay disappears, and every collection action you stopped resumes where it left off. That is bad enough on its own, but the aftershocks reach into any future filing.

If you file again within one year after a dismissal, the automatic stay in the new case lasts only 30 days. To keep it, you must move to extend before those 30 days expire, and convince the court the new case was filed in good faith.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay The court presumes bad faith when the prior case was dismissed for failure to file documents, failure to follow court orders, or failure to perform under a confirmed plan.

Two or more dismissals within the prior year is worse: no automatic stay takes effect at all when you refile.1Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay You would have to ask the court to impose one, carrying the same presumption of bad faith. A court can also dismiss a case with prejudice, barring any new filing for 180 days. That is the scenario to avoid: losing the ability to stop a foreclosure precisely when you need it most.

Costs Beyond the $313 Filing Fee

The filing fee is the smallest cost. Attorney fees vary by district, and many courts set “no-look” fee caps, a presumptively reasonable amount attorneys can charge without a detailed fee application. These caps commonly run from about $3,000 to $8,500 depending on district and complexity. Attorney fees in Chapter 13 are usually folded into the repayment plan, though an attorney handling an emergency filing may require a retainer before the petition goes in.

The Chapter 13 trustee also takes a percentage of every payment flowing through the plan, capped by federal law at 10%.14Office of the Law Revision Counsel. 28 USC 586 – Duties and Functions of the United States Trustee The actual percentage varies by district and is built into the plan payment amount.

Two mandatory courses add smaller costs: the pre-filing credit counseling session (typically $10 to $50) and a post-filing personal financial management course you must complete before the court will grant a discharge at the end of your plan.15Office of the Law Revision Counsel. 11 USC 1328 – Discharge

Filing Pro Se Versus Hiring an Attorney

You can legally file Chapter 13 pro se, but an emergency filing is the riskiest place to try. The 14-day window is unforgiving. The means test is complex. A poorly drafted plan gets rejected at confirmation. Beyond the paperwork, someone has to notify creditors and lenders within hours when a foreclosure sale is scheduled, and that practical work is part of what a bankruptcy attorney does routinely.

If cost is the obstacle, many bankruptcy attorneys will take a modest retainer to handle the emergency filing and fold the rest of their fees into the plan. Some legal aid organizations offer emergency bankruptcy help for low-income filers. The cost of getting it wrong, a dismissed case that cripples your stay protection for a year, usually exceeds the cost of representation.
