Entry to the USA from Germany is visa-free for stays of up to 90 days, but only if you have an approved ESTA and a biometric e-passport before you board. Anything longer, any work or study, and certain travel or criminal histories push you into the formal visa process at a U.S. consulate. Even a one-hour layover on U.S. soil counts as an entry and needs the same paperwork.
What You Need Before You Fly
The Visa Waiver Program lets German citizens travel to the United States for tourism or short-term business without a visa, provided the stay does not exceed 90 days.1U.S. Department of State. The e-passport is a passport with an embedded electronic chip containing biometric data. German passports issued in recent years include this chip, marked by a small gold logo on the cover. Germany is part of the Six-Month Club agreement, so your passport only needs to remain valid for the duration of your trip rather than six months beyond it.3U.S. Customs and Border Protection. Applying for ESTA
The only official application site is esta.cbp.dhs.gov. The form asks for biographical details, passport information, employment history, and a series of eligibility questions. The total fee is $40.27, payable by credit card, debit card, or PayPal.5Official ESTA Application Website. Dozens of copycat websites imitate the official ESTA page, charge inflated fees, and sometimes fail to submit the application at all. Layovers Count
The United States does not have international transit zones at its airports. Every passenger who lands on U.S. soil, even for a one-hour connection, must clear immigration and customs. So a valid ESTA (or visa) is required for any itinerary that touches the U.S., even if the final destination is somewhere else. This catches travelers routing through Miami or New York on the way to the Caribbean or South America.
When ESTA Is Not an Option
ESTA covers tourism and short business trips for people with clean records and unproblematic travel histories. Several situations force you into the formal visa process at a U.S. Embassy or Consulate instead:
- Any trip planned for more than 90 days.
- Employment, enrollment in a degree program, or work as a media representative.
- Presence in Iran, Iraq, Libya, North Korea, Somalia, Sudan, Syria, or Yemen on or after March 1, 2011. Cuba was added separately, with travel there on or after January 12, 2021 also disqualifying. - A previous ESTA denial or a past U.S. overstay.
The B-1/B-2 Visitor Visa
The standard route for German tourists and business visitors who cannot use ESTA is the B-1 (business), B-2 (tourism), or combined B-1/B-2 visa.11U.S. Department of State. Arrival: What Happens at the Border
When you land, a Customs and Border Protection officer decides whether to admit you. An approved ESTA or valid visa gets you to the inspection booth; the officer makes the final call.13U.S. Customs and Border Protection. Immigration Inspection Program
Expect questions about the purpose and length of your trip, where you will be staying, and whether you have a return ticket. Answer truthfully and keep answers concise. Volunteering extra information or seeming evasive both raise flags. If the primary officer wants more detail you may be sent to secondary inspection, which is not automatic cause for panic; it simply gives officers time to review your situation without holding up the line. They may ask more questions, examine luggage, or contact a relevant embassy. The officer retains full authority to deny entry and order your return on the next available flight.
How Long You Can Actually Stay
Your authorized stay is not set by your ESTA expiration or the date printed on your visa sticker. It is set by the CBP officer at entry and recorded on your electronic Form I-94. For VWP travelers the maximum is 90 days. Visa holders are often granted up to six months, at the officer’s discretion. Trips to Canada or Mexico Do Not Reset the Clock
A common misconception is that a few days in Canada or Mexico restarts the 90-day VWP window. It does not. Time spent in Canada, Mexico, or nearby Caribbean islands counts toward the same 90-day period that started when you first entered the United States.16U.S. Department of State Foreign Affairs Manual. 9 FAM 201.1 Nonimmigrant Travel Without a Visa If you entered on day one and spent two weeks in Canada starting on day 30, you have 46 days left when you return.
VWP Travelers Cannot Extend
People who entered under the Visa Waiver Program cannot file to extend their stay or change immigration status from inside the United States.17U.S. Customs and Border Protection. I Want to Extend or Change My Nonimmigrant Status If plans change, the only legal option is to leave and either return later with a new ESTA entry or apply for a visa at a U.S. consulate abroad.
The Cost of Overstaying
Overstaying your I-94 date is a serious immigration violation, and the penalties scale with the length of unlawful presence:
- Between 180 days and one year, if you leave voluntarily before removal proceedings begin, brings a three-year bar from re-entry.
- One year or more brings a ten-year bar, regardless of how you depart.

Customs Rules on Arrival
Every arriving traveler completes a customs declaration, either electronically or on paper Form 6059B handed out during the flight. It covers what you are bringing into the country and requires honest answers about food, agricultural products, cash, and commercial merchandise.
Food and Agricultural Items
All food, plants, seeds, soil, and animal products must be declared. CBP agriculture specialists inspect these items to keep pests and animal diseases out. Items German travelers commonly carry, such as cured meats, fresh fruit, and certain cheeses, are often prohibited or restricted. If you declare a prohibited item you can surrender it at the border without penalty. Cash Over $10,000
You can bring any amount of cash or monetary instruments, but if you carry more than $10,000 (or its foreign equivalent), you must report it. The declaration goes on your customs form, and you must also file a separate FinCEN Form 105 with CBP.20U.S. Customs and Border Protection. Grounds for Being Turned Away
A CBP officer can refuse entry to anyone found inadmissible under the Immigration and Nationality Act. The most common grounds for German travelers include:
- A conviction, or even an admission of committing a crime involving moral turpitude such as fraud or theft. Any drug-related offense, regardless of severity, is also disqualifying.

- False statements. Misleading a CBP officer during inspection, or having lied on a prior visa or ESTA application, is an independent ground for denial.
- Certain communicable diseases or mental health conditions associated with harmful behavior.
Denial under the VWP is particularly harsh. Unlike visa holders, VWP travelers generally have no right to a hearing before an immigration judge. The officer’s decision is usually final, and you are returned on the next available flight.
A Word on Health Insurance
The United States does not require proof of health insurance for tourists or business visitors entering under the VWP or a B-1/B-2 visa. That is not a reason to skip it. American healthcare costs are dramatically higher than in Germany, and German statutory health insurance (gesetzliche Krankenversicherung) provides little or no coverage abroad. A short emergency room visit can easily produce a bill of several thousand dollars. Travel health insurance with adequate U.S. coverage is inexpensive relative to the risk.
