EBT at Gas Stations: SNAP Rules, TANF Cash, and Hot Food

Using EBT at gas stations works in two lanes. The food side of your card, funded by SNAP, pays for eligible groceries sold in the convenience store. If your card also carries a TANF cash balance, that side can pay for gasoline at the pump and for non-food items inside. The station has to be authorized by the USDA for either lane to work, and not every gas station is.

What the SNAP Side Pays For

Federal law defines SNAP-eligible food as food for home consumption, which rules out alcohol, tobacco, and hot foods ready to eat on the spot.1Office of the Law Revision Counsel. 7 USC 2012 – Definitions At a gas station convenience store, that usually means pre-packaged snacks, bread, dairy, bottled water, soda, cold sandwiches and salads from the refrigerator case, cereal, canned goods, frozen meals, and juice. Seeds and plants meant for growing food at home also qualify.

The working test is simple. If the item needs preparation at home or is packaged for takeaway, it passes. If it is designed to be eaten on the premises while still hot, it doesn’t. A cold wrapped sub from the cooler is fine. A hot dog off the roller grill is not. The register handles the sorting, so eligible items get charged to the food balance and everything else stays off it.

In states with bottle-deposit laws, SNAP can cover the mandatory container deposit on a drink. Optional charges like a paper bag fee cannot go on the food balance.1Office of the Law Revision Counsel. 7 USC 2012 – Definitions

What SNAP Will Not Cover

  • Hot prepared food: anything heated and ready to eat, including roller-grill hot dogs, heated pizza slices, and hot coffee.
  • Alcohol and tobacco: beer, wine, liquor, cigarettes, cigars, vape products, and loose tobacco.
  • Vitamins, supplements, and medicine, even when shelved next to food.
  • Non-food products: cleaning supplies, pet food, paper goods, and anything automotive.

These restrictions apply only to the food balance. If your card also carries TANF cash, that side can generally cover most of these items at a gas station.2U.S. Government Accountability Office. TANF Electronic Benefit Cards

The Hot-Food Exception

There is one narrow exception to the hot-food rule. Under the Restaurant Meals Program, SNAP recipients whose household members are all elderly (60 or older), disabled, or homeless can use benefits to buy hot prepared meals at participating locations, which can include gas station food counters.3Food and Nutrition Service. It’s a state option, and only a handful of states have adopted it, including California, Arizona, Illinois, Maryland, Michigan, and Rhode Island. Coverage can vary by county even in those states. You don’t need to prove anything at the counter; your card is coded by the state, and the transaction either goes through or it doesn’t.

Paying for Gas and Non-Food Items With TANF Cash

At least 37 states deliver TANF cash assistance through the EBT card, and the cash side of the card behaves like an ordinary debit card.4National Conference of State Legislatures. EBT Electronic Benefit Transfer Card Restrictions for Public Assistance You can swipe it at the pump for gasoline, or use it inside for motor oil, windshield fluid, soap, toothpaste, or anything else the store sells.

Federal TANF rules restrict where the cash can be spent, not what it buys. The prohibited locations are liquor stores, casinos, and adult entertainment establishments.5Administration for Children and Families. TANF Requirements Related to EBT Transactions A gas station is not on that list. Individual states can add their own product restrictions, so check your state’s TANF rules if you are unsure.

You can also pull cash from an ATM at or near a gas station using the cash balance. Most gas station ATMs charge a surcharge that comes out of your balance. Getting cash back at the register avoids that fee when the store offers it, and surcharge-free machines in your state’s EBT network are the other way around it.

Finding a Gas Station That Accepts EBT

Before driving out expecting to pay with your card, confirm the station is authorized. The USDA’s SNAP Retailer Locator searches by address or zip code and works in any phone browser.6Food and Nutrition Service. Authorization is granted store by store, not brand by brand. A national chain’s flag on the sign does not guarantee that location participates. Franchise owners can opt out, and some locations lose authorization for failing to stock enough qualifying food.7Food and Nutrition Service. Store Eligibility Requirements

At the Register

Swipe or insert the card at the terminal. The system asks whether to draw from the food account or the cash account. Enter your four-digit PIN. If you are buying eligible food along with non-food items or gas, the payment gets split: SNAP goes to the eligible food first, and the rest goes to your cash account or another payment method.

Your receipt shows the remaining balances on both accounts. Keep it; it’s the fastest way to track spending without calling the balance line.

Returns of SNAP-purchased items go back to the card. No store, gas station or otherwise, can hand you cash for a SNAP return.

Fees and Sales Tax

Federal law prohibits retailers from charging any fee or surcharge on a SNAP EBT transaction.8Congressional Research Service. TANF cash is different. ATM surcharges come out of your balance, and gas station ATMs are usually third-party machines that charge a few dollars per withdrawal.

Protecting the Card From Skimmers

Gas pumps are a favorite target for card skimming, and EBT cards are especially vulnerable because most still rely on the magnetic stripe. USDA has announced a rollout of chip-and-tap EBT cards, but until your state issues one, the stripe is the weak point.10Food and Nutrition Service. SNAP EBT Chip and Tap Cards Are Coming Soon

The FBI’s advice at the pump: choose one in view of the attendant, inspect the reader and keypad for anything loose or mismatched, cover the keypad when entering your PIN, and consider paying inside instead of outside.11Federal Bureau of Investigation. One important change: the federal program that let states replace SNAP benefits stolen through skimming expired on December 20, 2024. Benefits stolen after that date are not currently eligible for replacement using federal funds.12Food and Nutrition Service. Report suspected skimming to the FBI’s Internet Crime Complaint Center at ic3.gov and call your state EBT customer service line immediately to freeze the card.

Penalties for Misuse

Cardholders caught trafficking benefits, meaning exchanging them for cash or ineligible goods, can be required to repay the full amount and disqualified from SNAP. Criminal prosecution through the USDA Office of Inspector General or state law enforcement can add fines and jail time.13Congressional Research Service. Both people face penalties, and federal investigators watch transaction patterns for exactly this kind of activity.
