eBay Tax Reporting Threshold: Federal and State 1099-K Rules

eBay is required to send you a Form 1099-K only when your gross sales exceed $20,000 and you complete more than 200 transactions in the same calendar year. Both conditions have to be met. The eBay 1099-K threshold was in flux for several years, but recent federal legislation locked those numbers back in as permanent law. Some states use lower thresholds of their own, and whether or not you receive the form, all income from selling on eBay is still taxable and still has to appear on your return.

The Federal Threshold in Plain Numbers

Under 26 U.S.C. ยง 6050W(e), a third-party settlement organization like eBay must file a Form 1099-K for any seller whose gross reportable payments exceed $20,000 and whose total number of transactions exceeds 200 during the calendar year.1Office of the Law Revision Counsel. 26 USC 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions

Both bars have to be cleared. If you sell $25,000 worth of goods but only make 150 sales, you won’t get a form. If you make 300 transactions but gross only $15,000, same result. eBay may still choose to send a 1099-K when a seller falls below the federal threshold, and the IRS has confirmed platforms are allowed to do that.2Internal Revenue Service. Why You’ve Seen Different Numbers

The $20,000/200-transaction rule was the original standard when Congress created the 1099-K in 2008. In 2021, the American Rescue Plan Act dropped it to a flat $600 with no transaction count. The IRS never actually enforced that figure. It treated 2022 and 2023 as transition years, keeping the old threshold in place, and set a temporary $5,000 threshold with no transaction count for 2024.3Internal Revenue Service. Notice 2024-85

Congress then ended the back-and-forth. The One, Big, Beautiful Bill (P.L. 119-21) retroactively repealed the $600 threshold and restored the original $20,000/200-transaction rule as permanent law.4Congress.gov. States That Set Lower Thresholds

Several states enforce their own 1099-K reporting thresholds below the federal limit. Some set the bar as low as $600, others land around $1,000 or $2,500. If you live in one of those states, eBay is required to generate a 1099-K at the state-level threshold even when your sales are well under $20,000. The form goes to you and to your state tax authority.

These state requirements operate independently from the federal rule. A seller who never triggers a federal 1099-K can still receive one based on where they live. Your eBay seller dashboard will typically show which thresholds apply to your account based on your registered address. If you’re unsure, check with your state’s department of revenue.

What the Number on the Form Actually Represents

The dollar amount on your 1099-K is the gross payments processed through the platform before any adjustments. That is the raw total of every completed sale, including the shipping charges your buyers paid. It does not subtract eBay’s fees, promotional credits, or your cost of goods.

Cancelled orders and refunds are excluded from the reported total. Sales tax that eBay collects and remits on your behalf under state marketplace facilitator laws is also excluded, because that money never passes through your account.

The gross number will almost always be higher than what actually landed in your bank. The gap between the reported figure and your real take-home pay is where deductions and adjustments come in, and why the records you keep matter more than the number on the form.

If You Sold Personal Items at a Loss

Cleaning out a closet and selling old furniture, clothing, or hobby gear for less than you paid does not create taxable income, even when the sales appear on a 1099-K. The IRS is explicit on this point.6Internal Revenue Service. Two methods zero it out:

  • Report the 1099-K amount on Schedule 1 (Form 1040), Part I, Line 8z, then enter an equal offsetting adjustment on Part II, Line 24z. The net effect on your adjusted gross income is zero.
  • Report the sale on Form 8949 and Schedule D as a disposition of a capital asset, using your original purchase price as the cost basis. The resulting loss offsets the reported proceeds.

Either works. The Schedule 1 method is more straightforward for most casual sellers. Keep records of what you originally paid, whether that’s a receipt, a bank statement, or a screenshot of the purchase confirmation. If You Sell as a Business

If you buy goods with the intention of reselling them for a profit, the IRS treats that as a business. Gross income and deductible expenses go on Schedule C (Form 1040), which produces your net profit or loss.7Internal Revenue Service. About Schedule C (Form 1040), Profit or Loss from Business (Sole Proprietorship) The gross figure from your 1099-K goes on the income line, and every legitimate business cost gets subtracted from it.

Common deductions for eBay resellers include the purchase price of inventory and any freight paid to receive it, eBay’s final value and listing fees along with payment processing charges, postage and packaging materials, and advertising expenses such as promoted listing fees. If you store inventory at home, the IRS allows a home office deduction for that storage even without the strict exclusive-use test that applies to other home offices. Net profit from Schedule C is subject to self-employment tax at a combined 15.3% rate covering Social Security and Medicare, on any net earnings of $400 or more. New sellers often miss this because no employer is withholding it from their payouts. If you expect to owe $1,000 or more in tax for the year after withholding and refundable credits, you’re generally required to make quarterly estimated tax payments as well.9Internal Revenue Service. If the Form Is Wrong

Errors show up. A refunded transaction may have been included, or the form may reflect activity from a different account. Contact eBay first and ask for a corrected 1099-K; the issuer’s name and contact information sit in the upper-left corner of the form.10Internal Revenue Service. If a corrected form won’t arrive before your filing deadline, you don’t have to report a figure you know is wrong. Enter the incorrect amount on Schedule 1, Part I, Line 8z labeled “Form 1099-K Received in Error,” then enter an equal offsetting amount on Part II, Line 24z with the same label. Your adjusted gross income is unchanged, and you’ve created a paper trail. Save any correspondence with eBay about the dispute.10Internal Revenue Service. What Happens If You Don’t Report It

The IRS receives a copy of every 1099-K eBay files. When the income on that form doesn’t appear anywhere on your return, automated matching flags the mismatch. The accuracy-related penalty for negligence or substantial understatement is 20% of the underpaid tax.11Internal Revenue Service. Accuracy-Related Penalty If you should have been making estimated tax payments and weren’t, an underpayment penalty is added on top, calculated on how short you were each quarter.12Internal Revenue Service. The way through is straightforward. Personal items sold at a loss get zeroed out with the Schedule 1 offset. Business activity goes on Schedule C with the expenses that belong there. Don’t leave a 1099-K figure unaccounted for.
