EB-5 Timeline: Processing Stages, Delays, and Wait Times

The EB-5 timeline runs about five to seven years from the initial petition to an unconditional green card, though a rural-project investor from a country without backlog can finish in under five, and an investor from mainland China or India filing in the unreserved category can wait a decade or more. Three variables drive almost all of that spread: which project category the investor picks, the investor’s country of birth, and how cleanly the petition moves through USCIS review.

The Stages and How Long Each Takes

The process breaks into six phases, and each one has its own clock.

Preparation and filing. Three to six months, most of it spent documenting the lawful source of the capital. USCIS wants to trace every dollar back to its origin through tax returns, bank statements, business records, and property documents covering several years. If any portion came from a gift or inheritance, the donor’s financial history gets pulled in as well. An incomplete financial trail is the most common trigger for later delays and denials, so this stage rewards patience.

Waiting for a visa number. This is where the timeline splits sharply by country and category. The receipt notice sets the investor’s priority date, and the Department of State’s monthly Visa Bulletin controls when that date can move forward. Reserved categories currently have no backlog; the unreserved category has significant retrogression for mainland China and India, meaning priority dates must be years old before a visa number opens up.

Conditional residence. Six to 18 months to convert the approved petition into a conditional green card, either through Form I-485 inside the United States4U.S. Citizenship and Immigration Services. The conditional period. A fixed 24 months during which the capital must remain committed and the project must stay on track to create the required jobs.6eCFR. 8 CFR 216.6 – Petition by Investor to Remove Conditional Basis of Lawful Permanent Resident Status This length does not vary.

Removing conditions. Form I-829 must be filed in the 90-day window immediately before the second anniversary of conditional status. Filing early gets it rejected; filing late causes conditional status to expire and opens the door to removal.7U.S. Citizenship and Immigration Services. Historic Processing Times While the I-829 is pending, the receipt notice automatically extends resident status, so the investor can continue to live, work, and travel normally past the printed expiration date on the conditional card.

What Shortens the Timeline

The EB-5 Reform and Integrity Act of 2022 set aside 20 percent of annual EB-5 visas for rural projects, 10 percent for high-unemployment projects, and 2 percent for infrastructure projects.8Office of the Law Revision Counsel. 8 USC 1153 – Allocation of Immigrant Visas These pools currently carry no backlog. An investor from China or India who picks a qualifying rural project can effectively skip the years-long visa wait that the unreserved category imposes on the same nationality. That single choice is often worth more time than any other decision in the process.

Concurrent filing is the other big time-saver. A regional center investor already inside the U.S. on a valid visa can file Form I-485 at the same time as the I-526E, provided a visa number is immediately available.9U.S. Citizenship and Immigration Services. What Stretches It

Country backlog is the largest single delay. Annual per-country limits cap how many visas any nationality can receive in the unreserved category, and mainland China and India routinely feel that cap. An investor from either country filing in the unreserved category should expect the visa wait to dwarf every other stage combined.

A Request for Evidence during I-526 or I-526E review can add months. Investors have 84 calendar days to respond, and USCIS regulations prohibit extensions beyond that window.10U.S. Citizenship and Immigration Services. Redeployment issues can complicate the tail end. The capital must stay “at risk” through the entire sustainment period. If the project repays the investment entity before that period ends, the entity has to redeploy the capital into other qualifying commercial activity within a commercially reasonable timeframe.9U.S. Citizenship and Immigration Services. The Aging-Out Risk for Children

A long timeline creates a specific hazard for families with teenagers. A derivative child must be unmarried and under 21. The Child Status Protection Act protects against processing time pushing a child past that cutoff by subtracting the number of days the petition was pending from the child’s age on the date a visa became available; the result is the child’s “CSPA age,” and if it is under 21 the child remains eligible.11U.S. Citizenship and Immigration Services. What the Full Timeline Looks Like in Practice

Two investors filing on the same day can finish years apart.

An investor from a country without backlog who picks a qualifying rural project can realistically hold an unconditional green card in under five years: roughly six months to prepare, about two years for petition adjudication (faster with priority processing on some rural cases), immediate visa availability, six to 18 months for conditional residence, the fixed 24-month conditional period, and about nine months for the I-829.

An investor from mainland China filing in the unreserved category can be looking at a decade or more, with most of the added years spent waiting for a visa number after the petition is approved. The project category, in other words, is not just a financial choice. For many families it is the single largest factor deciding how long the whole process takes.
