EB-2 vs EB-3 Processing Time: PERM, I-140, and NIW

For applicants born in most countries, EB-2 processing time is shorter than EB-3 because EB-2 currently has no Visa Bulletin backlog while EB-3 has a wait of roughly two years. For applicants born in India or China, the two categories run almost even, and which one moves faster shifts from month to month. The processing steps themselves are identical; the country of birth is what decides the answer.

Where EB-2 and EB-3 Stand Right Now

The Visa Bulletin is the single biggest factor in how long either category takes. As of the June 2026 Visa Bulletin, the Final Action Dates look like this:1U.S. Department of State. Visa Bulletin for June 2026

  • EB-2, most countries: Current (no backlog)
  • EB-2, China: September 1, 2021 (roughly a five-year wait)
  • EB-2, India: September 1, 2013 (roughly a thirteen-year wait)
  • EB-3, most countries: June 1, 2024 (roughly a two-year wait)
  • EB-3, China: August 1, 2021 (roughly a five-year wait)
  • EB-3, India: December 15, 2013 (roughly a twelve-and-a-half-year wait)

For India, the EB-3 cutoff is actually a few months ahead of EB-2 right now. That is not a typo. The relative speed of the two categories shifts over time based on how USCIS and the State Department handle spillover visas, and Indian applicants routinely watch the two queues trade places.

For everyone born outside India, China, and a handful of other backlogged countries, the picture is much simpler: EB-2 is essentially instant once your paperwork is done, and EB-3 adds about two years on top of the same paperwork.

Why the Visa Bulletin Controls Almost Everything

EB-2 and EB-3 each receive roughly 28.6% of the total employment-based visas available each year, plus any unused visas from higher preference categories.2Office of the Law Revision Counsel. 8 USC 1153 – Allocation of Immigrant Visas On top of that, no single country’s nationals can receive more than 7% of the total visas in a given year.3Office of the Law Revision Counsel. 8 USC 1152 – Numerical Limitations on Individual Foreign States That 7% cap is what creates the enormous backlogs for India and China, where demand vastly exceeds the annual allotment.

You get a priority date when your PERM labor certification is filed. Your case can move forward only when the Visa Bulletin’s cutoff date advances past your priority date. Cutoff dates do not always move forward. When demand outpaces supply, the State Department retrogresses the dates, sometimes freezing applicants who were previously eligible to file. Indian and Chinese applicants have lived through years of stalled or retreating dates.

There are two charts in each Visa Bulletin. The Final Action Dates chart controls when a green card can actually be issued. The Dates for Filing chart sometimes has earlier cutoff dates, which USCIS may authorize for filing the I-485 adjustment application before a visa number is technically available.4U.S. Citizenship and Immigration Services. Adjustment of Status Filing Charts from the Visa Bulletin Filing under the Dates for Filing chart lets you obtain work and travel authorization while you wait for final approval.

One quirk hides inside EB-3: the “other workers” subcategory (unskilled labor that isn’t temporary or seasonal) is capped at 10,000 visas per year, creating an additional bottleneck within the category.5U.S. Citizenship and Immigration Services. The Processing Stages Take the Same Time in Both Categories

Everything that happens before you reach the Visa Bulletin queue takes the same amount of time whether you file EB-2 or EB-3.

PERM Labor Certification

Most EB-2 and EB-3 cases begin with a PERM labor certification, where the Department of Labor verifies that no qualified U.S. workers are available for the position. This is the longest pre-filing step. As of February 2026, the Department of Labor reports an average processing time of 503 calendar days for analyst review of PERM applications.6U.S. Department of Labor. Processing Times That is roughly 16 to 17 months of adjudication alone.

Two preliminary steps eat up months before the employer can even submit the application. A prevailing wage determination, in which the Department of Labor sets the minimum salary the employer must offer, often takes six to seven months. Recruitment adds more time: for professional positions, the employer must place a job order with the state workforce agency for 30 days, run newspaper ads on two Sundays, and complete three additional recruitment steps from a DOL-approved list. After recruitment wraps up, the employer must wait an additional 30 days before filing.7eCFR. 20 CFR Part 656 – Labor Certification Process for Permanent Employment of Aliens in the United States If the Department of Labor audits the application, add several more months.

Realistically, the full PERM process runs 24 months or longer in 2026, and it is identical for EB-2 and EB-3. Your priority date locks in the day PERM is filed, so a slow adjudication does not push you further back in the Visa Bulletin queue.

Form I-140

Once PERM is approved, the employer files Form I-140 (Immigrant Petition for Alien Workers) to establish that the worker qualifies for the category and that the employer can pay the offered wage.8eCFR. 8 CFR 204.5 – Petitions for Employment-Based Immigrants9U.S. Citizenship and Immigration Services. USCIS to Increase Premium Processing Fees10U.S. Citizenship and Immigration Services. How Do I Request Premium Processing? Premium processing does not move you up in the Visa Bulletin. It only compresses the I-140 review itself, and it is available for both EB-2 and EB-3.

If your priority date is current when the I-140 is filed, you can file the I-140 and I-485 simultaneously. Concurrent filing runs two steps in parallel and can save months. It requires you to be physically present in the United States and your priority date to be current under whichever chart USCIS designates that month. For applicants from countries with no backlog or short backlogs, this is a real accelerator.

Adjustment of Status

Once your priority date is current, you file Form I-485 to adjust status if you are already in the United States.11Office of the Law Revision Counsel. 8 USC 1255 – Adjustment of Status of Nonimmigrant to That of Person Admitted for Permanent Residence The median processing time for employment-based I-485 applications in fiscal year 2026 is about 6.2 months, though individual cases vary by field office.12U.S. Citizenship and Immigration Services. Historic Processing Times Applicants outside the United States go through consular processing instead, with timelines that depend on the embassy’s caseload; after the visa is issued and you enter the country, the physical green card arrives within 90 days.13U.S. Citizenship and Immigration Services. When to Expect Your Green Card

None of these stages runs faster for EB-2 than for EB-3. The category label does not change how the Department of Labor or USCIS handles the paperwork.

The One Real Speed Advantage EB-2 Has: The National Interest Waiver

The National Interest Waiver (NIW) is an EB-2-only path that skips the entire PERM process. No labor certification, no employer sponsorship, no recruitment ads. You petition on your own behalf, and you are not tied to a specific employer.14U.S. Citizenship and Immigration Services. USCIS Policy Manual Vol. 6, Part F, Ch. 5 – Advanced Degree or Exceptional Ability

USCIS evaluates three factors under the Dhanasar framework: whether your endeavor has substantial merit and national importance, whether you are well positioned to advance it, and whether, on balance, the U.S. benefits from waiving the job offer and labor certification requirements.

By eliminating the two-plus years of PERM, the NIW path from filing to I-140 decision typically runs well under a year. The Visa Bulletin backlog, however, still applies. An NIW applicant born in India today faces the same decade-plus wait as anyone else. The NIW advantage is speed to get in line, not speed through the line, which makes it most valuable for applicants from countries with little or no backlog.

Downgrading Between EB-2 and EB-3

Federal regulations let you carry your priority date from one approved I-140 to a new I-140 in a different employment-based category, and if you have multiple approved petitions, you are entitled to the earliest priority date among them.8eCFR. 8 CFR 204.5 – Petitions for Employment-Based Immigrants

That rule is what makes the “downgrade” strategy possible. If you have an approved EB-2 I-140 but EB-3 is moving faster on the Visa Bulletin, your employer can file a new I-140 under EB-3 while you keep your original EB-2 priority date. Staying with the same employer generally means you do not need a new PERM application for the downgrade. Some applicants file in both categories at once and take whichever queue reaches them first. It costs more upfront, but for someone facing a twelve-year wait, hedging across both queues is a reasonable play.

Priority date retention is lost only in narrow circumstances: fraud or misrepresentation, revocation of the underlying labor certification, invalidation of the certification by USCIS or the State Department, or a determination that the original approval rested on a material error. Even if a former employer withdraws an I-140 after it has been approved for 180 days or more, you keep the priority date. A denied petition never establishes a priority date in the first place.

Which Category You File Is Not Really Your Choice

Before assuming you can pick the faster category, know that the category is set by the job’s minimum requirements, not by your personal qualifications. EB-2 covers professionals holding an advanced degree (a master’s or higher, or a bachelor’s plus five years of progressive experience) and people with exceptional ability in the sciences, arts, or business.15U.S. Citizenship and Immigration Services. Employment-Based Immigration: Second Preference EB-2 EB-3 covers skilled workers (positions requiring at least two years of training or experience), professionals holding a bachelor’s degree, and “other workers” performing unskilled non-seasonal labor.5U.S. Citizenship and Immigration Services. Green Card for Employment-Based Immigrants

If you have a master’s degree but the job only requires a bachelor’s, your employer files under EB-3. That is the mechanic behind most downgrades and the reason many highly qualified workers end up in EB-3 by default.

Total Timeline Side by Side

Adding up every stage gives you a realistic 2026 picture:

  • PERM labor certification: 24 months or more, identical for EB-2 and EB-3
  • I-140 petition: several months standard, 15 business days with premium processing, identical for both
  • Visa Bulletin wait, most countries: EB-2 current, EB-3 roughly two years
  • Visa Bulletin wait, India: EB-2 roughly 13 years, EB-3 roughly 12.5 years
  • Visa Bulletin wait, China: EB-2 roughly 5 years, EB-3 roughly 5 years
  • Adjustment of status: median around 6 months, identical for both

For applicants born in most countries, EB-2 is unambiguously faster because there is no Visa Bulletin backlog at all. For Indian-born applicants, the two categories run nearly neck and neck, and the faster one flips periodically. The EB-2 National Interest Waiver cuts substantial time off the PERM stage but does nothing about the Visa Bulletin, so its value depends heavily on your country of birth. The stages you can influence, such as getting PERM filed quickly and using premium processing on the I-140, save months. The Visa Bulletin, which you cannot influence, accounts for the majority of the total wait for anyone from a backlogged country. Checking the bulletin every month and understanding the downgrade rules are the practical tools that keep the process moving.
