It does not buy a better review, and it does not accelerate anything beyond the I-140 itself.
What “Action” Means in 45 Business Days
Within 45 business days of receiving a properly filed I-907 and the correct fee, USCIS will do one of the following:2USCIS. How Do I Request Premium Processing
- Approve the petition.
- Deny the petition, with reasons.
- Issue a Request for Evidence (RFE) asking for more documentation.
- Issue a Notice of Intent to Deny (NOID) and give you a chance to respond.
- Open a fraud investigation.
Only the first of those is the outcome most applicants have in mind when they pay. The same officers apply the same legal standard to the same evidence whether or not you pay for premium processing. If USCIS misses the 45-business-day window, it must refund the fee and continue treating the case as premium processed.
Business days exclude weekends and federal holidays, so 45 business days runs about nine calendar weeks.
What Premium Processing Does Not Cover
Premium processing applies to the I-140 only. If you filed Form I-485 to adjust status at the same time, that application stays in its own queue on its own timeline. The same is true for dependent family members. A fast I-140 decision does not pull those cases forward.
It also has no effect on visa availability. For applicants from countries with heavy demand, like India and China, the wait for a visa number can run years, and that queue is untouched by anything you pay USCIS. A faster I-140 approval locks in your priority date sooner, which matters, but it does not shorten the backlog itself.
Who Can Request It
Anyone filing an EB-2 NIW I-140 can request premium processing. Because the NIW category permits self-petitioning, you do not need an employer to file on your behalf.3USCIS. You can file Form I-907 with a brand-new I-140 or by itself if your I-140 is already pending. For a pending case, you’ll need the 13-character receipt number from the Form I-797 that USCIS sent when it accepted your original petition.
The Full Cost
The $2,965 fee took effect March 1, 2026, replacing the prior $2,805.1USCIS. This is on top of your base I-140 filing fee and, for employer-sponsored petitions, the separate Asylum Program Fee. Those amounts depend on category and employer size and are listed on the USCIS fee schedule (Form G-1055).5USCIS. Attorney fees for preparing an NIW petition and the premium processing request typically run somewhere between about $3,500 and $14,500, depending on case complexity and the attorney. Between government and legal costs, the total out of pocket for a premium-processed NIW filing can easily clear $5,000.

Online
You can file I-907 online only if your underlying I-140 is already pending and has a receipt number beginning with “IOE.” You cannot bundle a new I-140 and Form I-907 together online; that combination has to go by mail.7USCIS. By Mail
For paper filings, the correct service center address for I-140 filings is listed on the Form I-140 page at uscis.gov. Use a carrier with tracking so you can confirm delivery.
Payment by mail has changed. USCIS no longer accepts personal checks, business checks, money orders, or cashier’s checks for most paper filings. Instead, complete Form G-1450 to authorize a credit, debit, or prepaid card charge, or Form G-1650 to authorize a direct debit from a U.S. bank account.8USCIS. What an RFE or NOID Does to the Clock
RFEs and NOIDs are common in NIW cases, and receiving one does not doom your petition. It does reset the timeline. When USCIS issues an RFE or NOID, the 45-business-day clock stops immediately. A case with an RFE can therefore take considerably longer than nine weeks end to end. The practical implication is straightforward: put your strongest evidence in the initial filing. Premium processing rewards a well-documented petition and punishes a thin one, because gaps trigger the reset that eats most of the time savings you paid for.
