EB-2 NIW premium processing is a $2,965 paid upgrade that requires USCIS to take action on your Form I-140 within 45 business days, instead of the 14 months or more that regular processing typically runs.1eCFR. 8 CFR 106.4 – Premium Processing Fees2U.S. Citizenship and Immigration Services. How Do I Request Premium Processing You can request it with your initial National Interest Waiver filing or add it to a petition already pending with the agency. What it buys you is speed on the petition decision itself. Nothing downstream.
What the 45-Business-Day Clock Actually Guarantees
Premium processing guarantees a timely action, not a timely approval. Within the 45-business-day window after USCIS receives a properly completed Form I-907 and fee, the agency will issue one of the following:2U.S. Citizenship and Immigration Services. How Do I Request Premium Processing
- An approval notice, which grants the I-140 and locks in your priority date.
- A request for evidence (RFE) asking for more documentation.
- A notice of intent to deny (NOID) giving you a chance to respond before a final decision.
- A denial.
- The opening of a fraud or misrepresentation investigation.
If USCIS issues an RFE, the clock pauses. It doesn’t run while you’re preparing your response. Once your response is received, a new 45-business-day window begins on the supplemented petition. In practice that means an RFE can roughly double your total wait, but you’re still on a defined timeline rather than sitting in the general queue.
If USCIS misses the deadline, the premium processing fee is refunded and adjudication continues. The one exception: no refund is issued when the agency has opened a fraud or misrepresentation case tied to your petition.3U.S. Citizenship and Immigration Services. Form I-907 Instructions
How to Request Premium Processing on a NIW Petition
You request the service by filing Form I-907. There are two filing paths.
File by mail if you’re submitting the I-907 together with your initial I-140. If you’re adding premium processing to a petition already pending, you can file the standalone I-907 online through a USCIS account, or by mail.4U.S. Citizenship and Immigration Services. I-907, Request for Premium Processing Service Only one Form I-907 goes per petition.
The correct mailing address depends on the underlying petition type. USCIS directs NIW filers to the I-140 filing addresses page for current instructions, and those addresses change from time to time, so pull them fresh at the point of filing rather than relying on a printout from earlier in your case.5U.S. Citizenship and Immigration Services. For an upgrade, include the receipt number from your I-797 Notice of Action so USCIS can attach the I-907 to the correct file. Use a trackable delivery service for anything mailed. The 45-business-day clock starts when USCIS receives a complete I-907 package, and proof of receipt matters if you later need to argue the deadline was missed.2U.S. Citizenship and Immigration Services. Costs and How to Pay
The premium processing fee for an EB-2 NIW petition is $2,965, set by federal regulation at 8 CFR 106.4.1eCFR. 8 CFR 106.4 – Premium Processing Fees It’s on top of the base I-140 filing fee, which you owe whether or not you upgrade. Check the current USCIS fee schedule for the I-140 amount at the time you file, since fees are periodically adjusted.
Accepted payments include personal checks, cashier’s checks, and money orders drawn on a U.S. financial institution. For credit or debit payment on a mailed filing, attach Form G-1450, Authorization for Credit Card Transactions.6U.S. Citizenship and Immigration Services. G-1450, Authorization for Credit Card Transactions Online filers pay through the USCIS portal.
Attorney fees are a separate consideration. For preparing and filing an NIW petition, they typically run between $6,000 and $14,500, depending on the complexity of the case and location. That fee generally covers petition strategy, the supporting brief, evidence organization, and often the premium processing request itself. Filing without an attorney is allowed. NIW cases are evidence-heavy and most petitioners hire one.
What Premium Processing Does Not Do
Speed on the I-140 doesn’t carry through to the rest of your green card process. A few limits are worth being clear about before you pay the fee.
Form I-485, the adjustment of status application, is not eligible for premium processing. If you file the I-485 concurrently with your I-140, the I-140 side moves on the 45-business-day clock while the I-485 follows its own timeline, which can run a year or more after I-140 approval.
Priority date backlogs are unaffected. An approved I-140 establishes your priority date, which is your place in line for a visa number. For applicants born in most countries, EB-2 dates are current or nearly so. Applicants born in India and China face EB-2 backlogs that can stretch for years, and premium processing does nothing to shorten that wait. It does still buy you an early, locked-in priority date and flexibility to change employers or extend nonimmigrant status under certain protections, so it retains value even when the visa bulletin isn’t current.
And premium processing doesn’t lower the standard of review. A weak petition filed with the upgrade simply gets denied faster.
Why Your Evidence Package Still Decides the Outcome
USCIS evaluates every NIW petition under the three-prong framework from Matter of Dhanasar: substantial merit and national importance, being well positioned to advance the endeavor, and whether it is beneficial to waive the job offer requirement.7U.S. Department of Justice. Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016) Officers reviewing your case under premium processing apply the same standards as officers on the regular timeline.
USCIS has published guidance on what evidence it expects. Recommendation letters carry more weight when they come from independent experts with firsthand knowledge of your achievements, describe those achievements specifically, and explain how you’re positioned to advance the endeavor. Letters from interested U.S. government agencies or quasi-governmental entities like federally funded research centers can strengthen the case across all three prongs. Business plans and proposals help explain objectives but aren’t enough on their own; USCIS looks for independent corroboration such as funding commitments, customer interest, patent filings, or media coverage.8U.S. Citizenship and Immigration Services. Employment-Based Immigration: Second Preference EB-2
One procedural pitfall is worth calling out because it can eat weeks even on the premium clock. NIW petitioners skip full labor certification, but USCIS still requires a completed Form ETA-9089 Appendix A alongside the I-140.8U.S. Citizenship and Immigration Services. Employment-Based Immigration: Second Preference EB-2 A missing or incorrectly completed Appendix A can trigger an RFE on its own, which resets the clock for reasons that have nothing to do with the strength of your underlying case.
