The EB-2 NIW for software engineers is a self-petitioned green card route that skips employer sponsorship and the PERM labor certification, so long as you can show your work benefits the United States enough to justify the waiver. You qualify for the underlying EB-2 category through an advanced degree or exceptional ability, then win the waiver by satisfying the three-prong test from Matter of Dhanasar. Independence from any single employer is the main draw. The tradeoffs are a tighter adjudication standard in recent years and, for applicants born in India or China, a visa backlog that can outlast the petition itself.
Do You Qualify for EB-2 in the First Place?
The cleanest way in is an advanced degree: a U.S. master’s or doctorate, or the foreign equivalent. “Progressive” is the word that trips people up. The alternative is exceptional ability, which requires at least three of six specific types of evidence: an academic credential in your field, ten years of documented full-time experience, a professional license, a salary that reflects exceptional ability, membership in an association that requires achievement to join, or peer and industry recognition.3eCFR. 8 CFR 204.5 – Petitions for Employment-Based Immigrants For software engineers this pathway is harder to document than the degree route, and most successful tech petitioners qualify through the degree.
The Three Dhanasar Prongs
Every NIW petition rises or falls on Matter of Dhanasar. You have to show (1) that your proposed endeavor has substantial merit and national importance, (2) that you are well-positioned to advance it, and (3) that on balance the country benefits from waiving the job offer and labor certification requirements for you.4U.S. Department of Justice. Substantial Merit and National Importance
The work has to matter beyond your employer’s bottom line. USCIS looks for impact on a technology field, the economy, public health, or national security. The strongest framing is a direct connection to the White House Critical and Emerging Technologies list, which includes artificial intelligence, cybersecurity, quantum computing, advanced computing and semiconductor design, clean energy technologies, and integrated communication and networking technologies like 5G and 6G.5GovInfo. National importance does not mean your work has to touch every state. It means the impact travels past a single employer or locality. Scalable cloud infrastructure supporting e-commerce used nationwide is economic benefit. Security tools protecting financial systems or energy grids touch national defense. Contributions to open-source projects used across an industry qualify because the ripple effects go well beyond your desk. Describe the endeavor and its reach, not your job duties.
Well-Positioned to Advance the Endeavor
This is where software engineer petitions most often stumble. USCIS wants a track record that predicts future success: education, specialized training, and concrete accomplishments. A developer who architected a widely adopted database system, or built infrastructure serving millions of users, has tangible proof. A resume of generic responsibilities without measurable outcomes does not.
Patents, proprietary technologies, published research, leadership on major projects, invited conference talks, and contributions to industry standards all count. So does funding: venture capital, grants, or corporate investment in the specific work you’re proposing signals that people with money on the line believe you can deliver.
Expert opinion letters usually carry the most weight in this prong, and they are also where the most damage is done. A vague letter from a professor that says the applicant is talented and the work is important adds almost nothing. Officers read hundreds of these and recognize a template immediately. Effective letters come from people with authority to speak about your specific contributions. The writer should explain, in concrete terms, what problem your work solved, why the problem matters to the field, and how your approach differs from what came before. A letter from a colleague at a different company describing how your open-source library saved their team months carries more than a letter from your own manager saying you’re a great employee. Aim for independent writers who can describe your impact from the outside.
The Balancing Test
The third prong asks whether the country benefits more from waiving labor certification than from requiring it.6U.S. Citizenship and Immigration Services. If your endeavor involves entrepreneurship, independent research, or contributions across multiple organizations, tethering you to one employer through labor certification would shrink the impact. You can also point to urgent national need in your specialty, the difficulty of replacing your particular expertise, and the delay labor certification would impose on work the country needs done now. This prong is less about new evidence than about tying prongs one and two into a coherent argument.
What You File and What It Contains
Form I-140 is the primary petition.7USCIS. Beyond the forms, a complete package generally includes:
- Academic records: diplomas, transcripts, and credential evaluations for foreign degrees.
- A detailed CV covering publications, patents, projects, technical skills, and professional history.
- A petition letter organizing the evidence under the three Dhanasar prongs.
- Expert opinion letters, typically four to six, from independent professionals who can speak to the significance of your contributions.
- Evidence of impact: citations to your published work, usage or download statistics for your software, patent filings, media coverage, awards, and industry recognition.
- Salary and compensation records, particularly if you’re qualifying under exceptional ability.
- Professional certifications in specialized areas like cybersecurity, cloud architecture, or machine learning.
Any document not in English needs a certified translation, with a signed statement from the translator confirming the translation is complete and accurate and that they are competent to translate from the source language into English. This is regulatory, not optional, and deficient translations are a common cause of delay.
Fees
The base I-140 filing fee is $715. A self-petitioner also owes a $300 Asylum Program Fee, for a base total of $1,015.10U.S. Citizenship and Immigration Services. Attorney fees for preparing an NIW package typically run from several thousand to over ten thousand dollars, depending on complexity, and are not government fees. If you later file Form I-485 for adjustment of status, expect an additional filing fee of roughly $1,225 for the primary applicant, with more for each dependent. Plan the full budget upfront.
Filing and Timeline
You can file Form I-140 online through a USCIS account or by mail to the appropriate lockbox. Online filing is only available for standalone I-140 petitions; if you’re submitting Form I-907 for premium processing alongside the petition, you must file by mail.7USCIS. Without premium processing, NIW petitions have been taking roughly 18 to 20 months. Premium processing guarantees USCIS action within 45 business days, not calendar days.13U.S. Citizenship and Immigration Services. How Do I Request Premium Processing? That action can be an approval, a denial, or a Request for Evidence. For most software engineers who can absorb the cost, premium processing is worth it because a two-year wait creates significant planning uncertainty.
If USCIS issues a Request for Evidence, you get 84 calendar days to respond, plus three days for domestic mailing.14USCIS. Treat one as a chance to strengthen the record, not a rejection, but the deadline is firm and missing it results in denial on the existing record.
Priority Dates and the Backlog
Approval of the I-140 is not the green card. Your priority date, the date USCIS received your petition, sets your place in the visa queue, and the Department of State publishes a monthly Visa Bulletin showing which dates are eligible for final processing.
For applicants born in most countries, EB-2 is current, meaning there is no meaningful wait after approval. For India, the wait is severe. As of the October 2025 Visa Bulletin (fiscal year 2026), the EB-2 Final Action Date for India is April 1, 2013, a backlog of more than twelve years. For mainland China, the date is April 1, 2021, roughly four years back.15U.S. Department of State. The Visa Bulletin has two charts. The Final Action Date controls when the green card can actually be issued. The Date for Filing may allow you to submit adjustment of status earlier, which unlocks interim benefits like work authorization and travel documents while the final green card waits. Keeping Status and Traveling While You Wait
If you hold H-1B status, the NIW process fits well with it. Filing a self-petitioned I-140 does not affect the H-1B because H-1B is dual-intent, and you can change H-1B employers freely. Once Form I-485 is on file, your H-1B can expire without making you ineligible for the green card, provided you don’t work without authorization or become inadmissible on other grounds.16U.S. Citizenship and Immigration Services. Travel needs more care. An H-1B holder with a pending I-485 can travel and return without abandoning adjustment, but only by re-entering on a valid H-1B visa and returning to the sponsoring employer. If your H-1B stamp has expired or you plan to leave your current employer, apply for Advance Parole before you go. Leaving the U.S. without either a valid H-1B re-entry path or approved Advance Parole can result in USCIS treating the I-485 as abandoned.
Getting to the Green Card
Once the I-140 is approved and your priority date is current, you finish the process. Inside the United States, you file Form I-485 for adjustment of status; if your priority date is current when the I-140 is approved, concurrent filing may be available and saves time.18U.S. Citizenship and Immigration Services. Keep your underlying status current, save copies of every filing and receipt, and check the Visa Bulletin each month. Your approved I-140 and its priority date remain valid if you change jobs or employers, which is meaningful protection over a long wait.
