An Employment Authorization Document (Form I-766) is valid for whatever period USCIS prints on the front of the card, and for most common categories that period is now capped at 18 months for cards issued on or after December 5, 2025. Parole- and TPS-based EADs are capped even shorter, at one year or the end of the underlying status. Two rule changes in late 2025 shortened these validity periods and eliminated the automatic extension that used to bridge the gap during renewal, so the date on your card matters more than it did a year ago.
Maximum Validity by Category
USCIS has discretion to set a shorter period on any individual card, but federal rules cap the maximum by eligibility category. Parolees and Temporary Protected Status holders sit under a tighter cap. Their EADs are valid for the shorter of one year or the end date of the authorized parole period or TPS designation, effective for applications pending or filed on or after July 22, 2025.2U.S. Citizenship and Immigration Services. Dependent spouses of E, L, and H-1B nonimmigrants get EADs tied to the expiration of their I-94 arrival/departure record, with USCIS retaining discretion to set a shorter period. F-1 students on Optional Practical Training receive a standard 12-month card; those with a qualifying STEM degree can add a one-time 24-month extension for a total of 36 months.3U.S. Citizenship and Immigration Services. The category code printed on the front of your card identifies which cap applies to you.
If Your Current Card Was Issued Under the Old Rules
The shorter caps do not shorten cards already in your wallet. If you hold an EAD that was issued with a five-year validity before December 5, 2025, it remains valid through the printed expiration date. The new limits only apply to applications that were pending on that date or filed afterward.
Automatic Extensions Have Ended
An interim final rule effective October 30, 2025 eliminated automatic extensions for EAD renewal applications filed on or after that date.4U.S. Citizenship and Immigration Services. Interim Final Rule Published Ending the Practice of Automatically Extending Certain EADs Under the old system, a timely renewal in the same category kept your expiring card valid for up to 540 days while USCIS processed the new application. That bridge is gone for new filings.
The practical consequence is straightforward. If you file a renewal today and your current card expires before USCIS approves the new one, you have no work authorization during the gap, and your employer must remove you from payroll until you can present a valid document. USCIS now recommends filing the renewal application up to 180 days before your EAD expires.5U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Even 180 days may not be enough if processing runs long, so early filing reduces the risk of a gap without eliminating it. Working without valid authorization can weigh against you in future discretionary immigration decisions.
Two exceptions survive the rule change. TPS-based EADs can still be extended through Federal Register notices when USCIS extends or redesignates a country for TPS. And certain F-1 student mechanisms, including the STEM OPT extension and the H-1B cap-gap, continue to operate under separate legal frameworks.
Renewals Filed Before October 30, 2025 Still Get 540 Days
If you filed your renewal before October 30, 2025, the old rule governs your pending application. Your expired card remains valid for up to 540 days past its printed expiration, or until USCIS decides the renewal, whichever comes first.6U.S. Citizenship and Immigration Services. Three conditions must be met. You filed the renewal before your card expired, the renewal is in the same eligibility category as your current EAD (with a TPS exception allowing A12 and C19 to match each other), and your category code appears on the list of eligible classes: A03, A05, A07, A08, A10, A17, A18, C08, C09, C10, C16, C20, C22, C24, C26, and C31.7U.S. Citizenship and Immigration Services. You will not receive a new card during the extended period. Your expired EAD paired with your Form I-797C receipt notice functions as the proof of continued work authorization. Employers are required to accept that combination as a valid List A document for Form I-9, provided the category code in the receipt’s “Class Requested” field matches the code on the front of the expired card.
When an EAD Ends Before Its Printed Date
The card draws its authority from the underlying status or pending application. If that foundation disappears, the printed expiration date becomes irrelevant.
Common triggers include expiration of parole without renewal, revocation of parole by DHS, and a final denial of the application the EAD was based on, such as an asylum claim or an adjustment of status petition.8E-Verify. Before revoking an approved petition or status, USCIS generally issues a Notice of Intent to Revoke and gives you a chance to respond. The standard response window is 30 days, with three extra days if the notice is mailed and an additional 14 days if you are outside the United States.9U.S. Citizenship and Immigration Services. Combo Cards Expire All at Once
If you filed Form I-485 along with both Form I-765 and Form I-131, USCIS may issue a single card that works as both your EAD and your advance parole travel document. The card looks like a standard EAD but carries the text “Serves as I-512 Advance Parole.”10U.S. Citizenship and Immigration Services. Both functions live on one document, so when the card expires, you lose work authorization and travel permission at the same time. Time your renewal accordingly, especially given that the automatic 540-day bridge no longer applies to new filings and would not, in any case, have covered travel.
What to Do Before Your Card Expires
Check the printed expiration date and the category code on the front of your EAD. Count back 180 days, and set that as your target date to file Form I-765. If you fall into one of the classes now capped at 18 months, expect that renewal cycle to come around faster than it used to. And if your card is a combo card or is tied to parole or TPS, treat the underlying status end date as the real expiration, because that is what controls.
