EAD Extension: Filing Form I-765 After Auto-Extensions End

To renew your Employment Authorization Document, file Form I-765 with U.S. Citizenship and Immigration Services up to 180 days before your current card expires. The rules around an EAD renewal changed significantly in late 2025: if you file on or after October 30, 2025, you no longer get any automatic extension of work authorization while USCIS processes your application. Filing early, filing correctly, and stopping work the moment your card expires are now the three things that matter most.

The Automatic Extension Has Ended for New Filings

For years, timely renewal filers received an automatic extension of their work authorization — up to 540 days past the card’s expiration — while USCIS worked through the application. That safety net, at 8 CFR 274a.13(d), applied to renewals filed between May 4, 2022 and October 29, 2025.1eCFR. 8 CFR 274a.13 – Application for Employment Authorization

If you file your renewal on or after October 30, 2025, you are not eligible for any automatic extension of your work authorization or EAD validity.2U.S. Citizenship and Immigration Services. Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization Once your card expires, you cannot legally work until USCIS approves your renewal and issues a new card. A processing delay now translates directly into a gap in employment.

When to File

USCIS accepts renewal applications up to 180 days before the current EAD expires. With no automatic extension available, filing at the earliest possible date is the best protection you have. Processing times vary widely by category: some renewals get decisions within a few months, others take a year or more. After approval, it typically takes about two weeks for the new card to be produced and mailed via USPS Priority Mail.3U.S. Citizenship and Immigration Services. Do the math on your own case. If your category historically takes eight or nine months to adjudicate, and you file 90 days before expiration, you should expect to stop working when the card expires and wait. Filing the full 180 days out gives USCIS the maximum runway to decide before your authorization lapses.

Who Can Renew

Your EAD is tied to a specific immigration category, and renewal eligibility depends on whether that underlying status still supports work authorization. Common categories that renew include applicants with a pending Form I-485 (green card), asylees and refugees, and certain H-4, L-2, and E dependent spouses.4U.S. Citizenship and Immigration Services. Each EAD shows a category code identifying the legal basis for work authorization. (c)(8) covers pending asylum applicants; (c)(9) covers adjustment of status applicants.5U.S. Citizenship and Immigration Services. Your renewal must be filed under the same category or a valid new one, and a mismatched code is a common cause of denial.

Filling Out Form I-765

The form asks for your full legal name, U.S. mailing address, Alien Registration Number (A-Number), and the eligibility category code. Accuracy matters. A transposed digit in your A-Number or the wrong category code can delay your case by months or lead to rejection.

Supporting documents depend on your category, but common requirements include:

  • Two identical color passport-style photos, 2 by 2 inches, taken recently against a white or off-white background. Photos must be unmounted, unretouched, and not digitally enhanced.   • A photocopy of both sides of your current EAD.

F-1 students seeking the 24-month STEM OPT extension have additional requirements: the employer must be enrolled in E-Verify, you must list the employer’s E-Verify Company Identification Number, and the employer must complete a Form I-983 training plan before you file.7U.S. Citizenship and Immigration Services. Filing Fees

The base filing fee for a Form I-765 renewal is $520 for paper submissions or $470 for online filings.8U.S. Citizenship and Immigration Services.   • Asylum applicant (c)(8) renewal: base fee plus $275
  • TPS (a)(12) or (c)(19) renewal: base fee plus $280
  • Parolee (c)(11) renewal: base fee plus $280

If you filed a Form I-485 with a fee on or after April 1, 2024 and that application is still pending, your I-765 renewal fee is $260, whether filed online or on paper.8U.S. Citizenship and Immigration Services. If you cannot afford the fee, you can request a waiver on Form I-912 based on a means-tested benefit, household income at or below 150 percent of the Federal Poverty Guidelines, or documented financial hardship.10U.S. Citizenship and Immigration Services. Submitting the Application

Many applicants can file Form I-765 online through a USCIS account, which provides instant confirmation and slightly lower fees. Others must mail a paper application to a USCIS Lockbox. The correct address depends on your category and where you live; the current Form I-765 instructions list the right one. Mailing to the wrong facility can delay your case significantly.

After USCIS accepts the filing, you will receive a Form I-797C receipt notice with a 13-character receipt number — three letters followed by ten digits.11U.S. Citizenship and Immigration Services. Checking Your Case Status Online Use that number to track your case online. Some applicants will also be scheduled for a biometrics appointment at an Application Support Center.

Premium processing is available only for F-1 OPT and STEM OPT applicants, using Form I-907. As of March 1, 2026 the premium fee for Form I-765 is $1,780, on top of the standard filing fee.12U.S. Citizenship and Immigration Services. If You Filed Before October 30, 2025

If your renewal was properly filed before October 30, 2025, you may still be within the 540-day automatic extension. To use it, the renewal must have been filed before the card expired and must be based on the same category code as the expiring card. Only certain codes qualify: A03, A05, A07, A08, A10, A17, A18, C08, C09, C10, C16, C20, C22, C24, C26, C31, A12, and C19.2U.S. Citizenship and Immigration Services. Your employer verifies continued authorization by examining your expired EAD together with the Form I-797C receipt for the pending renewal, and the category code on the receipt must match the code on the expired card (ignoring any trailing “P” in codes like C09P). H-4, E, and L-2 dependent spouses must also show an unexpired Form I-94 with valid derivative status.13U.S. Citizenship and Immigration Services. What Working Past Expiration Can Cost You

Working after your EAD expires — even for a single day — counts as unauthorized employment and can permanently damage your ability to become a permanent resident.

Federal law bars most applicants from adjusting to permanent resident status if they engaged in unauthorized employment at any point during their stay in the United States.14Office of the Law Revision Counsel. 8 USC 1255 – Adjustment of Status of Nonimmigrant to That of Person Admitted for Permanent Residence USCIS treats the bar as triggered from the first day of unauthorized work, and leaving the country and returning does not erase it.15U.S. Citizenship and Immigration Services. Certain employment-based applicants get limited relief under Section 245(k), which permits adjustment despite unauthorized employment only if the total of all status violations since the applicant’s most recent lawful admission does not exceed 180 days. If your EAD expires and your renewal has not been approved, stop working. The lost income is recoverable. A permanent bar to a green card is not.

Address Changes and Travel While Pending

If you move while the renewal is pending, report the new address to USCIS within 10 days.16U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card The fastest method is through your USCIS online account, which updates the address almost immediately. Paper Form AR-11 submissions do not automatically update your pending case, and missing a request for evidence because it went to the old address can result in a denial.

International travel is a separate question with real consequences. A pending Form I-765 is not a travel document. Adjustment of status applicants who leave without advance parole can have their I-485 treated as abandoned, and asylum applicants who leave without prior authorization can be treated as having abandoned the claim. If Your Renewal Is Denied

There is no formal appeal from a denied Form I-765. You have two options: file a motion to reopen or reconsider on Form I-290B within 30 days of the denial (33 days if the notice was mailed), or file a new Form I-765 if you can establish eligibility.17U.S. Citizenship and Immigration Services. A motion to reopen requires new evidence addressing the reason for denial, and the same office reviews it. Filing a brand-new application is sometimes faster, especially when the original denial was due to a correctable error like a missing document or the wrong fee.
