The 540-day automatic EAD extension is still available, but only if you filed your Form I-765 renewal before October 30, 2025. Who Still Gets the 540 Days
The permanent 540-day extension applies to eligible renewal applicants who timely filed Form I-765 on or after May 4, 2022, and before October 30, 2025.2E-Verify. No separate form, fee, or request is needed. If you’re in an eligible category and filed on time, the extension kicks in automatically. Your renewal must be filed under the same eligibility category as the expiring card. The one recognized exception is TPS: an A12 card renewed under C19, or a C19 renewed under A12, still qualifies.4U.S. Citizenship and Immigration Services. If you’re filing in 2026, the automatic extension is generally no longer available. USCIS processing time becomes your only cushion, so file as early as regulations allow and consider whether your circumstances support an expedite request.
Which EAD Categories Qualify

- A03 Refugee
- A05 Asylee
- A07 N-8 or N-9 nonimmigrant
- A08 Citizen of Micronesia, Marshall Islands, or Palau
- A10 Withholding of deportation or removal granted
- A12 Temporary Protected Status granted
- A17 Spouse of principal E nonimmigrant
- A18 Spouse of principal L-1 nonimmigrant
- C08 Asylum application pending
- C09 Adjustment of status application pending
- C10 Cancellation of removal or suspension of deportation applicant
- C16 Adjustment based on continuous residence since January 1, 1972
- C19 Prima facie eligible for TPS
- C20 Section 210 legalization
- C22 Section 245A legalization
- C24 LIFE Act legalization
- C26 Spouse of certain H-1B nonimmigrants
- C31 VAWA self-petitioner
If your code is not on this list, the automatic extension never applied, regardless of when you filed. Check your expired card and your I-797C receipt notice: the category on the receipt must match the card, subject to the A12/C19 swap for TPS.
Extra Rule for H-4, E, and L Spouses
If you hold an EAD under A17, A18, or C26, you need one more document to keep the extension: an unexpired Form I-94 showing valid derivative status. Without it, the extension does not apply even if your renewal was timely filed.5U.S. Citizenship and Immigration Services. The extension also cannot run past your I-94 end date. If the I-94 expires before your 540 days are up, your work authorization ends on the I-94 date.3U.S. Citizenship and Immigration Services. This trips people up when the principal spouse’s status extension is still pending.
What to Show Your Employer
For most categories, two documents together prove your extended work authorization:
- The expired EAD card, showing your category code and expiration date.
- Form I-797C (Notice of Action), the receipt for your timely filed renewal, with a category matching the expired card (or the A12/C19 TPS swap).
For A17, A18, and C26, add the unexpired I-94. When the codes match and the receipt was issued before the card expired, the package functions as a valid work permit for the duration of the extension.3U.S. Citizenship and Immigration Services. Your employer updates the Additional Information field in Section 2 of your Form I-9 with the calculated extension end date and the notation “EAD EXT.” When the extension ends, whether by USCIS decision, day 540, or the I-94 date for spousal categories, the employer must reverify. If the renewal is approved, you present the new EAD; if not, you need another basis for work authorization or you must stop working.3U.S. Citizenship and Immigration Services. Calculating Your End Date
Take the “Card Expires” date on your EAD and add 540 calendar days. That’s the outside limit. For A17, A18, and C26, use the I-94 date if it’s earlier. State DMVs, Benefits Offices, and SSA
An automatically extended EAD can cause confusion at state agencies that see a facially expired card. Those agencies verify status through the Systematic Alien Verification for Entitlements (SAVE) system, and USCIS has directed them not to turn away people with automatic extensions, but instead to run a SAVE query to confirm status.7Federal Register. Bring your expired EAD, your I-797C, and a printout from the USCIS calculator showing your extension end date. Social Security follows its own procedure for extended EADs, entering the calculated extension date rather than the printed card expiration.8Social Security Administration. E-Verify accounts for the 540-day extension once the updated I-9 information is entered.2E-Verify. Final Rule Permanently Increases Automatic Extension of Employment Authorization If the system lags, the paper documents control, and your employer should not suspend you based on the E-Verify mismatch alone.
When the Extension Ends Before Day 540
The 540-day period is a ceiling, not a promise. Three events end it early:
- USCIS approves the renewal. The new card replaces the extension with no gap.
- USCIS denies the renewal. Work authorization ends the day the denial is issued. You must stop working immediately unless you have another basis to work.
- The I-94 expires, for A17, A18, and C26 only. The extension cannot outlast the underlying nonimmigrant status.
Because a denial cuts off authorization on the spot, respond promptly and completely to any USCIS request for evidence during the extension. A missed response leads to denial.
If You’re Filing in 2026 or Running Out of Time
For renewals filed on or after October 30, 2025, there’s no automatic bridge. File as early as you’re allowed and, if the wait is going to cost you your job, consider an expedite request. The most relevant ground for EAD renewals is “severe financial loss to a company or person.” USCIS has acknowledged that job loss can qualify depending on circumstances, but simply needing work authorization is not enough on its own. TPS: The Carve-Out That Survived
Temporary Protected Status beneficiaries have two ways their EAD can be extended: the general automatic extension based on a timely filed renewal, and a country-specific extension announced by DHS through a Federal Register notice when TPS is redesignated or extended.10U.S. Citizenship and Immigration Services. 5.3 Automatic EAD Extensions for Temporary Protected Status (TPS) Beneficiaries
The second track is among the limited exceptions preserved after October 30, 2025.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization If you’re a TPS holder, check whether a Federal Register notice separately extends your work authorization for your country, in addition to whether you qualified for the general 540-day rule based on filing before the cutoff. A12 and C19 remain interchangeable for extension purposes, so a code mismatch between those two alone does not disqualify you.
