The EAD 540-day extension is an automatic continuation of work authorization for people who filed a Form I-765 renewal on time in an eligible category. It kept the expired card valid for up to 540 days past the printed expiration, or until USCIS decided the renewal. As of October 30, 2025, DHS ended this automatic extension for any renewal filed on or after that date.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Renewals filed before that date keep the extension they already had.2Federal Register. Removal of the Automatic Extension of Employment Authorization Documents
Does the Extension Still Apply to You
The date you filed your I-765 is what matters. If USCIS received your renewal before October 30, 2025, and you otherwise qualified, your 540-day extension remains in force. The interim final rule that ended the practice explicitly preserved existing extensions.2Federal Register. Removal of the Automatic Extension of Employment Authorization Documents
If USCIS received your renewal on or after October 30, 2025, no automatic extension applies. The only carve-out is for extensions provided by law or through a Federal Register notice for Temporary Protected Status employment documentation, which operate under their own rules.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization
Who Qualified for the Extension
Three conditions had to be met under 8 CFR 274a.13(d)(1). The renewal had to be properly filed on the correct form before the “Card Expires” date on the EAD. It had to be based on the same eligibility category as the expiring card. And the category had to be one where employment authorization continues even after the card expires, without USCIS needing to decide a separate underlying application first.3eCFR. 8 CFR 274a.13 – Application for Employment Authorization
TPS beneficiaries get two accommodations. The category codes on the EAD and the receipt notice can differ if one shows A12 (TPS approved) and the other shows C19 (TPS pending); those are treated as matching for extension purposes.4E-Verify. Final Rule Permanently Increases Automatic Extension of Employment Authorization and/or EADs for Certain Individuals TPS applicants could also file during the re-registration period set in the applicable Federal Register notice, even if the EAD had already expired.3eCFR. 8 CFR 274a.13 – Application for Employment Authorization
Which Category Codes Qualify
Only specific eligibility codes trigger the 540-day extension. Look at the category printed on your EAD to see if you’re on the list.5U.S. Citizenship and Immigration Services. Employment Authorization
Humanitarian and protection-based categories:
- (a)(3) Refugees
- (a)(5) Asylees
- (a)(10) Withholding of deportation or removal
- (a)(12) TPS beneficiaries (approved)
- (c)(8) Pending asylum applicants
- (c)(19) Pending TPS applicants found prima facie eligible
- (c)(31) VAWA self-petitioners with an approved Form I-360
Employment and status-based categories:
- (a)(17) Spouse of an E nonimmigrant
- (a)(18) Spouse of an L nonimmigrant
- (c)(9) Pending adjustment of status under Section 245
- (c)(26) Spouse of an H-1B nonimmigrant
Legalization and registry categories:
- (c)(16) Creation of record (continuous residence since January 1, 1972)
- (c)(20) Section 210 legalization (pending I-700)
- (c)(22) Section 245A legalization (pending I-687)
- (c)(24) LIFE Act legalization
If your code is not on this list, the 540-day extension never applied to your renewal.
How the 540 Days Are Counted
The clock starts the day after the “Card Expires” date printed on the front of your EAD. It runs for up to 540 days, or until USCIS decides your renewal, whichever comes first.6U.S. Citizenship and Immigration Services. 5.1 Automatic Extensions Based on a Timely Filed Application to Renew So a card that expired June 1, 2025 carries an extension through roughly November 23, 2026, unless USCIS acts sooner.
Two events cut the extension short. A denial ends it immediately, with no grace period. Withdrawing the application ends it the same way. Approval also ends the extension, but in that case a new card follows.
Documents That Prove the Extension
There is no new card. You prove your work authorization with two documents together: the expired EAD itself, and Form I-797C, Notice of Action, the receipt USCIS mailed when it received your I-765.7U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Neither one works alone. The card shows your category and original expiration; the I-797C shows the renewal is pending and when it was received.
Check the receipt notice as soon as it arrives. The “Class Requested” on the I-797C should match the category on your expired card, with the A12/C19 TPS pairing being the one accepted mismatch. Confirm that your name, date of birth, and category are correct. Errors need to be fixed with USCIS before employers can rely on the documents.
What Your Employer Does on the I-9
Employers recognize the extension by updating Form I-9, and the steps depend on whether you are a new hire or already on staff.6U.S. Citizenship and Immigration Services. 5.1 Automatic Extensions Based on a Timely Filed Application to Renew
New Hires
For a new employee showing an expired EAD with a valid I-797C receipted before October 30, 2025, the employer completes Section 2 by entering “EAD” as the document title, the card number, and the date 540 days from the card’s expiration as the expiration date. “EAD EXT” goes in Additional Information. In Section 1, the employee picks “An alien authorized to work until” and enters the same 540-day date; refugees and asylees enter “N/A” because their underlying status does not expire.
Current Employees
For an existing employee, the employer updates the current I-9 with the 540-day extended expiration date and writes “EAD EXT” in Section 2 Additional Information. A new I-9 is not needed, but the employee has to present the I-797C. When the extension ends, either because USCIS decided the renewal or because 540 days ran out, the employer must reverify work authorization.
If You Filed on or After October 30, 2025
The 540-day extension does not apply. Under the new 8 CFR 274a.13(e), a renewal filed on or after that date does not automatically extend the expiring EAD or the underlying work authorization.2Federal Register. Removal of the Automatic Extension of Employment Authorization Documents Extensions set by statute or by a Federal Register notice for TPS employment documentation are the only carve-outs.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization
USCIS now recommends filing the renewal up to 180 days before your card expires to reduce the chance of a gap in work authorization.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization Without an automatic bridge, filing early is the main thing you control.
Filing Fee for the Renewal
Form I-765 renewals carry a $275 fee under H.R. 1, charged in addition to existing fees under the USCIS fee rule rather than replacing them.8U.S. Citizenship and Immigration Services. USCIS Updates Fees Based on H.R. 1 Because the components stack, run your case through the USCIS Fee Calculator on the I-765 page before you file. Some categories, especially asylum-based filings, have historically been fee-exempt, but exemptions and waivers can change, so confirm before submitting.
