E-2 visa processing time runs from a few weeks to several months. If you file a change of status inside the United States on Form I-129, standard USCIS adjudication typically takes several months, and premium processing can compress that to 15 business days for an extra fee. If you apply at a U.S. consulate abroad, the clock is driven by interview availability at your post and any post-interview administrative review, not by a published USCIS estimate.

If you’re already in the U.S. on another visa, you switch to E-2 by filing Form I-129 with the E-1/E-2 Classification Supplement.1U.S. Citizenship and Immigration Services. I-129, Petition for a Nonimmigrant Worker The base filing fee is $780. Most petitioners also owe an Asylum Program Fee of $600 on top of that; small employers with 25 or fewer full-time employees pay $300, and nonprofits are exempt.2U.S. Citizenship and Immigration Services. Once USCIS receives your petition, you get a Form I-797C receipt notice with a case number you can track through the online case status portal.3U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Standard processing times fluctuate with the workload at the service center handling your case. USCIS publishes current estimates on its online processing times tool, and checking that tool before you file gives you a realistic window for your specific center. If something is missing from your file, you’ll receive a Request for Evidence, which pauses the clock until you respond.
Premium Processing for I-129
Premium processing guarantees that USCIS will take action on your E-2 petition within 15 business days.4U.S. Citizenship and Immigration Services. How Do I Request Premium Processing “Action” here means an approval, a denial, a notice of intent to deny, or a Request for Evidence. If USCIS misses the window, the premium fee is refunded. Note that a Request for Evidence counts as action: if you get one, the 15-day guarantee restarts once you respond, not from the original filing.
You request premium processing by filing Form I-907 alongside your I-129. As of March 1, 2026, the premium fee for E-2 petitions is $2,965, up from $2,805.5U.S. Citizenship and Immigration Services. Consular Processing Timeline
If you’re applying from outside the U.S., there are three phases that determine how long your case takes: preparation, the interview wait, and post-interview processing.
Preparing the Application
Consular E-2 applications start with Form DS-160, the online nonimmigrant visa application, plus Form DS-156E, a supplemental form covering the business’s financial health, staffing, and your role.6U.S. Department of State. Nonimmigrant Treaty Trader/Investor Visa Application Instructions Most embassies expect a structured binder of supporting documents with labeled tabs for the cover letter, treaty nationality, investment evidence, and business financials. Formatting rules vary post to post, and some consulates set page limits or specific tab requirements. Check your embassy’s website before you assemble anything, because rebuilding the package later costs time you can’t get back.
The Interview Wait
After you submit the DS-160, you register on your embassy’s scheduling portal and pay the $315 Machine Readable Visa fee.7U.S. Department of State. Fees for Visa Services Interview wait times vary enormously by location. Some consulates offer appointments within weeks; others have backlogs stretching months. The State Department publishes current estimates on its Global Visa Wait Times page.8U.S. Department of State. Visa Appointment Wait Times Check the post you actually plan to use before you set expectations, because averages hide big swings between cities in the same country.
After the Interview
If the officer approves your case, the consulate keeps your passport to print the visa. Return by secured courier typically takes a few business days, though the exact timeframe depends on the post. Depending on your nationality, you may also owe a reciprocity issuance fee, separate from the MRV fee. The State Department’s reciprocity schedule shows the amount, if any, for your country.9U.S. Department of State. Visa Reciprocity and Civil Documents by Country
Administrative Processing: The Hardest Delay to Predict
Sometimes the officer can’t make a decision at the interview. When that happens, your case goes into administrative processing under Section 221(g) of the Immigration and Nationality Act. Common triggers include missing documentation, the officer needing more time to research your business, or referral for additional review. There is no fixed timeline. It can resolve in days, drag on for months, or in rare cases take longer. You won’t have much visibility into what’s happening while it’s pending, which is what makes it the most frustrating point in the consular path.
Visa Validity Versus Time in the U.S.
The length printed on your E-2 visa stamp isn’t the same for everyone. Under the principle of reciprocity, the U.S. grants the same duration your home country grants American citizens for a similar visa.9U.S. Department of State. Visa Reciprocity and Civil Documents by Country For most treaty countries, that’s a five-year visa with multiple entries. For a handful of countries, it’s as short as three months.
Visa validity isn’t the same as your authorized period of stay. Each time you enter the United States, you’re typically admitted for two years, regardless of when the stamp expires.10U.S. Citizenship and Immigration Services. E-2 Treaty Investors If your visa stamp expires while you’re inside the country during a valid two-year admission, you can stay for the full two years. You’ll just need a new visa before your next trip abroad.
Extensions
E-2 status can be extended in two-year increments, and there’s no cap on the number of extensions you can receive, as long as you continue to meet the requirements and maintain the intent to eventually depart.10U.S. Citizenship and Immigration Services. E-2 Treaty Investors Extensions are filed on Form I-129 through USCIS and follow the same timeline and fees as the initial petition. Premium processing is available for extensions. If you leave the country and re-enter while your E-2 visa is still valid, CBP generally readmits you for a fresh two-year period automatically, with no I-129 needed.
