Drones at Night: FAA Rules, Lighting, and Training

Flying a drone at night is legal in the United States without a waiver, as long as your aircraft carries anti-collision lighting visible for at least three statute miles and your pilot training is current for night operations. The FAA replaced the old night-waiver process in April 2021 with a straightforward set of conditions under 14 CFR Part 107, and the same rules cover civil twilight, the 30-minute window on either side of sunrise and sunset when the sky is dim but not fully dark.1eCFR. 14 CFR 107.29 – Operation at Night

Anti-Collision Lighting

Between sunset and sunrise, your drone must have anti-collision lights visible from at least three statute miles. The regulation requires a flash rate “sufficient to avoid a collision” but does not specify a number of flashes per minute.1eCFR. 14 CFR 107.29 – Operation at Night The standard is functional: the light must flash conspicuously enough that a manned aircraft pilot would notice it.

The same lighting requirement applies during civil twilight. Outside Alaska, that means the 30 minutes before official sunrise and the 30 minutes after official sunset. Alaska uses the civil twilight times published in the Air Almanac, since the flat 30-minute rule doesn’t work at extreme latitudes.1eCFR. 14 CFR 107.29 – Operation at Night

A few details are easy to miss. The rule doesn’t dictate 360-degree coverage or a specific mounting position; it just demands three statute miles of visibility. You may reduce the light intensity in flight if safety calls for it, for example when the strobe interferes with a sensor payload, but you cannot turn the light off.1eCFR. 14 CFR 107.29 – Operation at Night Standard red and green navigation lights don’t count. Those indicate heading; you need a dedicated flashing strobe rated for the three-mile distance. Check the spec sheet before buying, because plenty of inexpensive LED lights sold for drones fall well short.

Training You Need to Fly at Night

Part 107 Pilots

Anyone flying for a commercial purpose needs a Remote Pilot Certificate under Part 107.2Federal Aviation Administration. Become a Certificated Remote Pilot To fly at night, you must have completed either your initial knowledge test or your recurrent training after April 6, 2021.1eCFR. 14 CFR 107.29 – Operation at Night If you certified before that date and haven’t done updated training since, night operations are off the table until you do.

Recurrent training is required every 24 calendar months to keep the certificate current, and the current curriculum covers night operations as a required knowledge area.3eCFR. 14 CFR 107.65 – Aeronautical Knowledge Recency The training is free through the FAA Safety Team website.

Recreational Flyers

Hobbyists flying under the recreational exception must pass The Recreational UAS Safety Test (TRUST) before flying in any conditions, night included.4Federal Aviation Administration. The Recreational UAS Safety Test (TRUST) TRUST is a free online test administered through FAA-approved providers. Carry proof of completion, digital or paper, whenever you fly. The three-mile anti-collision lighting rule applies to recreational flyers too.

Keeping the Drone in Sight After Dark

This is where most night flights actually run into trouble. Under 14 CFR 107.31, you must keep the aircraft in sight throughout the flight using unaided vision. Corrective lenses are fine. Binoculars and monitors are not. You have to be able to tell the drone’s location, altitude, direction of flight, and whether it’s heading toward anything.5eCFR. 14 CFR 107.31 – Visual Line of Sight Aircraft Operation The obligation doesn’t relax after sundown.

In practice, the strobe becomes your only real reference. Once the drone is far enough away that you can see the light but can’t judge which direction it’s facing or how high it is, you’ve probably crossed the line. Night flights almost always have a smaller effective radius than day flights.

A visual observer can satisfy the line-of-sight requirement in your place, as long as they maintain effective communication with you and can see the drone unaided.6eCFR. 14 CFR 107.33 – Visual Observer An observer isn’t required at night, but it’s a sensible addition when scanning a dark sky is the main job.

Weather and Visibility Minimums

Part 107 requires at least three statute miles of flight visibility from your control station. At night, judge it by whether you can see and identify prominent lighted objects at that distance. You also need 500 feet of vertical clearance below clouds and 2,000 feet of horizontal distance from them.7eCFR. 14 CFR 107.51 – Operating Limitations for Small Unmanned Aircraft

Fog, haze, and low clouds show up more often at night than new pilots expect, and they can drop visibility below minimums quickly. If you can’t see lit objects three miles out from the launch point, the flight doesn’t happen. A narrow spread between temperature and dew point is a signal fog is likely to form, so it’s worth checking that before heading out.

Remote ID Applies at Night Too

Since September 2023, nearly all drone flights in U.S. airspace require Remote ID. The drone must broadcast its serial number or session ID, its latitude, longitude, altitude, velocity, and a time stamp throughout the flight.8eCFR. 14 CFR Part 89 – Remote Identification of Unmanned Aircraft The rule doesn’t distinguish day from night.

Three ways to comply: fly a drone with built-in Standard Remote ID, add an aftermarket broadcast module, or fly at an FAA-recognized identification area where Remote ID isn’t required. If you add a module, register its serial number through the FAA’s DroneZone portal. Registration lasts three years, and the registration number has to be visible on the outside of the aircraft.8eCFR. 14 CFR Part 89 – Remote Identification of Unmanned Aircraft

Airspace and Local Rules

Flying at night doesn’t change airspace rules. Class B, C, D, and lateral E airspace near airports still require authorization. The fastest route is the Low Altitude Authorization and Notification Capability (LAANC) system, which processes requests in near-real time.9Federal Aviation Administration. UAS Data Exchange (LAANC) Prohibited and restricted areas remain off-limits without specific government permission. Check for active Temporary Flight Restrictions before every night mission; TFRs for VIP travel, wildfire operations, or emergencies often go up on short notice.

Local governments layer their own rules on top of the federal ones. Some cities prohibit drone launches in public parks after dark, and residential noise ordinances can apply even to small aircraft. A violation of local law brings fines or equipment seizure regardless of federal compliance. Confirm your city or county code before assuming a daytime-legal spot stays legal after sunset.

How Your Eyes Behave in the Dark

Physiology works against night pilots. The center of the retina, packed with cone cells, is essentially a blind spot in low light. Staring directly at your drone’s strobe can make it seem to vanish. Off-center scanning, looking slightly to the side of the aircraft, puts the image on the rod cells in your peripheral vision, which handle dim light and movement far better.

Full dark adaptation takes roughly 30 minutes, and a bright phone screen wipes most of it out instantly. If you need to check the controller, dim the screen or use a red filter, since red light disrupts dark-adapted vision less.

Two illusions matter in particular. Autokinesis makes a stationary point of light appear to drift if you stare at it, so shift your gaze rather than locking on. Depth perception also degrades because the texture and color cues your brain uses in daylight are gone. Trust your telemetry for altitude and distance instead of your eyes.

What Violations Cost

Penalties for breaking Part 107 at night are the same as for any Part 107 violation, and they’re steeper than many pilots realize. Under 49 U.S.C. ยง 46301, an individual certificated remote pilot faces civil penalties up to $1,875 per violation. For individuals or small businesses committing more serious violations, the cap rises to $17,062 per violation.10Federal Register. Failing to register the drone is a separate matter, with civil fines up to $27,500 and criminal penalties reaching $250,000 and up to three years in prison.12Federal Aviation Administration.
