The U.S. Department of Transportation regulates the movement of compressed oxygen cylinders under Title 49 of the Code of Federal Regulations, and the DOT regulations for transporting oxygen cylinders reach the cylinder itself, its labels and markings, the shipping paper that rides with it, how it is secured in the vehicle, whether the vehicle needs placards, and who is trained to touch any of it. Oxygen is a Division 2.2 non-flammable gas with a subsidiary 5.1 oxidizer hazard, and that dual classification is what makes the paperwork and labeling heavier than for many other compressed gases.1eCFR. 49 CFR 172.101 – Purpose and Use of the Hazardous Materials Table
Who Has to Follow These Rules
The Hazardous Materials Regulations apply to anyone who offers or transports hazardous materials in commerce.2eCFR. 49 CFR Chapter I Subchapter C – Hazardous Materials Regulations Medical oxygen suppliers, gas distributors, welding shops sending cylinders to job sites, and the drivers behind the wheel all fall inside. Owner-operators are not exempt because they work for themselves. A “hazmat employee” under the federal definition is anyone who loads, unloads, handles, prepares for shipment, or drives a vehicle carrying hazardous materials in commerce.3eCFR. 49 CFR 171.8 – Definitions and Abbreviations
If you are an individual moving your own prescribed medical oxygen in your personal vehicle for non-commercial purposes, the Hazardous Materials Regulations do not apply. Title 49 lists that activity as outside the scope of the rules.4eCFR. 49 CFR 171.1 – Applicability of Hazardous Materials Regulations Basic handling still matters: secure the cylinder so it cannot roll or fall, keep the valve closed and capped, and ventilate the vehicle.
How Oxygen Is Classified
The Hazardous Materials Table gives compressed oxygen a primary classification of Division 2.2 and a subsidiary hazard of Division 5.1.1eCFR. 49 CFR 172.101 – Purpose and Use of the Hazardous Materials Table The proper shipping name is “Oxygen, compressed.” The identification number is UN1072. Those exact terms appear on shipping papers, labels, and markings tied to the shipment.
Cylinder Specifications and Requalification
Only certain pressure vessels are legal for oxygen. The regulations authorize a specific list of DOT specification cylinders for compressed gases, including 3A, 3AA, 3AL, 3B, and 3E, among others. Aluminum 3AL and 4E cylinders carry additional conditions for oxygen service. DOT 3HT cylinders are restricted to aircraft use and nonflammable gases, so they are not a general option for highway transport of oxygen.5eCFR. 49 CFR 173.302a
Every specification cylinder has to be requalified on a schedule. The standard interval is five years, usually by hydrostatic test. Some 3A and 3AA cylinders in exclusive service for non-corrosive gases like oxygen can qualify for a ten-year interval if the cylinder was manufactured after December 31, 1945, is dried immediately after testing, and meets the other conditions in the rule. When it qualifies, it is stamped with a five-pointed star after the test date.6eCFR. 49 CFR 180.209 – Requirements for Requalification of Specification Cylinders
Before any cylinder is filled, the filler must visually inspect it for dents, cracks, arc burns, or evidence of fire exposure. A cylinder past its requalification date cannot legally be filled or offered for transport. Inspectors cite this failure often.
Markings, Labels, and Vehicle Placards
Each cylinder must show the proper shipping name and identification number, plus the shipper’s and receiver’s names and addresses on non-bulk packages. Because oxygen has both a primary 2.2 class and a subsidiary 5.1 oxidizer hazard, two labels are required: the green Non-Flammable Gas label and the yellow Oxidizer label.7eCFR. 49 CFR 172.400 – General Labeling Requirements Missing the oxidizer label is a common oversight.
Compressed oxygen is a Table 2 material for placarding. Placards are not required on a highway vehicle or freight container carrying less than 454 kg (1,001 pounds) aggregate gross weight of Table 2 materials. At or above that threshold, placards go on all four sides. For domestic shipments, the OXYGEN placard may be used instead of the standard NON-FLAMMABLE GAS placard, and the identification number 1072 must appear either on the placard or on a separate orange panel.8eCFR. 49 CFR 172.504 – General Placarding Requirements
Shipping Papers
A shipping paper must accompany every commercial shipment of oxygen. The description follows a fixed sequence: identification number (UN1072), proper shipping name (Oxygen, compressed), and hazard class (2.2). The subsidiary class (5.1) goes in parentheses immediately after the primary class.9eCFR. 49 CFR 172.202 – Description of Hazardous Material on Shipping Papers Compressed gases generally carry no packing group, so that field stays blank. Total quantity by weight or volume is required.10eCFR. 49 CFR Part 172 Subpart C – Shipping Papers
The shipper prints a certification on the paper confirming the material is properly classified, packaged, marked, and labeled. The paper must also carry an emergency response telephone number that is monitored at all times while the material is in transit. An answering machine or callback service does not satisfy this. The person who answers must know the hazards or have immediate access to someone who does.11eCFR. 49 CFR 172.604 – Emergency Response Telephone Number
While the driver is at the wheel, the shipping paper stays within arm’s reach and either visible to someone entering the cab or stored in a holder mounted on the driver’s door. When the driver leaves the cab, the paper goes in the door holder or on the driver’s seat.12eCFR. 49 CFR 177.817 – Shipping Papers First responders need to find it fast.
Securing and Segregating the Cylinders
Every hazmat package on a motor vehicle must be secured against shifting under normal transportation conditions, and cylinders with valves or fittings must be loaded to minimize the chance of damage.13eCFR. 49 CFR 177.834 – General Requirements Racks, straps, chains, or pallets keep cylinders from rolling, tipping, or sliding. A loose cylinder that rolls during a hard stop can shear its own valve and turn into a projectile.
Cylinder valves must be closed during transport. For DOT specification cylinders, the valve assembly must be protected from damage, typically by a securely attached metal cap. Cylinders manufactured on or after October 1, 2007, must have valve protection strong enough to prevent leakage if the cylinder is dropped six feet onto a hard surface. Small oxygen cylinders with a water capacity of 4.8 liters or less, and Medical E cylinders with a water capacity of 4.9 liters or less, are exempt from the valve protection requirement.14eCFR. 49 CFR 173.301 – General Requirements for Shipment of Compressed Gases
Because oxygen is an oxidizer, it must be segregated from incompatible materials. The segregation chart in 49 CFR 177.848 controls which hazard classes can share a vehicle.15eCFR. 49 CFR 177.848 – Segregation of Hazardous Materials Keep oxygen away from flammable liquids, flammable gases, and corrosives. A small oxygen leak near flammable vapor is enough to start a violent fire.
Training for Everyone Who Handles Oxygen
Every hazmat employee must complete training before independently performing regulated functions. New hires can work under direct supervision of a trained employee while completing training, but security awareness training specifically must be finished within 90 days of hire. Recurrent training is due at least once every three years.16eCFR. 49 CFR 172.704 – Training Requirements
Training covers four areas:
- General awareness of hazardous materials and hazard communication.
- Function-specific rules that apply to the employee’s actual job, whether filling cylinders, loading trucks, preparing shipping papers, or driving.
- Safety, including emergency response, personal protective measures, and accident avoidance.
- Security awareness, and, for companies required to keep a security plan under Subpart I, in-depth training on that plan.
Employers keep records of every completed training: employee name, completion date, materials used, and the trainer’s name and address.
Empty Cylinders Usually Still Count
An “empty” oxygen cylinder almost always holds residual gas and pressure. The default rule is that an empty package containing only residue is transported the same way it was when full: full shipping papers, labels, placards, and securement.17eCFR. 49 CFR 173.29 – Empty Packagings
One exit exists. If all hazardous material markings, labels, and placards are removed or covered, and internal gauge pressure is below 29 psig at 68°F, the cylinder falls out of the remaining hazmat rules. Most returned oxygen cylinders will not meet that low-pressure threshold, so treat empties like full cylinders for compliance purposes.
The Materials of Trade Exception
A commercial user who carries oxygen as a tool of the trade rather than as freight may qualify for a streamlined set of rules. Under the materials of trade exception, a Division 2.2 gas in a cylinder with a gross weight of 100 kg (220 pounds) or less is exempt from most hazmat shipping, marking, and placarding requirements when transported by motor vehicle. The total weight of all materials of trade on one vehicle cannot exceed 200 kg (440 pounds).18eCFR. 49 CFR 173.6 – Materials of Trade Exceptions
A welder driving to a job site with one oxygen cylinder and one acetylene cylinder is the classic case. The exception does not apply to hazardous waste or materials that are poisonous by inhalation. The cylinder still has to be a DOT-specification container in good condition with the valve closed and protected. What you get relief from is full shipping papers, placards, and some marking requirements. Basic safe-handling obligations stay.
When You Must Report an Incident
An immediate phone call to the National Response Center is required whenever a hazardous material incident directly results in a death, an injury requiring hospital admission, a public evacuation lasting an hour or more, or closure of a major road or transportation facility for an hour or more.19eCFR. 49 CFR 171.15 – Immediate Notice of Certain Hazardous Materials Incidents A written follow-up is due within 30 days. Situations that do not hit those triggers should still be reported when conditions are dangerous enough in the driver’s judgment.
What Violations Cost
The Pipeline and Hazardous Materials Safety Administration can impose civil penalties of up to $102,348 per violation for knowingly breaking the hazmat transportation rules. If the violation results in a death, serious injury, or major property destruction, the ceiling rises to $238,809. Each day a continuing violation persists counts as a separate offense. Training violations carry a minimum penalty of $617.20eCFR. 49 CFR 107.329 – Maximum Penalties
When PHMSA calculates a fine, it looks at the severity of the violation, the violator’s history, ability to pay, and effect on the business’s ability to keep operating. Missing placards, expired cylinder test dates, incomplete shipping papers, and untrained drivers are among the most commonly cited failures. They fill enforcement dockets because they are also the easiest to catch during a roadside inspection.
