DOT gas can regulations govern how flammable liquids like gasoline are packaged and moved in commerce, but they are only one piece of the picture. The Department of Transportation’s Hazardous Materials Regulations under Title 49 of the Code of Federal Regulations apply mainly to commercial shippers, carriers, and packaging manufacturers. If you’re carrying a five-gallon can in your truck for work, a much narrower exemption probably covers you. And the red plastic can on your garage shelf is regulated by the Consumer Product Safety Commission and the EPA, not DOT.
Which Rules Apply to Your Gas Can
The phrase “DOT-approved gas can” gets used loosely at hardware stores and online, but four different agencies actually have a hand in these containers:
- DOT (through PHMSA) regulates the transport of hazardous materials in commerce under 49 CFR.1eCFR. 49 CFR Part 171 – General Information, Regulations, and Definitions
- The Consumer Product Safety Commission regulates the consumer gas cans sold to the public, including child-resistant spouts and flame mitigation devices.2Consumer Product Safety Commission. Portable Fuel Container Safety Act of 2020
- OSHA sets separate rules for safety cans used at workplaces and job sites.
- The EPA controls evaporative emissions from portable fuel containers.
Which of these matters most depends on what you’re doing with the can. Commercial fuel shipments trigger DOT. A can at a construction site triggers OSHA. Buying one off the shelf triggers CPSC and EPA design rules.
When DOT’s Transport Rules Actually Kick In
DOT’s hazmat regulations draw a hard line at container size. A non-bulk package holds up to 119 gallons of liquid; anything larger is bulk packaging and pulls in stricter packaging specs, vehicle placarding, and driver requirements.3eCFR. 49 CFR Part 171 – General Information, Regulations, and Definitions – Section: 171.8 Definitions and Abbreviations
For commercial drivers hauling gasoline in non-bulk containers, a CDL with a HAZMAT endorsement is not required as long as each individual container stays at or below 119 gallons and the total quantity on the vehicle does not exceed 1,000 gallons. Cross either threshold and full hazmat compliance applies.
Materials of Trade Exemption
Most people transporting a gas can for work never touch those thresholds. Under 49 CFR 173.6, a Packing Group II flammable liquid like gasoline is exempt from most hazmat requirements when carried by motor vehicle in quantities of 30 liters (about 8 gallons) or less per package.4eCFR. 49 CFR 173.6 – Materials of Trade Exceptions A landscaper with a five-gallon can in the truck bed, a contractor bringing fuel to a generator, or a farmer refueling equipment in the field all fall under this exemption. The container still has to be closed and in good condition, but shipping papers, placards, and a HAZMAT endorsement are not required.
DOT Packaging Marks and What They Mean
When DOT rules do apply, the performance-oriented packaging standards under 49 CFR Part 178 govern the container. Compliant packaging has to pass drop, leak, and pressure tests keyed to the hazard of its contents, and containers that pass carry a UN marking stamped on the body.5eCFR. 49 CFR Part 178 – Specifications for Packagings
The code reads left to right. The first element identifies container type and material: “1A1” is a non-removable-head steel drum, “1H1” is a non-removable-head plastic drum, “3H1” is a plastic jerrican. What follows shows which packing groups the container is rated for (X covers all three, Y covers II and III, Z covers III only), the specific gravity or gross mass at which it was tested, the test pressure, the year of manufacture, and the country that authorized the marking.6eCFR. 49 CFR Part 178 – Specifications for Packagings – Section: 178.503 You’ll see these markings on commercial drums and jerricans, not the consumer cans at a home center.
Consumer Gas Can Rules (CPSC)
Two federal laws set the design of the gas cans sold to the public.
The Children’s Gasoline Burn Prevention Act, enacted in 2008 and later amended by the Portable Fuel Container Safety Act of 2020, requires portable gasoline, kerosene, and diesel containers with a capacity up to 8.45 gallons to comply with ASTM F2517, which sets child-resistant closure standards.7Consumer Product Safety Commission. The 2020 Act added a second requirement: flame mitigation devices on portable fuel containers of 5 gallons or less. These devices stop flame from propagating back into the container if vapors at the spout ignite. Under 16 CFR Part 1461, containers sold empty must meet ASTM F3326-21, and containers sold pre-filled must meet ASTM F3429/F3429M-24. Workplace Safety Cans (OSHA)
Gas cans used at job sites answer to OSHA. Under 29 CFR 1910.106, a “safety can” is an approved container of not more than 5 gallons, with a spring-closing lid and spout cover, designed to safely relieve internal pressure when exposed to fire.10Occupational Safety and Health Administration. 29 CFR 1910.106 – Flammable Liquids The spring-closing lid and the pressure-relief design are what separate a safety can from an ordinary fuel container.
OSHA recognizes approvals from nationally recognized testing laboratories, naming Underwriters Laboratories (UL) and Factory Mutual (FM) as examples whose certification meets the “approved” requirement.11Occupational Safety and Health Administration. OSHA has also determined that use of DOT-specification polyethylene containers for storing flammable liquids in workplaces is a de minimis violation under certain conditions, which bridges some of the gap between DOT transport rules and OSHA storage rules.12Occupational Safety and Health Administration. Type I vs Type II Safety Cans
Safety cans come in two designs. A Type I can has one opening used for both filling and pouring. A Type II can has two openings: one for filling and a separate spout with a flexible hose for controlled dispensing. Type II cans pour with more precision and less spillage. Both types have to meet the same OSHA requirements for spring-closing lids and pressure relief.
EPA Evaporative Emission Standards
Since January 1, 2009, EPA has required portable fuel containers manufactured for consumer use to limit hydrocarbon emissions to no more than 0.3 grams per gallon per day, counting both permeation through the walls and vapor venting from the spout.13eCFR. 40 CFR Part 59 Subpart F – Control of Evaporative Emissions From New and In-Use Portable Fuel Containers Containers must hold that level throughout a useful life of five years from the date of sale.
EPA’s definition of a portable fuel container is broad: any reusable container designed for consumers to receive, transport, store, and dispense gasoline, diesel, or kerosene. The rule also sweeps in any red, yellow, or blue utility jug regardless of how it’s marketed, closing off relabeling as a workaround.14eCFR. 40 CFR Part 59 Subpart F – Control of Evaporative Emissions From New and In-Use Portable Fuel Containers – Section: 59.680 That is why modern gas cans have sealed spouts and limited venting compared to older designs.
Labeling and Color Coding
A compliant gas can shows the type of fuel it’s designed for, its capacity, flammability warnings, handling instructions, and the manufacturer’s information. Containers subject to DOT hazmat transport rules also need proper hazard labels from 49 CFR Part 172 Subpart E, including the Class 3 flammable liquid diamond.
Color coding follows an industry convention: red for gasoline, yellow for diesel, blue for kerosene, and green for oil or other combustibles. EPA’s emission rule reinforces this by treating any red, yellow, or blue container as a portable fuel container subject to emission limits, regardless of labeling.14eCFR. 40 CFR Part 59 Subpart F – Control of Evaporative Emissions From New and In-Use Portable Fuel Containers – Section: 59.680 Using the wrong color creates a real hazard. Someone pouring from a yellow container expects diesel, not gasoline, and misfueling equipment can cause engine damage or fire.
Filling and Transporting a Gas Can Safely
Buying the right can is only half of it. How you fill and move the can matters just as much.
Set the can on the ground to fill it. Filling on a plastic truck bed liner or inside a vehicle lets static electricity build, and one spark can ignite the vapors. Keep the pump nozzle in contact with the can throughout to dissipate charge, fill slowly, and stop at about 95 percent to leave room for expansion in warm weather.
When you move a filled can, secure it upright so it can’t tip or slide. Carry it in a truck bed or trunk rather than the passenger compartment. Gasoline vapors are heavier than air and will pool at floor level inside a closed vehicle, creating a health hazard and a fire risk. Ventilation around the container is not optional.
Penalties for Violating Federal Hazmat Rules
DOT hazmat violations carry serious financial weight for commercial operations. A knowing violation of the federal hazardous material transportation law can bring civil penalties of up to $102,348 per violation. Where the violation causes death, serious injury, or substantial property destruction, the maximum rises to $238,809. Each day a violation continues counts as a separate offense.15eCFR. 49 CFR 107.329 – Maximum Penalties
These penalties target commercial shippers, carriers, and packaging manufacturers rather than individuals with a single gas can. Construction companies, landscapers, and fleet operations that routinely move fuel can still find themselves within DOT’s reach if their containers, labeling, or transport practices fall short. The materials of trade exemption protects small-quantity transport only when every condition is met, including that the container be closed and in good condition.4eCFR. 49 CFR 173.6 – Materials of Trade Exceptions
