DOT Division 1.4G Consumer Fireworks: Limits, EX/FC Numbers, Shipping

Under U.S. Department of Transportation rules, DOT Division 1.4G consumer fireworks are explosives with a minor blast hazard whose effects stay largely inside the package if the device accidentally ignites, and whose pyrotechnic contents produce light, sound, smoke, or similar effects. That single classification, shown on shipping papers as UN0336, Fireworks, 1.4G, sets the rules for how these products are built, tested, approved, packaged, shipped, and sold.

What 1.4G Means

The “1.4” is the hazard division. Under 49 CFR 173.50, Division 1.4 covers explosives that present a minor explosion hazard: if a device fires accidentally, the blast and any fragments must remain essentially inside the package, and an external fire cannot cause the whole package to detonate almost instantly.1eCFR. 49 CFR 173.50 – Class 1 – Definitions That confined-hazard profile is what separates a box of backyard fountains from a crate of professional display shells.

The “G” is the compatibility group. Under 49 CFR 173.52, group G covers pyrotechnic articles, or articles containing an explosive substance together with an illuminating, incendiary, or smoke-producing substance.2eCFR. 49 CFR 173.52 – Classification Codes and Compatibility Groups of Explosives Nearly every product sold at a roadside stand or retail fireworks store falls into this group.

How 1.4G Differs From 1.3G and 1.4S

Large aerial shells fired at municipal Fourth of July shows are classified as Division 1.3G, which covers materials with a fire hazard or a minor blast or projection hazard. Those are professional display fireworks, not consumer goods, and they require federal explosive licenses, trained pyrotechnicians, and far stricter storage and transport rules. Before DOT adopted the current UN-based numbering, the industry called consumer fireworks “Class C” and display fireworks “Class B.”

You may also see a 1.4S designation on other hazardous materials. The “S” is a special compatibility group where the effects of accidental functioning are limited enough not to hinder firefighting or emergency response near the package. Items in 1.4S are exempt from the EXPLOSIVE 1.4 placard entirely.3eCFR. 49 CFR 172.504 – General Placarding Requirements Consumer fireworks are 1.4G, not 1.4S, and do not qualify for that additional relief.

Composition and Size Limits That Keep a Device in 1.4G

Whether a device qualifies as a 1.4G consumer firework turns on strict chemical composition limits set by APA Standard 87-1A, which is incorporated into federal regulation at 49 CFR 173.64 and 173.65.4eCFR. 49 CFR 173.64 – Exceptions for Division 1.3 and 1.4 Fireworks

Flash Powder Per Report

Ground-level reports (the bang) are capped at 50 milligrams of chemical composition per bang. Aerial reports, produced at roughly 10 feet or higher, are allowed up to 130 milligrams per report.5American Pyrotechnics Association. 2018 APA Standard 87-1A – Standard for the Construction, Classification, Approval, and Transportation of Consumer Fireworks Any device that exceeds these thresholds is no longer a legal consumer firework.

Total Pyrotechnic Composition by Device

Total composition limits under APA 87-1A vary by device category:

  • Cone fountain: up to 50 grams
  • Cylindrical fountain: up to 100 grams
  • Roman candle: up to 20 grams
  • Wheel: up to 200 grams
  • Reloadable aerial shell: up to 60 grams per shell
  • Multi-tube cake: up to 500 grams, but only if the tubes are securely attached to a wood or plastic base and separated by at least half an inch; without that base-and-separation construction, the cap is 200 grams

The 500-gram cake is the largest legal consumer firework. Anything above that crosses into display-firework territory.5American Pyrotechnics Association. 2018 APA Standard 87-1A – Standard for the Construction, Classification, Approval, and Transportation of Consumer Fireworks Consumer aerial shells are also capped at 1.75 inches in outer diameter; shells larger than that require professional licensing and a 1.3G classification.

Approval Numbers: EX and FC

Before any 1.4G consumer firework can be shipped into or within the United States, the specific device design must be individually approved and assigned a tracking number. There are two paths.

EX Numbers From PHMSA

The Pipeline and Hazardous Materials Safety Administration can review a manufacturer’s application directly and assign an EX number. The application must include a diagram, a complete list of chemical compositions and quantities, thermal stability test results, and a signed certification that the device meets APA Standard 87-1A.4eCFR. 49 CFR 173.64 – Exceptions for Division 1.3 and 1.4 Fireworks The thermal stability test holds the device at 167°F (75°C) for 48 consecutive hours. If components inside the finished product could touch each other, they must be in contact during the test.

FC Numbers From Fireworks Certification Agencies

Since 2013, manufacturers have had an alternative: applying to a DOT-approved Fireworks Certification Agency (FCA) rather than to PHMSA directly. FCAs review consumer firework applications for compliance with APA 87-1A and, on approval, assign an FC number.6eCFR. 49 CFR 173.65 – Division 1.4G Consumer Fireworks Both numbers carry the same legal weight. Either one proves the device has been classified and approved for domestic transportation.7Federal Register. Without a valid EX or FC number, a firework cannot legally be transported or sold. The number is usually printed on the product packaging or listed on the commercial invoice. Shipping or selling fireworks without valid approval documentation can lead to seizure of the goods and substantial civil penalties.

Packaging and Marking

Approved 1.4G fireworks must meet physical packaging and labeling standards. The outer shipping container must display the words “Consumer Fireworks” to distinguish the contents from other hazardous materials, and a standardized orange diamond-shaped label showing the 1.4G designation must be affixed to the exterior of each package.8Pipeline and Hazardous Materials Safety Administration. Safety Guidance for Shipping Consumer Fireworks The packaging itself must prevent accidental ignition and withstand normal handling, keeping devices from shifting, leaking, or sustaining damage while stacked in trailers and warehouses.

Shipping Rules That Follow From the Classification

Shipping Papers

Every hazmat shipment, including 1.4G fireworks, must be accompanied by shipping papers describing the contents. Anyone offering hazardous materials for transport must list them on these documents, and drivers must keep the papers within reach during transit.9eCFR. 49 CFR Part 172 Subpart C – Shipping Papers

Placarding Threshold

A vehicle carrying 1,001 pounds or more (gross weight) of Division 1.4G fireworks must display EXPLOSIVE 1.4 placards on all four sides. Below that weight, placards are not required.3eCFR. 49 CFR 172.504 – General Placarding Requirements Division 1.4 sits in Table 2 of the placarding rules, which is why the 1,001-pound threshold applies rather than the zero-threshold placarding required for higher-hazard explosives.

Driver Credentials and Training

Drivers hauling more than 1,001 pounds of 1.4G fireworks must hold a commercial driver’s license with a hazardous materials endorsement.10Pipeline and Hazardous Materials Safety Administration (PHMSA). Limited Quantity Relief

Smaller shipments may qualify for limited quantity treatment. Goods shipped as a limited quantity are exempt from the shipping paper requirement except when moved by air or water, which makes local ground deliveries less administratively demanding.9eCFR. 49 CFR Part 172 Subpart C – Shipping Papers

Penalties for Violations

A knowing violation of federal hazmat transportation law carries a civil penalty of up to $102,348 per offense. If the violation causes death, serious injury, or substantial property destruction, that ceiling rises to $238,809. Training-related violations carry a minimum penalty of $617. Each day a continuing violation persists counts as a separate offense.11eCFR. 49 CFR 107.329 – Maximum Penalties

Importing 1.4G Fireworks

Most consumer fireworks sold in the United States are manufactured overseas. Every imported device must already have a valid EX or FC number before it enters the country, and manufacturers or their U.S. agents must apply in writing to PHMSA or a DOT-approved FCA before transporting Division 1.4G fireworks into the country.6eCFR. 49 CFR 173.65 – Division 1.4G Consumer Fireworks

Importers must keep a paper or electronic copy of the certification record, showing the EX or FC number and the approving agency, while the fireworks are in transit, and must retain those records for five years after importation. Federal, state, and local officials, including Customs and Border Protection, can demand to see the documentation at any point.12Pipeline and Hazardous Materials Safety Administration (PHMSA). Adjacent Rules to Know

DOT classification governs how 1.4G fireworks are shipped, but two other regimes apply to the same products. The Consumer Product Safety Commission sets construction and labeling standards in 16 CFR Part 1507, including a fuse burn window of 3 to 9 seconds, a base-width requirement of at least one-third the device’s height for upright-firing devices, a 60-degree tip-angle test for larger multi-tube mine and shell devices, and a list of prohibited or restricted chemicals such as arsenic compounds, mercury salts, and unalloyed magnesium.13eCFR. 16 CFR Part 1507 – Fireworks Devices14eCFR. 16 CFR 1507.2 – Prohibited Chemicals Every consumer firework has to satisfy the DOT and CPSC frameworks at the same time.

At retail, OSHA guidance based on NFPA 1124 sets separation distances around fireworks sales areas, including a 50-foot no-smoking zone, a 300-foot no-discharge zone, and minimum distances for combustible debris, parked vehicles, and portable generators.15Occupational Safety and Health Administration.
