Whether Walmart taxes food depends entirely on the state and local rules where the store is located, not on any company policy. In most states, basic groceries such as produce, meat, dairy, bread, and pantry staples ring up tax-free, while prepared foods, candy, soft drinks, and non-food items in the grocery aisles are taxed at the standard rate. Walmart is required to collect whatever tax the jurisdiction imposes and send it to the taxing authority, which is why the same cart can generate different tax totals at two stores in different areas.
What Walmart Charges Tax On
Even in states that exempt basic groceries, a few categories of food almost always get taxed. The definitions come from a framework most states have adopted to keep the rules consistent across jurisdictions, and they show up on your Walmart receipt as taxable items no matter how “grocery” they feel.
Prepared Food
Prepared food means anything sold hot, heated by the seller, or sold with eating utensils provided by the seller, including plates, forks, spoons, napkins, and straws.1Streamlined Sales Tax Governing Board. Food Definition Issues A container used only to transport the food does not count as a utensil. A rotisserie chicken from the deli, a hot slice of pizza, and a pre-made salad sold with a plastic fork all fall into this bucket and get taxed at the standard rate in nearly every state.
Candy
Candy is defined as sugar, honey, or other sweeteners combined with chocolate, fruits, nuts, or other flavorings and sold as bars, drops, or pieces. There’s a quirk worth knowing: if the product contains flour, it is not classified as candy and often escapes the tax as a regular food item.2Streamlined Sales Tax Governing Board. Rule 327.6.1 Candy Definition That’s why a Twix bar, which contains flour, may ring up tax-exempt, while a Snickers bar, which doesn’t, gets taxed as candy. The ingredient label is the tiebreaker.
Soft Drinks
Soft drinks are non-alcoholic beverages with natural or artificial sweeteners. The definition excludes beverages containing milk or milk products, soy or rice milk substitutes, or more than fifty percent vegetable or fruit juice by volume.1Streamlined Sales Tax Governing Board. Food Definition Issues A can of Coca-Cola is taxed. A carton of orange juice usually isn’t, provided it’s more than half juice. A bottled smoothie made with milk also falls outside the soft drink definition. Energy drinks like Red Bull and Monster typically get taxed because they carry sweeteners but no milk or significant juice content.
Supplements and Non-Food Items
Vitamins, minerals, protein powders, and herbal supplements sit near the food aisles but are not legally food. Products required to carry a “Supplement Facts” panel rather than a “Nutrition Facts” panel are classified as dietary supplements and don’t qualify for grocery exemptions in most states. A bottle of multivitamins or a tub of whey protein will almost certainly be taxed.
The same applies to household items stocked near groceries. Paper towels, toilet paper, soap, cleaning supplies, and personal care products are taxable at the standard rate even when they ride through checkout with a cart of exempt food. This is one of the most common reasons a Walmart receipt shows a tax charge on what feels like a pure grocery run.
What Walmart Usually Doesn’t Tax
Most states with a sales tax fully exempt basic groceries. Exempt items generally include raw and unprocessed foods intended for home preparation: fresh produce, unprocessed meat, poultry, fish, dairy, eggs, bread, grains, pasta, rice, flour, and cooking ingredients like herbs and spices. Frozen meals, canned goods, cereal, chips, and bottled water usually qualify too, as long as they don’t meet the candy, soft drink, or prepared food definitions.
The test isn’t whether an item is “healthy.” A bag of potato chips is tax-exempt in most states because it’s a food ingredient for home consumption, isn’t heated, comes with no utensils, and doesn’t fit the candy definition. What matters is which legal category the product falls into, not how nutritious it is.
Reading Your Walmart Receipt
Every item on a Walmart receipt has a single letter printed next to the price that tells you how it was taxed:
- N: Non-taxable. No sales tax was charged. Most basic groceries carry this code.
- X or T: Taxable at the standard state and local rate. Prepared food, candy, soft drinks, and non-food items typically fall here.
- F: Food taxed at a reduced grocery rate. Only appears in states that tax groceries at a lower rate than other goods.
- O: Taxed at an alternate rate that varies by state.
- P: Pharmacy or prescription item, usually exempt.
The bottom of the receipt breaks out each tax rate separately, so you can see the total charged under each category. If a specific item surprises you, the letter next to its price tells you which bucket Walmart’s system placed it in.
SNAP and EBT Purchases
Food paid for with SNAP benefits through an EBT card is never taxed, no matter what state you’re in. Federal law conditions a state’s participation in SNAP on not collecting sales tax on purchases made with those benefits.3Office of the Law Revision Counsel. 7 USC 2013 – Establishment of Supplemental Nutrition Assistance Program A state that tried to would lose its ability to participate in the program, so none do.
The exemption covers only the SNAP-funded portion of the transaction. If you split payment between your EBT card and cash or a debit card, the non-SNAP portion is taxed under normal state rules. Items that aren’t SNAP-eligible in the first place, such as household supplies and hot prepared foods, are also taxed as usual when you pay for them separately.
Why the Rate Depends on Where You Shop
Sales tax in the United States is entirely a state and local matter. There is no federal sales tax.4Legal Information Institute. Sales Tax Each state legislature decides which goods are taxable, what the rates are, and which items qualify for exemptions, and Walmart collects whatever applies at each store.
Five states have no general sales tax at all, so food purchased at any Walmart in those states is never taxed. Among the remaining forty-five states, most fully exempt basic groceries from state sales tax. Fewer than a dozen states still impose some level of grocery tax. Some charge a reduced rate on groceries, running from a fraction of a percent up to around four percent, while keeping the standard rate higher for other goods. A few tax groceries at the full state rate, though some offset that by offering a grocery tax credit on residents’ income tax returns. Several states have repealed or reduced their grocery taxes since 2022, and the number still taxing groceries continues to shrink.
Counties and cities in some areas add their own local sales tax on top of the state rate, and these local add-ons may or may not apply to food. Two Walmart stores twenty miles apart can charge different amounts on the same bag of groceries because one sits in a city with an additional local tax and the other doesn’t. Local rates are typically small, often under one percent, but they add up on a large run.
Online Orders, Pickup, and Delivery
When you order groceries through Walmart’s website or app for delivery or shipping, the sales tax is calculated based on where the order is going. For most shoppers using a large retailer like Walmart, the practical result is that you pay the rate for your delivery address.
At checkout, Walmart shows an estimated tax amount. The final tax is calculated when the order is processed and items are confirmed, so the amount on your confirmation email may differ slightly from the estimate you saw in your cart. For pickup orders, the tax matches whatever your local Walmart store would charge at the register. The same rules about exempt groceries, taxable prepared food, candy, and soft drinks apply whether you buy in the store, pick up, or have items delivered.
