Does the UK Tax Your US Social Security Benefits?

If you live in the UK and collect US Social Security, the UK taxes those benefits and the United States does not. Article 17(3) of the US-UK tax treaty gives the UK exclusive taxing rights over Social Security paid by one country to a resident of the other, so the question of whether the UK taxes US Social Security benefits has a straightforward answer: yes, in full, and the US steps aside even when the recipient is a US citizen.

That result surprises most Americans who move to Britain, because it reverses the usual assumption that the US always taxes its citizens’ Social Security. The mechanics matter, though — you still have to report the benefit correctly on both sides and claim the exemption in the right place.

The Treaty Rule That Shifts Taxing Rights to the UK

Article 17 of the US-UK Income Tax Convention covers pensions, Social Security, and similar payments. Paragraph 3 sets the specific rule for Social Security: payments made by one country to a resident of the other are taxable only in the country where the recipient lives.1Legislation.gov.uk. The Double Taxation Relief (Taxes on Income) (The United States of America) Order 2002 – Article 17 A UK resident receiving US Social Security therefore owes UK tax on it, and only UK tax.

This is a deliberate carve-out. Private pension distributions fall under Article 17(1) and reach the same UK-only result for a UK resident through a different route, but the treaty drafters wanted a bright-line rule for governmental benefit programs rather than folding them into the general pension provisions.

Why US Citizens Are Also Exempt from US Tax

Most treaty benefits are neutralized for US citizens by the “saving clause” in Article 1(4), which preserves the US right to tax its own citizens as though the treaty did not exist.2U.S. Department of the Treasury. Convention Between the United States and the United Kingdom for the Avoidance of Double Taxation Article 17(3) is one of the rare exceptions. Article 1(5)(a) carves it out of the saving clause entirely, and the Treasury Department’s Technical Explanation confirms the point in plain language: “a U.S. citizen who is a resident of the United Kingdom will not be subject to U.S. tax on any U.S. social security benefits.”3Department of the Treasury. Technical Explanation of the Convention Between the United States and the United Kingdom

You still report the benefit on your US return. You just claim the treaty exemption to zero out the taxable amount, and the US collects no federal income tax on it.

How Much UK Tax You Actually Pay

HMRC treats US Social Security as foreign pension income. The full payment is taxable — there is no UK equivalent of the US rule that caps the taxable portion at 85%. Your benefit gets added to your other UK income and taxed in the ordinary bands after your Personal Allowance of £12,570.4GOV.UK. Income Tax Rates and Personal Allowances

For 2026-27, the bands are:

  • Basic rate of 20% on taxable income from £12,571 to £50,270
  • Higher rate of 40% on taxable income from £50,271 to £125,140
  • Additional rate of 45% on taxable income above £125,140

Your Social Security stacks on top of any UK state pension, private pension distributions, employment income, and savings interest. If Social Security is your only income and it’s modest, the Personal Allowance may shelter most or all of it. If you also draw a UK state pension and a private pension, the Social Security portion can be taxed at 40%.

Scottish residents use different rate bands. If you live in Scotland, check the Scottish rates rather than the ones above.

One consequence catches people out: because the UK taxes 100% of the benefit while the US would have capped the taxable portion at 85%, someone on a moderate income can end up paying more UK tax than the US would have charged on the same benefit.

Relief for Recent Arrivals: The Four-Year Foreign Income Regime

From April 2025, the UK replaced the old remittance basis with a four-year foreign income regime for “qualifying new residents” — people who were not UK tax resident for the previous ten consecutive years.5GOV.UK. INTM603685 – International Manual If you qualify, foreign income during your first four years of UK residence can be relieved from UK tax.

Whether and how this interacts with the treaty’s exclusive-UK-taxation rule for Social Security is worth raising with a cross-border tax adviser, because claiming the foreign income relief while the treaty removes US taxing rights can produce a period during which neither country collects tax on the benefit.

Split Year Treatment in the Year You Move

If you move to the UK partway through a tax year, split year treatment under the statutory residence test may apply. When it does, you are taxed as a UK resident only for the portion of the year after arrival and as a non-resident before that. Split year treatment applies automatically when you meet the criteria; you cannot pick the split date. Social Security received during the non-resident portion of the year is not subject to UK income tax. Once the resident portion begins, the treaty gives the UK sole taxing rights for the rest of the year.

What You File in Each Country

Living in the UK does not end your US filing obligation if you are a US citizen or green card holder, and receiving foreign income triggers UK filing on top of that. Getting both returns right is what keeps you from paying tax to the wrong country.

The US Return

US citizens abroad get an automatic two-month extension, moving the filing deadline from April 15 to June 15. Attach a statement to the return explaining you qualified for the extension because you lived outside the United States.6Internal Revenue Service. Automatic 2-Month Extension of Time to File Any tax owed is still due by April 15, and interest runs from that date.

Report the Social Security benefit on Form 1040 as usual, then claim the treaty exemption to bring the taxable amount to zero. Form 8833 (Treaty-Based Return Position Disclosure) is the standard form for asserting a treaty position that overrides the Internal Revenue Code. Reference Article 17(3) of the US-UK Income Tax Convention and note that you are a UK resident whose Social Security is taxable exclusively in the UK.

The Foreign Earned Income Exclusion does not help here. The IRS classifies pension and annuity payments, including Social Security, as outside the definition of foreign earned income.7Internal Revenue Service. Foreign Earned Income Exclusion The treaty exemption is what removes US tax, not the FEIE.

The UK Return

UK residents with foreign income generally need to file a Self Assessment return.8GOV.UK. Self Assessment Tax Returns – Who Must Send a Tax Return Report the US Social Security on the foreign income pages, converted to sterling. HMRC does not learn about the income automatically; the reporting obligation is yours.

The UK tax year runs from April 6 to April 5 and does not align with the US calendar year, so you’ll need to apportion your Social Security payments into the correct UK tax year.

Currency Conversion

On the UK side, you can convert each payment at the exchange rate on the date it was received, or use a consistent yearly average. HMRC publishes monthly rates, though they’re designed primarily for customs. On the US side, no conversion is needed for a dollar-denominated benefit, but where conversion is required elsewhere on your return the IRS accepts any consistently applied posted rate, including the yearly averages it publishes.9Internal Revenue Service. Yearly Average Currency Exchange Rates Pick a method and stay with it.

Two Things That Still Affect the Check You Receive

The treaty settles who taxes the benefit. Two other rules affect the amount that lands in your account.

The WEP Repeal

Americans who received both US Social Security and a foreign government pension such as the UK State Pension used to face a reduced benefit under the Windfall Elimination Provision. The Social Security Fairness Act, signed into law on January 5, 2025, repealed the WEP entirely, retroactive to benefits payable from January 2024 onward.10Social Security Administration. Social Security Fairness Act – Windfall Elimination Provision and Government Pension Offset Update If your benefit was previously reduced because of a UK State Pension and your payments have not been adjusted, contact the Social Security Administration.

Medicare Part B Premiums

Medicare Part B premiums are deducted from your Social Security check even when you live outside the United States. The standard 2026 monthly premium is $202.90, with higher-income beneficiaries paying more through income-related adjustments.11Centers for Medicare and Medicaid Services. 2026 Medicare Parts A and B Premiums and Deductibles Medicare generally does not cover care received outside the US, so a UK resident using the NHS is paying for coverage they can’t use. Dropping Part B stops the deductions but can trigger a permanent late enrollment penalty if you return to the US. A penalty-free special enrollment period is available if you or your spouse had employer-based health coverage abroad, but NHS access alone does not qualify.
