Does the IRS Owe You Money? Claim It Before the Three-Year Deadline

The IRS may owe you money if you skipped filing a return in a year when taxes were withheld from your pay, if a refund check came back undeliverable, or if you qualified for a refundable credit and never claimed it. In early 2025, the agency estimated more than 1.1 million taxpayers had unclaimed refunds for a single tax year, with a median amount of about $781.1Internal Revenue Service. How to Check Whether the IRS Is Holding Money for You

Your IRS Online Account

The most complete view is your IRS Online Account at irs.gov. Where’s My Refund

If you already filed and you’re just waiting, use “Where’s My Refund?” at irs.gov. It updates 24 hours after you e-file a current-year return, or three days after e-filing a prior-year return.4Internal Revenue Service. Where’s My Refund? Amended returns have a separate tracker, “Where’s My Amended Return?”, which turns on about three weeks after you submit Form 1040-X.5Internal Revenue Service. Where’s My Amended Return?

Transcripts If You’re Not Sure You Ever Filed

If you can’t remember whether you filed a particular year, order a transcript. Three types matter here, and all are free:6Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them

  • A tax return transcript shows most line items from the return you filed.
  • A wage and income transcript shows W-2s and 1099s that employers and banks reported to the IRS. This is the key document if you never filed and need to rebuild what you earned.
  • A verification of nonfiling letter confirms the IRS has no record of a return for that year.

Pull transcripts instantly through your Online Account, call the automated line at 800-908-9946, or mail Form 4506-T.7Internal Revenue Service. Common Reasons the IRS Is Sitting on Your Money

You Never Filed for a Year You Had Withholding

This is the largest source of unclaimed refunds. If your employer took federal income tax out of your paychecks and you didn’t file that year, the IRS has no way to calculate what you’re owed and mail it. The money stays put until you file the return.

Your Refund Check Was Returned as Undeliverable

When a paper check bounces back, the IRS parks the funds and waits. It does not track you down. If you moved or your address had a typo, the check sits there until you update your information and ask for reissue.

You Qualified for the Earned Income Tax Credit and Didn’t Claim It

The EITC is fully refundable, so you get the money even if you owe no federal income tax. For 2025 returns filed in 2026, the maximum credit is $8,046 with three or more qualifying children, $7,152 with two, $4,328 with one, and $649 with none.9Internal Revenue Service. Earned Income and Earned Income Tax Credit (EITC) Tables Many eligible taxpayers miss it because they don’t know it exists or assume they earn too much.

One boundary worth naming: the Recovery Rebate Credit for missed pandemic stimulus payments is no longer available. The three-year window for the 2020 credit closed April 15, 2024, and the 2021 credit closed April 15, 2025.10Internal Revenue Service. 2021 Recovery Rebate Credit – Topic C

The Three-Year Deadline That Erases Your Refund

Federal law gives you three years from the original filing deadline to claim a refund. After that, the money becomes property of the U.S. Treasury and cannot be recovered.11Office of the Law Revision Counsel. 26 USC 6511 – Limitations on Credit or Refund There are no exceptions for hardship, ignorance, or small amounts.

In practical terms for 2026:

  • Tax year 2022: deadline to claim is April 15, 2026.
  • Tax year 2023: deadline is April 15, 2027.
  • Tax year 2024: deadline is April 15, 2028.
  • Tax year 2021 or earlier: already closed.

One trap catches people every year. The IRS can hold your past-due refund until you also file returns for more recent years. File a 2022 return to claim a refund, but leave 2023 or 2024 unfiled, and the 2022 refund may wait on those later returns. If the later returns show a balance owed, the refund gets applied there first.1Internal Revenue Service. Taxpayers Should Act Now to Claim More Than $1 Billion in Refunds for Tax Year 2021

How to File a Past-Due Return and Claim the Money

Use the Correct Year’s Form

A 2022 return has to be filed on the 2022 Form 1040, not the current year’s form. Using the wrong version gets your return rejected. The IRS keeps prior-year forms on its website going back decades.12Internal Revenue Service. Prior Year Forms and Instructions

Reconstruct Your Income From the Wage Transcript

Pull the wage and income transcript for that year. It shows exactly what employers and financial institutions reported. Transfer those figures onto the correct year’s 1040. If your numbers don’t match what the IRS already has, the return gets flagged for review and everything slows down.

Paper File and Send It Certified

Prior-year returns generally cannot be e-filed. Mail the return to the processing center listed in that year’s 1040 instructions for your state. Use certified mail with return receipt. If the three-year deadline is close, the postmark is your proof.

What to Expect on Timing

E-filed current-year returns process in about 21 days.13Internal Revenue Service. Processing Status for Tax Forms Mailed returns take six weeks or more.4Internal Revenue Service. Where’s My Refund? Amended returns take 8 to 12 weeks and sometimes up to 16.5Internal Revenue Service. Where’s My Amended Return? Direct deposit is fastest, though the IRS caps electronic deposits at three per bank account and sends a paper check beyond that.14Internal Revenue Service. Get Your Refund Faster

What Actually Shows Up in Your Account

Offsets Can Reduce Your Refund

Even when the IRS owes you, the Treasury Offset Program can intercept the refund to cover certain debts:15Internal Revenue Service. Topic No. 203, Reduced Refund

  • Past-due child support
  • Federal agency debts, including defaulted student loans
  • State income tax
  • Certain unemployment compensation debts owed to a state

In fiscal year 2024 the program recovered more than $3.8 billion.16Bureau of the Fiscal Service. Treasury Offset Program If your refund is offset, the Bureau of the Fiscal Service sends a separate notice showing the date, amount, which agency received it, and how to dispute. That notice arrives independently of any IRS letter, so read anything unfamiliar that shows up after you file.

The IRS Pays Interest If It’s Slow

If the IRS doesn’t issue your refund within 45 days of the filing deadline, or within 45 days of the date you actually filed if you filed late, it owes you interest running from the original due date.17Office of the Law Revision Counsel. 26 USC 6611 – Interest on Overpayments The rate is set quarterly and was 7% for the first quarter of 2026 and 6% for the second, compounded daily.18Internal Revenue Service. Quarterly Interest Rates You don’t need to request it. The IRS calculates and adds it automatically. For a past-due return filed late, interest only runs from the date you actually filed.

If Your Check Was Returned, Update Your Address

File Form 8822 to give the IRS your current home address.19Internal Revenue Service. About Form 8822, Change of Address You can also put a new address on your next filed return, but Form 8822 processes the change sooner if filing season is a way off. Requesting direct deposit on the return itself sidesteps the mailing question entirely.

Claiming a Refund for Someone Who Died

A surviving spouse filing a joint return just signs it and notes the date of death. A court-appointed representative filing the original return attaches a copy of the court certificate. Anyone else claiming the refund files Form 1310, checks Line C, and keeps a copy of the death certificate for their records in case the IRS asks.20Internal Revenue Service. Form 1310 – Statement of Person Claiming Refund Due a Deceased Taxpayer A copy of a will is not enough; anyone claiming to be the executor or administrator has to produce a court certificate of appointment.

Watch Out for Refund Recovery Scams

“The IRS owes you money” is a favorite scammer opening line. Common versions include unsolicited emails, texts, or letters claiming an unclaimed refund is waiting and asking for personal information or an upfront fee to release it. Some dishonest preparers also charge a percentage of your refund, which is a red flag.21Internal Revenue Service. Recognize Tax Scams and Fraud

The IRS initiates contact by postal mail, not by email, text, or social media.22Internal Revenue Service. State Unclaimed Property Is a Different Search

A lot of people looking for government money are actually thinking of state unclaimed property, which is a separate system. States hold funds from forgotten bank accounts, insurance policies, utility deposits, and similar sources.23USAGov. How to Find Unclaimed Money From the Government Those funds sit with your state treasurer or comptroller, not with the IRS. If you’ve lived in several states, search each one. The federal refund search and the state property search don’t overlap, and it’s worth running both.
