Does the IRS Freeze Bank Accounts? The 21-Day Window and Your Appeals

Yes. The IRS can freeze your bank account by issuing a levy, a legal seizure of the funds on deposit to cover unpaid taxes. But the agency has to send you written notice at least 30 days before it acts, and once your bank receives the levy, it must hold the frozen money for 21 days before turning it over. That 21-day window is your opening to negotiate a release, arrange a payment plan, or show the levy is causing serious financial hardship.

The Notice That Comes Before a Freeze

The IRS cannot go straight to your bank. Federal law requires the agency to send you a final notice of intent to levy at least 30 days before contacting a third party like a bank.1Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint This notice is usually labeled Letter 1058 or LT11. It shows the balance owed, explains your right to a hearing, and lists alternatives that could stop the levy before it starts.

By the time this notice arrives, you have typically received several earlier balance-due letters. The final notice must be delivered in person, left at your home or business, or sent by certified or registered mail to your last known address.1Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint If you moved and never updated your address with the IRS, the mailing to the old address still satisfies the law.

One narrow exception exists. If the IRS decides collection is “in jeopardy” — for example, if a taxpayer is preparing to leave the country or move assets out of reach — it can skip the 30-day waiting period and levy immediately.1Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint Jeopardy levies are rare.

What Happens When the Bank Gets the Levy

The IRS sends Form 668-A (Notice of Levy) to your bank. As of the moment the bank receives it, the bank must freeze the funds in your account.2Internal Revenue Service. What if I Get a Levy Against One of My Employees, Vendors, Customers or Other Third Parties The freeze is a snapshot of the balance at that instant. Deposits that hit the account afterward are not caught unless the IRS sends a fresh levy later.

Federal law then holds the money in place for 21 days. The bank cannot send anything to the IRS until 21 days have passed since it received the notice.3Office of the Law Revision Counsel. 26 USC 6332 – Surrender of Property Subject to Levy During those 21 days, the funds sit in your account, but you cannot withdraw, spend, or write checks against them. The waiting period exists so you have time to reach the IRS and try to work something out. If nothing changes, on day 22 the bank turns the money over.2Internal Revenue Service. A bank levy is a one-shot event. It captures only what was in the account when the notice arrived, unlike a wage levy, which keeps taking from every paycheck until the debt is paid or released.4Taxpayer Advocate Service. Levies To reach later deposits, the IRS has to issue another levy.

What To Do During the 21-Day Window

Call the IRS at the phone number printed on the levy notice or on Letter 1058/LT11. If a revenue officer is assigned to your case, call that person directly. Explain what you owe, why you cannot cover essential expenses with the account frozen, and what you can offer.

Expect to document your finances. Most individuals fill out Form 433-F (Collection Information Statement), which asks for monthly income, living expenses, bank balances, and asset values.5Internal Revenue Service. Form 433-F, Collection Information Statement More complex cases use Form 433-A. Pull together recent pay stubs, bank statements, rent or mortgage records, utility bills, and medical bills to back up the numbers.

Fax everything to the assigned agent or unit as soon as you can. The 21-day clock does not pause while the IRS reviews your file. If the agency agrees the levy is causing economic hardship, or that releasing it will help collection along, it issues Form 668-D (Release of Levy) to your bank.6Internal Revenue Service. 5.11.2 Serving Levies, Releasing Levies and Returning Property Once the bank processes the release, you get your money back.

Reasons the IRS Must Release a Levy

Federal law requires release when any of these conditions is met:7Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property

  • The tax has been paid or the 10-year collection statute has expired.
  • Releasing the levy will actually help the IRS collect, for example by letting you use the funds to settle the debt another way.
  • You enter an installment agreement whose terms do not specifically preserve the levy.8Internal Revenue Service. How Do I Get a Levy Released
  • The levy is causing economic hardship, meaning you cannot meet basic living expenses like rent, food, utilities, and medical costs.
  • The frozen amount is more than what you owe. In that case the IRS can release the excess.

A release lifts the freeze. It does not erase the debt. If you do not resolve the balance through payment, an installment agreement, or another arrangement, the IRS can issue a new levy later.8Internal Revenue Service. How Do I Get a Levy Released

If the Notice Just Arrived: Request a CDP Hearing

If you still have Letter 1058 or LT11 in hand and the 30 days have not run, file Form 12153 to request a Collection Due Process (CDP) hearing.9Office of the Law Revision Counsel. 26 USC 6330 – Notice and Opportunity for Hearing Before Levy The hearing is run by the IRS Independent Office of Appeals, separate from the collections staff on your case. At the hearing you can:

  • Dispute whether you actually owe the tax, if you have not had a prior chance to contest it.
  • Propose an installment agreement, an offer in compromise, or a currently not collectible status.
  • Raise innocent spouse relief if the debt comes from a joint return.
  • Challenge whether the IRS followed the required procedures.

A timely CDP request generally stops the IRS from levying while the hearing is pending, and preserves your right to petition the U.S. Tax Court if you disagree with the outcome.9Office of the Law Revision Counsel. 26 USC 6330 – Notice and Opportunity for Hearing Before Levy10Taxpayer Advocate Service. Collection Due Process (CDP) Miss the 30-day deadline and you can still ask for an equivalent hearing, but it will not pause collection and you lose the Tax Court option.

If the Levy Already Hit: Collection Appeals Program

Once a levy is issued and the CDP window has closed, the Collection Appeals Program (CAP) is another route. It is faster and less formal than a CDP hearing, and it does not lead to Tax Court review.

First, request a conference with the manager of the IRS employee who took the action. If that does not resolve the disagreement, you have two business days to tell the collection office you plan to appeal, and your Form 9423 (Collection Appeal Request) must be received or postmarked within three business days of the manager conference. The IRS generally pauses collection while a CAP appeal is pending, unless it believes the tax or the ability to collect is at risk.11Internal Revenue Service. Form 9423, Collection Appeal Request The deadlines are measured in business days, so move fast.

Joint Accounts

Sharing an account with a spouse or someone else who does not owe the tax does not protect the balance. The IRS can freeze the entire joint account. The co-owner who does not owe can request a release by showing the frozen money belongs to them, not to the person on the tax bill.12Internal Revenue Service. Information About Bank Levies Call the phone number on Form 668-A and be ready with pay stubs, deposit records, or other paperwork tracing the funds to the non-debtor.

Income the IRS Cannot Touch

Some income and property are off-limits to a levy no matter what you owe. Bank accounts themselves are fair game, but if the account holds any of the following types of funds, they are protected:13Office of the Law Revision Counsel. 26 USC 6334 – Property Exempt From Levy

  • Unemployment benefits.
  • Workers’ compensation.
  • Public assistance payments, service-connected disability benefits, and certain railroad retirement and pension payments.
  • Enough income to satisfy a court-ordered child support judgment that predates the levy.
  • A minimum amount of wages tied to your filing status and dependents, recalculated by the IRS each year.

Necessary clothing and schoolbooks are exempt, along with household goods up to $11,980 in value for 2026 and tools of your trade up to $5,990.14Internal Revenue Service. Revenue Procedure 2025-32 The IRS can reach a primary residence only with written approval from a federal judge or magistrate, a much higher bar than a bank levy.13Office of the Law Revision Counsel. 26 USC 6334 – Property Exempt From Levy If exempt funds ended up in your frozen account, say so when you call, and be ready to document the source.

When Nothing Is Working: Call the Taxpayer Advocate

If the levy is causing hardship and you cannot get anywhere through regular IRS channels, or if the IRS missed a promised response date, the Taxpayer Advocate Service (TAS) can intervene. TAS is an independent organization inside the IRS, and its help is free.4Taxpayer Advocate Service.
