Section 8 does not affect SSI. The Housing Choice Voucher subsidy your local housing authority pays to your landlord is excluded by federal statute from the income the Social Security Administration counts when it sets your Supplemental Security Income payment. The relationship runs the other way instead: your SSI counts as income when the housing authority calculates the rent you owe.
The Statutory Exclusion
Congress wrote the exclusion directly into the SSI income statute. Assistance paid for the dwelling you occupy under the United States Housing Act of 1937, the National Housing Act, and several related housing laws is not counted when determining SSI eligibility or payment amounts.1Office of the Law Revision Counsel. 42 USC 1382a – Income; Earned and Unearned Income Defined The Housing Choice Voucher Program operates under the 1937 Act, so it sits squarely inside that exclusion.
SSA confirms the treatment publicly, listing Section 8 vouchers among the benefits that do not count toward SSI income limits.2Social Security Administration. Exceptions to SSI Income and Resource Limits The agency’s internal manual is more explicit still: field offices are told to assume any housing assistance involving HUD is excluded, and the manual states that “Section 8 housing is HUD housing assistance.”3Social Security Administration. The exclusion is not limited to money that goes straight to your landlord. If your utility allowance exceeds your rent share and the housing authority cuts you a check for the difference, that payment is still HUD assistance. SSA’s own ruling says the exclusion applies “regardless of the form or manner in which such assistance is received on behalf of the unit or received by the individual occupants.”4Social Security Administration. Why Other Housing Help Can Reduce SSI (and Section 8 Does Not)
People confuse Section 8 with other rent help because most third-party help with shelter does reduce SSI. Section 8 is the exception, not the rule.
Private Help With Rent: The Presumed Maximum Value
When a relative, friend, or other private party pays part of your rent or utilities, SSA treats that help as in-kind support and maintenance. The reduction is capped by the Presumed Maximum Value, which equals one-third of the federal benefit rate plus $20.5Social Security Administration. SSI Federal Payment Amounts for 2026 If the actual value of the help is lower, SSA uses the lower number.
Same dollar figure, different outcome. If your sister pays $800 of your rent, SSA can reduce your SSI by up to $351. If a Section 8 voucher covers that same $800, your SSI stays whole because the statutory exclusion applies.
Living in Someone Else’s Household
A different rule applies when you live in someone else’s household and that household provides all your food and shelter without you paying your share. Your SSI drops by one-third of the federal benefit rate, about $331 per month in 2026.7Social Security Administration. It also does not apply if you contribute your fair share of household expenses.
Your SSI Does Count Toward Your Section 8 Rent
The interaction runs one direction only. Section 8 does not touch your SSI, but the housing authority does count your SSI when it figures how much rent you owe. Under HUD rules, your share of rent and utilities is generally the highest of 30 percent of monthly adjusted income, 10 percent of gross monthly income, or a minimum rent set locally.8U.S. Department of Housing and Urban Development. Because of this, an SSI cost-of-living increase can raise your Section 8 rent share at your next annual recertification, even though the voucher itself never changed your SSI.
Reporting Changes to Both Agencies
Keep both offices informed. Report any change in living arrangements to SSA no later than 10 days after the end of the month the change occurred.9Social Security Administration. Report income changes to your housing authority as well, because they drive your rent share. Missing a recertification or skipping an income update can put your voucher at risk.
If SSA later determines you received more SSI than you were entitled to, the excess becomes an overpayment. The agency automatically withholds 10 percent of your monthly payment until it is repaid, and can collect through tax refund offsets or wage garnishment if you no longer receive benefits.11Social Security Administration. If SSA Reduces Your SSI Because of Section 8
SSA sometimes miscodes Section 8 as in-kind support. If that happens, you have 60 days from the date you receive the notice to file a request for reconsideration, either online or by submitting Form SSA-561-U2 to your local office.12Social Security Administration. Timing protects your cash flow. File within 10 days of the notice and your SSI continues at the original amount while the appeal is pending. File after 10 days but within 60, and the reduced payment may take effect temporarily, with SSA restoring the difference once the reconsideration is processed.12Social Security Administration. Point directly to the statutory exclusion when you appeal, and bring your voucher paperwork to show HUD involvement.
