Does an EAD Require Employer Sponsorship? H-4, L-2, and E Spouses

No, an EAD does not require employer sponsorship. An Employment Authorization Document is a work permit issued by U.S. Citizenship and Immigration Services, and most of the categories that make someone eligible for one have nothing to do with an employer or a family member filing a petition. Refugees, asylum applicants, TPS holders, DACA recipients, F-1 students on Optional Practical Training, and several other groups apply for their own EAD based on their own immigration situation. A smaller set of EADs does grow out of a petition that someone else filed, but even in those cases you file the work permit application yourself and the sponsor has no control over where you work.

EAD Categories With No Sponsor Involved

Federal regulations sort EAD-eligible people into three groups. One group is authorized to work as a direct result of their immigration status. Another is authorized to work only for a specific employer. A third has to affirmatively apply to USCIS for permission to work. Most of the situations people ask about fall into the first and third groups, and none of them involve sponsorship in the way people usually mean the word.

  • Refugees and asylees. If you were admitted as a refugee or granted asylum, work authorization comes with the status itself. You file for the physical EAD card, but no employer or relative petitioned for your right to work.
  • Asylum applicants. With a pending Form I-589, you can file for an EAD after your case has been pending for 150 days and become eligible to receive the card once 180 days have passed since filing. Delays you cause don’t count toward that clock.1U.S. Citizenship and Immigration Services. Applicant-Caused Delays in Adjudications of Asylum Applications and Impact on Employment Authorization
  • Temporary Protected Status. TPS holders receive work authorization as part of the protected status. No sponsor is involved.2U.S. Citizenship and Immigration Services. Employment Authorization Document
  • Deferred Enforced Departure. DED is a presidential directive that grants work authorization to nationals of designated countries.
  • DACA recipients. Deferred Action for Childhood Arrivals recipients file Form I-821D alongside Form I-765. No employer or family sponsor is part of the process.3U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization
  • F-1 students on OPT. Students on F-1 visas apply for Optional Practical Training through their school and USCIS. The school provides a recommendation. That is an academic process, not employer sponsorship.

Each of these categories grants the right to work based on your own status. The card is evidence of that right, not the product of anyone’s petition on your behalf.

When an EAD Grows Out of a Sponsored Petition

Some EADs exist only because of an underlying immigration case that did involve a sponsor. The distinction matters: without the sponsored petition you would not qualify, but the EAD is a byproduct of the pending process, and you file the I-765 yourself.

The adjustment-of-status EAD is the clearest example. If you have a pending Form I-485 for a green card, you can apply for an EAD to work while USCIS processes the case.2U.S. Citizenship and Immigration Services. Employment Authorization Document The I-485 may rest on a family member’s petition or an employer’s labor certification, but the EAD is yours. You choose where to work, and the sponsor has no say over that.

H-4 dependent spouses of H-1B workers are in a similar position. You can apply for an EAD if your H-1B spouse has an approved Form I-140 immigrant petition or has been granted H-1B status beyond the standard six-year limit under the American Competitiveness in the Twenty-First Century Act.4U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses Your eligibility depends on your spouse’s employer-sponsored case, but once you have the EAD, you can work for any employer you choose.

L-2 and E Spouses Don’t Need an EAD at All

If you’re the spouse of an L-1, E-1, E-2, or E-3 visa holder, an EAD may not be necessary. Since November 2021, USCIS treats these dependent spouses as authorized to work as part of their immigration status. Your Form I-94, stamped with class codes like L-2S, E-1S, E-2S, or E-3S, is enough on its own to prove work authorization to an employer.5U.S. Citizenship and Immigration Services. You can still request an EAD if you want a physical card that also serves as an identity document, but it is no longer a prerequisite to starting work.

How the Application Itself Works

Whatever your underlying category, you apply on Form I-765, Application for Employment Authorization.3U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization Some categories allow online filing through a USCIS account, and others require paper submission to the service center listed in the form instructions. Nothing on the form calls for an employer’s signature or an employer’s supporting documents in the categories described above.

You’ll usually need to submit a copy of your Form I-94, passport biographical page, or travel document; evidence proving eligibility under your specific category (a pending I-485 receipt, an asylum receipt notice, and so on); and two identical passport-style photos.6U.S. Citizenship and Immigration Services. Filing fees vary by category and filing method. USCIS updates them periodically, so check the current fee schedule before filing, and consider Form I-912 if you may qualify for a fee waiver. Renewals in 2026: Automatic Extensions Are Gone

One change deserves attention no matter which category you fall into. On October 30, 2025, DHS ended the automatic extension of EAD validity for people with pending renewal applications. If you file a renewal on or after that date, your current card expires on the printed date, whether or not USCIS has finished processing the renewal.10U.S. Citizenship and Immigration Services. Automatic Employment Authorization Document (EAD) Extension

If your renewal isn’t approved before your existing EAD expires, you cannot legally work in the gap. File early.

A few exceptions remain. TPS holders who filed renewals on or after July 22, 2025, may still get an automatic extension of up to one year or the length of the TPS designation, whichever is shorter. USCIS may also publish country-specific Federal Register notices extending TPS-related EADs. And if your renewal was filed and received before October 30, 2025, the older 540-day automatic extension may still apply, in which case you’ll present the expired EAD together with your Form I-797C receipt notice showing the eligibility category matches.11U.S. Citizenship and Immigration Services. Why Timing Matters: The Unauthorized Work Bar

Working without a valid EAD is not just a job problem. It can close off the ability to get a green card through adjustment of status. If you worked without authorization at any point after January 1, 1977, you are generally ineligible to adjust status, and leaving the country and returning does not cure that bar.12eCFR. 8 CFR Part 245 – Adjustment of Status to That of Person Admitted for Permanent Residence

Immediate relatives of U.S. citizens (spouses, parents, and unmarried children under 21) are exempt. Employment-based applicants have a narrower cushion: if your unauthorized work and status violations total no more than 180 days in the aggregate since your last lawful admission, you can still adjust.13U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7, Part B, Chapter 8 – Inapplicability of Bars to Adjustment Past 180 days the bar applies in full.

With automatic extensions gone for most categories, days worked past an EAD’s expiration count against you. Filing a renewal as early as USCIS allows is the single most reliable way to keep long-term immigration options open.
