A valid U.S. passport does prove citizenship. Under federal law, a passport book issued to a U.S. citizen for its full authorized period carries the same legal weight as a certificate of naturalization or a certificate of citizenship, so no federal or state agency can insist you produce a birth certificate or naturalization papers on top of it. The equivalence has limits, though, and one class of U.S. passport does not prove citizenship at all.
The Statute That Gives a Passport Its Legal Force
The rule sits in 22 U.S.C. § 2705. Two conditions have to hold. The passport must be within its period of validity, and it must have been issued for the maximum period authorized by law. For adults 16 and older, that maximum is 10 years; for children under 16, it is 5 years.2U.S. Department of State. Passport Fees Passports occasionally get issued with a shorter validity, usually because of unpaid fees or a State Department restriction, and a limited-validity passport does not carry the same statutory equivalence. Most people never encounter this, but it matters if the passport is your only citizenship document in a legal proceeding.

Does the Passport Card Count Too?
Yes, for domestic purposes. The card’s limits are about travel, not citizenship. It cannot be used for international air travel and is only valid for land and sea crossings between the U.S. and Canada, Mexico, Bermuda, and certain Caribbean destinations.5U.S. Department of State. The One U.S. Passport That Does Not Prove Citizenship
Not every U.S. passport belongs to a U.S. citizen. People born in American Samoa or Swains Island are classified as non-citizen nationals. They owe permanent allegiance to the United States, hold U.S. passports, and can live and work anywhere in the country without a visa, but they are not citizens.6U.S. Department of State. A non-citizen national’s passport looks nearly identical to a citizen’s. The difference is a stamped endorsement on the last page reading: “THE BEARER IS A UNITED STATES NATIONAL AND NOT A UNITED STATES CITIZEN.”7U.S. Department of State. American Samoa is the only U.S. territory whose residents are not citizens at birth. A legal challenge, Fitisemanu v. United States, argued that classification was unconstitutional, and the Supreme Court declined to hear the case in 2022, leaving the non-citizen national status in place. When Your Passport Stops Proving Citizenship
The statute’s protection ends when the passport does. Since July 2022, U.S. Customs and Border Protection has stopped allowing citizens to use an expired passport for direct return to the United States, a practice that had been informally tolerated before.8U.S. Customs and Border Protection. Damage can end the passport’s legal force before the expiration date does. If the photo page is obscured by water, the cover is significantly torn, or the electronic chip is no longer readable, officials can reject the document. The security features in modern passports, including holographic images and RFID chips, need to stay intact for the document to work at automated checkpoints.
One narrow exception runs the other way. An expired passport still counts as primary evidence of citizenship when you use it to apply for a renewal, provided it is undamaged and was originally issued for the full validity period.4U.S. Department of State. What This Means in Practice
If someone asks you to prove you are a U.S. citizen and you hand them a current, undamaged passport book or card issued for its full term, that is the end of the matter as a legal question. They cannot demand a birth certificate or naturalization certificate in addition. Federal agencies, state agencies, employers running Form I-9 checks, and financial institutions all sit inside the reach of 22 U.S.C. § 2705.
