Do You Pay Tax on UK Gambling Winnings? Pros, Spread Bets, HMRC

You do not pay any tax on UK gambling winnings. Whether the money comes from the National Lottery, a bet at the racecourse, an online casino, a poker tournament, or a spread bet on the FTSE, HMRC takes nothing from the payout itself. The tax on UK gambling winnings falls on the operators, not the players, and it has worked that way for decades.

Why Gambling Winnings Sit Outside the Tax System

UK income tax attaches to identifiable sources: employment, self-employment, a trade, rental property, savings interest, and so on. A bet doesn’t fit any of those categories, so winnings never enter the income tax framework. National Insurance doesn’t apply either, because it only bites on earnings from work.

Capital gains tax is ruled out separately. Section 143 of the Taxation of Chargeable Gains Act 1992 exempts gains from betting, lotteries, and games with prizes from CGT altogether.1Legislation.gov.uk. Taxation of Chargeable Gains Act 1992 – Section 143 The exemption is the same whether you win £5 on a scratchcard or a seven-figure sum in a poker event.

The government still collects a substantial amount from the industry, but it does so at the operator level through duties on their gross profits. From your side of the counter, the payout arrives whole.

One consequence cuts the other way. Because winnings are not taxable, losses are not deductible. You cannot offset a losing year at the bookmaker against your salary, your investment gains, or anything else. The exemption is a one-way street.

Does It Matter If You Gamble Professionally?

People who make their living from gambling reasonably worry that HMRC will one day decide their play is a trade. It won’t. The point was settled in Graham v Green (1925), where a man’s only income came from betting on horses and the court still held that he was not carrying on a trade. HMRC’s own guidance keeps that position: having a system, studying form, or being successful enough to live off your winnings does not turn gambling into a taxable activity.2HM Revenue & Customs. Business Income Manual – BIM22017

There is one narrow carve-out. If you receive an appearance fee for playing in a televised poker tournament or a similar broadcast, that fee is payment for a service to the production company and is taxable as trade income. The winnings from the same event remain tax-free.2HM Revenue & Customs. Business Income Manual – BIM22017 The distinction matters only if you are actually paid to appear.

Spread Betting

Spread betting lets you speculate on the price of shares, currencies, indices, and commodities without owning the underlying asset. UK law classifies it as gambling, which puts the profits inside the same Section 143 exemption that covers every other bet.1Legislation.gov.uk. Taxation of Chargeable Gains Act 1992 – Section 143

The contrast with conventional dealing is stark. Buy the same shares through a broker and any gain above your annual exempt amount is taxed at 18% at the basic rate or 24% at the higher rate.3GOV.UK. Capital Gains Tax Rates and Allowances Spread betting sidesteps that, and it sidesteps stamp duty on the purchase too. This is the main reason active traders use it. The financial risk is separate: losses on a spread bet can exceed your stake, and the tax exemption does nothing to soften them.

Do You Need to Tell HMRC About a Big Win?

No. Gambling winnings don’t go on a Self-Assessment return. There isn’t a box for them, and HMRC doesn’t want a notification regardless of the amount. A £10 accumulator and a £2 million lottery prize are treated the same way for reporting purposes: nothing to declare.

The practical friction sits with your bank. Large or unusual deposits can trigger anti-money laundering checks, because financial institutions have a legal duty to verify the source of funds that look out of the ordinary. A sudden six-figure credit will attract questions. To satisfy them, you’ll usually need a certificate of winnings from the operator, a screenshot of your betting account showing the payout, or a statement from the gambling platform confirming the withdrawal.

Mortgage lenders can be more cautious still. Some will accept gambling proceeds toward a deposit if the funds have been in your account for several months and you can trace them to a licensed operator. Others decline outright. If you’re buying property with gambling funds, a broker who knows how different lenders treat the issue is worth speaking to before you apply.

Tax on What You Do With the Money

The exemption covers the gambling event, not the rest of your financial life. Once the winnings are in your account, they are ordinary money, and anything you earn from them is taxed like any other return on capital.

Interest on a savings account is taxable income. Basic-rate taxpayers can earn up to £1,000 in savings interest each year under the personal savings allowance before tax applies; higher-rate taxpayers get £500; additional-rate taxpayers get nothing. Interest above those thresholds is taxed at your marginal rate. Park £500,000 of a jackpot in a savings account and the tax bill on the interest builds quickly.

Dividends from shares bought with winnings follow the normal dividend tax rules. Rental income from a property bought with winnings is taxed like any other rental income. The winnings themselves stay tax-free; the yield from putting them to work does not.

Giving Winnings Away

You can give gambling winnings to family or friends during your lifetime with no immediate tax charge. The UK has no gift tax. Inheritance tax is where the issue can appear, because large gifts made in the seven years before death are pulled back into the calculation of the estate.

The nil-rate band is £325,000, frozen at that level until April 2030.4HM Revenue & Customs. Inheritance Tax Thresholds and Interest Rates If gifts made in the seven years before death take the total above that threshold, the recipients may owe inheritance tax. Gifts made less than three years before death are taxed at the full 40% rate. Between three and seven years, taper relief reduces the rate:5GOV.UK. How Inheritance Tax Works: Thresholds, Rules and Allowances

  • 3 to 4 years before death: 32%
  • 4 to 5 years: 24%
  • 5 to 6 years: 16%
  • 6 to 7 years: 8%
  • 7 years or more: 0%

A winner who scoops a large prize and immediately hands out six-figure sums to family should plan around this timeline. Each gift starts its own seven-year clock. Annual exemptions and other reliefs cover smaller gifts, but big distributions without planning can leave recipients with a tax bill nobody expected.

US Citizens and Dual Nationals

The UK exemption does not cancel US tax obligations. American citizens and green card holders are taxed on worldwide income wherever they live. Gambling winnings earned in the UK must be reported on a US federal tax return and are taxed as ordinary income at the applicable federal rate.6IRS. Topic No. 419, Gambling Income and Losses Losses can offset winnings only if you itemise deductions, and only up to the amount of reported winnings.

A second filing catches people out. Any US person with a financial interest in foreign financial accounts must file a Report of Foreign Bank and Financial Accounts with FinCEN if the combined balance passes $10,000 at any point in the calendar year.7FinCEN.gov. Report Foreign Bank and Financial Accounts UK online betting accounts can count toward that threshold. The penalties for missing the filing are steep, and the trap is precisely that the UK side of the equation is so light-touch that the US side is easy to forget.
