Do You Have to File W-2s Electronically: 10-Return Rule and Waivers

If your business files 10 or more returns of any type in a calendar year, filing W-2s electronically is mandatory, and every W-2 you submit that year must go through the Social Security Administration’s Business Services Online portal rather than on paper. The threshold comes from Treasury Decision 9972 and applies to returns due on or after January 1, 2024. Businesses filing fewer than 10 total returns can still use paper, though the IRS encourages electronic submission either way.1Federal Register. How the 10-Return Count Works

The count is aggregate, not by form type. It sweeps in income tax returns, employment tax returns, excise tax returns, and information returns together. A small business that files quarterly Form 941s, an annual income tax return, and a handful of W-2s can cross the line without noticing.1Federal Register. On the information return side, the count picks up the 1098 series, the 1099 series, Forms 3921 and 3922, the 5498 series, Form 8027, and ACA returns like Forms 1094-B, 1095-B, 1094-C, and 1095-C. One note on paper filing if you’re under the threshold. You need the official red-ink Copy A or an approved substitute. Forms printed from the IRS website aren’t scannable, and the SSA will reject them, which can trigger the same penalties as not filing at all.3Internal Revenue Service. Where to File: Business Services Online

W-2s go to the Social Security Administration, not the IRS directly, even though the electronic filing rule itself is an IRS rule. The filing portal is Business Services Online. Access now runs through Login.gov or ID.me credentials; the older BSO-specific username and password system has been retired.4Social Security Administration. Business Services Online (BSO)

Once you’re in, you have two options. You can key W-2 data directly into an online form, which works for a small number of employees. Or you can upload a formatted wage file generated by your payroll software, which is what larger employers typically do. The portal validates the submission before accepting it, and it issues a confirmation you can use as proof of filing. Save or print that receipt right away.

What to Gather Before You File

Getting the data right the first time avoids the mismatch notices and W-2c corrections that eat up hours later. For each employee, you need:

  • Your Employer Identification Number, which links the wage data to your entity.5Internal Revenue Service. Employer Identification Number
  • The employee’s Social Security number. Wrong SSNs are one of the most common triggers for SSA error notices.
  • Gross wages and compensation for Box 1, covering taxable wages, tips, and other compensation.
  • Federal income tax withheld, plus Social Security and Medicare taxes, each in their own boxes.
  • Retirement plan contributions for Box 12 with the correct codes (Code D for 401(k) deferrals, Code E for 403(b), and so on).3Internal Revenue Service. General Instructions for Forms W-2 and W-3 (2026)

Reconcile your W-2 totals against your Form 941 quarterly filings before you submit. Discrepancies between the two are among the surest ways to draw an IRS inquiry.

Deadline

W-2s are due to the SSA by January 31, and the same date applies whether you file electronically or on paper.6Internal Revenue Service. Employment Tax Due Dates If January 31 falls on a weekend or federal holiday, the deadline moves to the next business day.

Automatic extensions aren’t available for W-2s. Most other information returns get an automatic 30-day extension through Form 8809, but W-2s don’t. You can request a single 30-day nonautomatic extension on paper with a written justification, and no further extension is allowed after that. The IRS grants these only for narrow reasons: a catastrophic event in a federally declared disaster area, a fire or natural disaster that disrupted operations, or the death or serious illness of the person responsible for filing. If Electronic Filing Would Be a Hardship

You can request a waiver from the electronic filing rule using Form 8508. The request must be filed at least 45 days before the return’s due date, which puts the practical deadline for W-2s in mid-December of the prior year.9Internal Revenue Service. Two types of requests get streamlined treatment. First-time waiver requesters, meaning filers who have never requested a waiver for any form in any prior year, are automatically granted the waiver. Filers whose religious beliefs conflict with the required technology are automatically exempt and only need to file Form 8508 once to notify the IRS.

Everyone else has to show undue financial hardship. That means attaching two current third-party cost estimates comparing electronic filing against paper filing. Prior-year estimates aren’t accepted. Other qualifying grounds include lack of internet access, being a foreign entity unable to obtain filing software, or operating a business in its first year. Penalties if You File on Paper When You Shouldn’t Have

Filing on paper when the rule required electronic filing is treated as a failure to file. The penalty tiers for returns due in 2026 are:10Internal Revenue Service. Information Return Penalties

  • $60 per form if corrected within 30 days of the due date
  • $130 per form if corrected after 30 days but by August 1
  • $340 per form if corrected after August 1 or never filed
  • $680 per form for intentional disregard, with no annual cap

Annual maximums cap total exposure for the first three tiers. Large businesses face caps of $683,000, $2,049,000, and $4,098,500. Small businesses, defined as those with average annual gross receipts of $5 million or less over the three most recent tax years, have lower caps of $239,000, $683,000, and $1,366,000.11Internal Revenue Service. One important limit on the paper-when-required penalty: it applies only to the returns exceeding the 10-return threshold, not every return you filed. If you were required to file 15 W-2s electronically and put all 15 on paper, the penalty applies to 5 of them.1Federal Register. Employee Copies Are a Separate Question

The electronic filing rule governs how you file with the SSA. It doesn’t change your obligation to provide W-2 copies to employees by January 31. You can deliver those on paper or electronically, but electronic delivery requires the employee’s affirmative consent, along with a disclosure statement explaining the arrangement and a demonstration that the employee can access the electronic format. An employee who doesn’t consent still gets a paper copy. Once given, consent carries forward to future years until the employee revokes it, and the electronic version must contain every piece of information the paper form would.12Internal Revenue Service.
