Do You Get PMI Back? Refund Rules by Loan and Premium Type

Whether you get PMI back depends on how you paid for it. If you paid a single upfront premium for private mortgage insurance on a conventional loan, federal law entitles you to a refund of the unearned portion when coverage ends early, and your servicer has 45 days to send it. Monthly PMI is generally not refundable, because each payment buys that month’s coverage — the exception is money the servicer collected after your PMI should have already ended. FHA upfront mortgage insurance follows its own rules, with a partial credit available only if you refinance into another FHA loan within 36 months. Lender-paid PMI produces no refund at all, because you never paid a separate premium in the first place.

Single-Premium Conventional PMI: The Main Refund Case

If you paid your PMI as a lump sum at closing rather than as a monthly add-on, you have the strongest refund rights. Under the Homeowners Protection Act, once your PMI is canceled or terminated, your servicer must return all unearned premiums to you within 45 days.1Office of the Law Revision Counsel. 12 USC Chapter 49 – Homeowners Protection

“Unearned” means the part of your upfront payment that was meant to cover months of insurance you will no longer use. If you refinanced, sold the home, or paid off the loan before the policy would have expired on its own, those remaining months’ worth of premium belong to you. The insurer has 30 days after being told your PMI ended to send the unearned premium back to your servicer, and the servicer then has to pay you.1Office of the Law Revision Counsel. 12 USC Chapter 49 – Homeowners Protection Fannie Mae’s servicing guidelines tell servicers to forward the refund as soon as it arrives from the insurer, and in any case no later than 45 days after the termination date.2Fannie Mae. B-8.1-04, Termination of Conventional Mortgage Insurance

The size of the refund depends on how many months of coverage were left when the policy ended. The earlier your PMI ends, the more of your upfront premium comes back.

Monthly PMI: Refundable Only When You Were Overcharged

Monthly PMI premiums buy one month of coverage at a time. Once a month begins, that payment is earned, so there is nothing to refund for months already used. The refund scenario for monthly PMI is different: it applies when your servicer kept charging you after the insurance should have ended.

Federal law bars servicers from collecting PMI premiums more than 30 days after coverage is supposed to stop, whether the stopping point is your own cancellation request at 80 percent of original value, automatic termination at 78 percent, or final termination at the midpoint of the loan.1Office of the Law Revision Counsel. 12 USC Chapter 49 – Homeowners Protection Any premium collected past that deadline has to come back to you, usually as a credit to your escrow account or a direct payment. If you suspect you were charged past your termination date, pull your statements and compare them against when you first crossed the 78 or 80 percent line.

FHA Upfront MIP: A Refinance Credit, Not a Cash Refund

FHA loans use a different insurance program with its own refund rules. The upfront mortgage insurance premium on most FHA loans is 1.75 percent of the base loan amount.3U.S. Department of Housing and Urban Development. Appendix 1.0 – Mortgage Insurance Premiums If you refinance from one FHA loan into another FHA loan within 36 months of closing, part of that upfront premium follows you into the new loan as a credit against the new upfront premium. It is not paid to you as cash.4U.S. Department of Housing and Urban Development. Refunding a Payment

The credit shrinks by roughly two percentage points each month:

  • Month 1: about 80 percent of the original upfront premium
  • Month 12: about 58 percent
  • Month 24: about 34 percent
  • Month 36: about 10 percent
  • After month 36: nothing

To qualify, the original FHA loan must be current with no serious delinquencies, and it cannot be in foreclosure or an assumed mortgage. If you refinance into a conventional loan instead of another FHA loan, no credit is available.

HUD also issues certain automatic refunds outside the refinance context: for overpayments of the upfront premium, premiums submitted under invalid case numbers, and cases canceled before endorsement. Overpayment refunds go out roughly four weeks after endorsement; canceled-case refunds take six to eight weeks. Refunds you have to request go through HUD’s Single Family Insurance Operations Division and can take up to 60 days.4U.S. Department of Housing and Urban Development. Refunding a Payment

Lender-Paid PMI: No Refund

Lender-paid mortgage insurance is not refundable, because you never paid a separate premium. Your lender paid the insurer upfront and built the cost into your interest rate. That higher rate stays for the life of the loan even as your equity grows, and you cannot cancel the coverage or ask for a rate reduction when you hit 80 percent equity. The only way to get out of the added cost is to refinance, and refinancing produces new loan terms rather than a refund of the old insurance.

When Does Your PMI Actually End?

Because a refund depends on coverage ending, it helps to know what triggers that. The Homeowners Protection Act sets three ways conventional PMI comes off.

Your Own Request at 80 Percent

You can ask your servicer in writing to cancel PMI once your principal balance reaches 80 percent of the home’s original value, based either on the amortization schedule or on actual payments including any extra principal you have applied.5Office of the Law Revision Counsel. 12 USC 4901 – Definitions Original value is generally the lower of the purchase price or the appraisal at purchase, or the appraised value at the time of a refinance.6Consumer Financial Protection Bureau. When Can I Remove Private Mortgage Insurance (PMI) From My Loan The servicer has to stop charging PMI within 30 days of receiving your request and the evidence it requires.1Office of the Law Revision Counsel. 12 USC Chapter 49 – Homeowners Protection

Automatic Termination at 78 Percent

Even without a request, your servicer must automatically terminate PMI on the date your balance is first scheduled to reach 78 percent of original value under the initial amortization schedule.5Office of the Law Revision Counsel. 12 USC 4901 – Definitions Extra payments don’t move this date up; it runs on the original schedule.

Final Termination at the Loan’s Midpoint

If neither of the above has happened, PMI must end on the first day of the month after the midpoint of your amortization period, as long as you are current on payments.7Office of the Law Revision Counsel. 12 USC 4902 – Termination of Private Mortgage Insurance For a 30-year mortgage, that is year 15.

Cancellation Based on Current Value

If your home has appreciated, Fannie Mae guidelines allow cancellation before you hit 80 percent of original value: at 75 percent loan-to-value based on current value for loans under two years old, or 80 percent for loans that have been in place at least two years.2Fannie Mae. B-8.1-04, Termination of Conventional Mortgage Insurance Proving current value usually means paying for a new appraisal.

How to Get the Refund You’re Owed

Start with your servicer. Ask for their cancellation form and confirm what evidence they require. Your original PMI disclosure at closing lists the earliest date you can request cancellation, and if you can’t find it your servicer must provide the information.6Consumer Financial Protection Bureau. When Can I Remove Private Mortgage Insurance (PMI) From My Loan

Send your written request and supporting documents by certified mail with a return receipt, or through the servicer’s secure portal if it generates a confirmation number. Keep copies. After cancellation is processed, check your next statement to confirm the PMI line item is gone. If you paid a single upfront premium, your refund of the unearned portion should arrive within 45 days of the cancellation or termination date. Compare the amount against the remaining months of coverage the policy would have run.

If the Servicer Doesn’t Pay

If your servicer refuses to cancel PMI when you have met the requirements, or misses the 45-day refund window, the Homeowners Protection Act lets you sue. You can recover actual damages with interest from the date of the violation, statutory damages up to $2,000, and reasonable attorney fees and court costs. You have two years from discovering the violation to file, and the clock runs from when you learned about the problem rather than when it happened.8Office of the Law Revision Counsel. 12 USC 4907 – Civil Liability

Before going to court, a complaint to the Consumer Financial Protection Bureau is free and often resolves the dispute. The CFPB can require a servicer to reimburse unearned premiums collected after your PMI should have ended.6Consumer Financial Protection Bureau. Is a PMI Refund Taxable?

PMI premiums on qualified mortgage insurance contracts issued after 2006 have, in some years, been deductible as mortgage interest, subject to an income phase-out beginning at $100,000 in adjusted gross income and ending at $110,000. Lenders report premiums of $600 or more per loan on Form 1098, Box 5.9Internal Revenue Service. Instructions for Form 1098

If you deducted PMI premiums in a prior tax year and later receive a refund of those premiums, the refund may need to be included in your gross income for the year you receive it, under the tax benefit rule. If you never deducted the premiums, whether because you didn’t itemize or your income exceeded the phase-out, the refund is generally not taxable. A tax professional is worth consulting when the refund is large.
